All vendors or seasonal retail sellers of fireworks within the City of Bismarck, Missouri, must first apply and obtain a permit from the City authorizing said sale within the City limits. Each vendor and/or seasonal retailer shall pay an annual fee of two hundred fifty dollars ($250.00) per permit. Each permittee shall otherwise comply with all regulations and requirements as set forth in Chapter 320 of the Revised Statutes of Missouri. Said permits shall only be issued to "seasonal retailers" as that term is defined in Section 320.106, RSMo.

A person, vendor, seasonal retailer or other entity authorized to sell fireworks within the City of Bismarck may have in his, her or its possession bottle rockets within the City limits. Said person, vendor, seasonal retailer or other entity shall be permitted to possess and sell said bottle rockets whereat other fireworks are sold. The possession and sale of said bottle rockets by any person, vendor, seasonal retailer or other entity shall not constitute a violation of said person, vendor, seasonal retailer or entities' permit to sell fireworks within the City of Bismarck.

No person shall, within the City limits, set off or discharge any fireworks, including bottle rockets or any rockets that are similar to bottle rockets, without the written consent of the Mayor in which he/she shall specify the time and place when and where the same may be done. The mayor is hereby permitted to allow for the discharge of said fireworks and/or bottle rockets consistent with this Article. The violation of this provision shall be punishable in accordance with Chapter 100, Article III, of the Code of the City of Bismarck.
