Any business that wishes to engage in a temporary or periodical special event that is outside its normal operations shall be required to obtain a special event permit.
A. 
A business is defined as any sole proprietorship, corporation, limited liability corporation, or partnership.
B. 
An event outside of normal operations shall include promotional events that include activities and/or events not regularly conducted on the business premises such as a gathering at which food and beverages are supplied, tent sales, sales of items that are not normally a part of the business inventory or outside gatherings at which there are speakers and music.
The business shall purchase a special use license from the Village by application to the Village Clerk at least 30 days in advance of the event, which application shall provide information on the name of the business, any event sponsors, the type of activity planned, copies of any NYS licenses required for the event, a copy of the business owner's liability insurance policy showing coverage for the event planned, the name and telephone numbers of a contact person to be made available during the event and the dates and times that the event will be held.
The fee for issuance of the special event permit shall be $50 per day that the permit is in force or $250 for six months, payable upon application.
The Village may refuse to issue a permit upon good cause shown, such as criminal activity, traffic congestion due to the event, complaints from neighbors of noise, or refuse problems, lack of adequate facilities for the numbers of people that attended previous events, etc.
A violation of this chapter is punishable by a fine of not less than $250, and not more than $500, for each day that the event is held without issuance of a permit.
The business owners shall cooperate with all lawful directions of all police agencies, the Village of New York Mills Codes Officers and all laws of the State of New York, its subsidiaries and departments.
