This chapter is adopted for the purpose of promoting the orderly and safe parking of motor vehicles and the minimizing of traffic congestion in the City of Lambertville.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle I of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the City.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Whenever snow has fallen and the accumulation is such that it covers the street, an emergency shall exist and no vehicle shall be parked on the streets, or portions thereof as set forth in subsection 7-4.8 of this chapter. The above parking prohibition shall remain in effect after the snow has ceased falling until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Parking may also be temporarily prohibited upon any of the streets of the City by the Chief of Police for weddings, funerals or when the Chief determines that a parking emergency exists. When such a determination is made, then there shall be no parking upon the streets or sections of streets where temporary "emergency no-parking" signs are displayed.
c. 
Any vehicle which is disabled to the extent that the operator can not move it due to mechanical failure or weather conditions or any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
d. 
The provisions of paragraphs a., b and c shall not apply to any firefighting equipment, ambulances or other emergency equipment actively engaged in dealing with an emergency in the City.
e. 
Parking by Emergency Personnel.
1. 
Definitions.
EMERGENCY
Shall mean any fire, flood or natural disaster or state of emergency as determined by the Mayor or his designee, the Municipal Coordinator of Emergency Management or the Police Director.
EMERGENCY PERSONNEL
Shall mean all active members of the Lambertville Police Department, the Fire Departments of the City of Lambertville and the Lambertville-New Hope Ambulance and Rescue Squad.
PARKING REGULATIONS
Shall mean those regulations controlling parking whether set forth in the statutes of the State of New Jersey or the Code of the City of Lambertville.
2. 
During periods of emergency, all parking regulations shall be suspended for emergency personnel from the commencement of the emergency until two hours following its conclusion.
3. 
The Fire Chief and the Chief of the Lambertville-New Hope Ambulance and Rescue Squad will provide the Clerk of the City of Lambertville with applications, approved by the respective Chief, for emergency parking permits for all active members.
4. 
Emergency parking permits will be issued by the City Clerk based upon said application and will expire on December 31st of the year of issuance.
5. 
Permits will be issued on a yearly basis and may be issued at any time during the year.

[The handicapped parking space adjacent to 7 Ferry Street was removed at the request of the City in December 2022.]
a. 
A handicapped parking space is a special designation to provide a parking space for those individuals with medical needs which preclude their ability to walk any distance to their residence. It must be created by ordinance and carries a minimum fine of $100 for misuse. In a city where parking is limited, the approval of a handicapped parking space which serves to further restrict parking in residential neighborhoods needs to be evaluated by the Mayor and Council.
1. 
All requests for designation of a handicapped parking space shall be in writing and certify that there is no off-street parking at this location.
2. 
Include a copy of the handicapped placard issued by the New Jersey Motor Vehicle Commission.
3. 
Include a copy of the applicant's current motor vehicle license and registration.
4. 
If the applicant does not drive or does not own a vehicle, then the license and registration of the member of the household who is responsible for driving the applicant shall be included.
5. 
The information shall be forwarded to the Public Works Director and Chief of Police for review and comment.
6. 
The information will be presented to the Council at the next regularly scheduled meeting.
7. 
The Mayor and Council will consider the written comments from the Police Director and Public Works Director citing the availability of parking in that area on a regular day, the need for a handicapped parking space in that vicinity and other pertinent factors.
b. 
No person shall park a vehicle at any time upon any of the streets or parts of streets described herein except:
1. 
Persons issued handicapped persons identification cards by the Director of Motor Vehicles pursuant to N.J.S.A. 39:4-205 and the vehicle bears a wheelchair symbol license plate or a placard issued by the Director of the Motor Vehicle Commission which is properly displayed on such vehicle pursuant to N.J.S.A. 39:4-206; and
2. 
Temporary handicapped persons who shall be issued a temporary placard by the Chief of Police of any municipality in the State of New Jersey pursuant to N.J.S.A. 39:4-206, and the vehicle displays such temporary placard.
3. 
In accordance with provisions of N.J.S.A 39:4-197(3)c and notwithstanding any other provisions of this chapter, any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $250 for the first offense, and for subsequent offenses, a fine of at least $250 and up to 90 days community service, on such terms and in such form as the Court shall deem appropriate, or any combination thereof.
c. 
The removal of a handicapped parking space shall be at the discretion of the Mayor in consultation with the Police Director and Public Works Director after notification is received that the space is no longer necessary.

A violation of the following subsections shall result in a fine as follows:

Subsection 7-4.2, Parking Prohibited During State of Emergency, and Subsection 7-4.8, No Parking Snow Emergency, may be satisfied by payment to the Municipal Court of a fine of $36 plus any fees required by the State of New Jersey;

Subsection 7-4.4, Parking Prohibited Certain Hours, may be satisfied by payment to the Municipal Court of a fine of $26.
b. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to the penalties contained in Chapter 1, § 1-5, General Penalty.

All former traffic ordinances of the City of Lambertville which are inconsistent with this Traffic Chapter are hereby repealed to the extent of such inconsistency. This repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

Church of St. John the Evangelist, owners of the property, has filed a written consent with the City of Lambertville that the provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public road at Church of St. John the Evangelist Cemetery that the City enforce and patrol the private road that connects South Franklin Street with Boozer Street.
b. 
All signs, posts or other necessary materials shall be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniformed Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
c. 
Unless other penalty is expressly provided by the New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $1,250 or imprisonment for a term not exceeding 90 days or both.
d. 
If any of this subsection is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this subsection.
e. 
All ordinances or parts of ordinances inconsistent with this subsection are hereby repealed to the extent of such inconsistency.
f. 
This subsection shall take effect upon the final passage and publication according to law and approval by the New Jersey Department of Transportation.
