Be it ordained by the Mayor and Council of the Borough of Woodstown,
in the County of Salem and State of New Jersey:

Pursuant to the Uniform Fire Safety Act, N.J.S.A. 52:27D-192,
et seq., there is hereby enacted an ordinance to be entitled Woodstown
Fire Prevention Code. This chapter shall be so designated, and said
title shall constitute the local ordinance enforcing the provisions
of the Uniform Fire Safety Act.
Pursuant to N.J.S.A. 52:27D-202 and pursuant to N.J.A.C. 5:70-1,
et seq., and such amendments and additions as shall hereafter be adopted,
the New Jersey Uniform Fire Code shall be locally enforced in the
Borough of Woodstown, Salem County, New Jersey.
The local enforcing agency shall be the Woodstown Bureau of
Fire Prevention.
The local enforcing agency shall enforce the Uniform Fire Safety
Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Borough
of Woodstown, other than owner-occupied one- and two-family dwellings
used exclusively for dwelling purposes, and premises owned or operated
by the federal government, interstate agencies or the State of New
Jersey. The local enforcing agency shall faithfully comply with all
the pertinent requirements of the Uniform Fire Safety Act and the
Uniform Fire Code.
The Fire Official employed through the local enforcing agency established by Section 57-3 of this chapter shall report to the Chairman of the Public Safety Committee of the Woodstown Borough Council.
A.
Appointment of inspectors and employees. The Fire Official and such
inspectors and other employees as may be necessary in the local enforcing
agency shall be appointed by the Woodstown Borough Council. The Fire
Official shall be certified by the state prior to appointment by the
Governing Body.
B.
Term of office. The Fire Official shall serve for a term of four
years. Any vacancy shall be filled for the unexpired term.
C.
Removal from office. The Fire Official shall be subject to removal
by the Woodstown Borough Council for inefficiency or misconduct. Each
employee to be so removed shall be afforded an opportunity to be heard
by the Woodstown Borough Council or a designated hearing officer,
which hearing shall be conducted consistent with the due process requirements
of the New Jersey Constitution.
Pursuant to N.J.S.A. 52:27D-206 and 208 of the Uniform Fire
Safety Act, any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Salem County Construction
Board of Appeals.
The Bureau of Fire Prevention established by Section 57-3 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.
A.
In addition to the registrations required by the Uniform Fire Code,
the following non-life hazard uses shall register with the Bureau
of Fire Prevention. These uses shall be inspected once per year and
shall pay an annual fee as set forth below:

B.
R/A uses shall be inspected and charged a fee only upon sale or change
of tenant.
C.
Uses not classified above that are subject to the Uniform Fire Code
shall be classified as business uses.
D.
Uses required to register with the state as life hazard uses shall
not be required to register under this section.
E.
Vacant buildings which create a fire hazard shall be charged and
inspected according to the previous use of the building.
The application fees for the permits listed in N.J.A.C. 5:70-2.7
shall be as provided by state regulation.
The Woodstown Borough Solicitor is specifically appointed to
assist the local enforcing agency as necessary to enforce the provisions
of this chapter, applicable statutes and administrative regulations.
The Woodstown-Pilesgrove Regional School Board shall be exempt
from Type 1 through Type 4 permit and inspection fees but shall not
be exempt from the payment of the life-hazard use fees to the extent
that same may be applicable. Life-hazard uses are as defined in N.J.S.A.
52:27D-196(e). Notwithstanding the exemption from fees, the school
board must still obtain all permits and be subject to all inspections
required by law.
Enforcement, violations and penalties shall be managed in conformity
with the Uniform Fire Safety Act, the Uniform Fire Code and all other
laws of the State of New Jersey.
