Any resident of the City of Bismarck, Missouri, when desiring culvert pipe installation on City "Right of Way," shall first make written request to the City Clerk for City's permission to allow placement of culvert on said City "Right of Way." Upon receiving aforementioned request, the City Clerk shall notify the City Utility Superintendent of the pending petition.

The Superintendent shall assess the proposed installation site and shall report back to the City Clerk and testify as to whether the petition should be granted or denied. Should the Utility Superintendent deny the petitioner's request, he or she shall give written reason for his or her decision. The City Clerk shall then notify the petitioner of the Superintendent's decision.

The City resident petitioning the City for culvert-pipe installation assistance shall be responsible for purchasing the actual culvert pipe. Once the pipe has been purchased, the City Utility Crew shall install the pipe and supply one (1) dump truck load of gravel. Any additional gravel needed to complete the project shall be purchased by the petitioner at his or her expense.

The sections, paragraphs, sentences and clauses of this Article are severable; and if any section, paragraph, sentence, or clause of this Article is declared to be unconstitutional by a Court of competent jurisdiction, such unconstitutionality shall have no effect upon the remaining sections, paragraphs, sentences and clauses of this Article.
