As used in this chapter, the following terms shall have the meanings indicated:
EQUIPMENT AND APPARATUS
Any item or items, whether permanent or mobile, that require for their use the congregation of one or more persons in and about the immediate area of the item or items. This definition is intended to include, but is not limited to, basketball hoops and hockey goals.
PERSON
Includes individuals, firms, partnerships, corporations and unincorporated associations.
A. 
No person shall place or maintain any encroachment, obstruction or encumbrance in, over or upon any street, avenue, highway, road or lane of the Borough of Lawnside which in any way impedes or interferes with the safe, free or unobstructed use of the street by the public.
B. 
No equipment or apparatus shall be placed by any person in a public right-of-way or on private property in the vicinity of any public right-of-way such that the use of the equipment or apparatus would tend to require any user to be in and about the public right-of-way.
C. 
No person shall place or store any structure, equipment, vehicle or other material or article upon any borough street so as to interfere with the flow of water along gutters or to interfere with traffic on any such street unless as otherwise provided by borough ordinance.
D. 
Any person who violates or fails to comply with any provision of this Article which results in obstruction or damage of any borough street shall, upon notice from the borough police, remove the obstructions.
Any person who violates or fails to comply with any provision of this Article which results in the damage to or obstruction of any borough street, gutter, storm drain, or culvert, shall be responsible for all expenses incurred by the borough in repairing said damage or removing said obstruction, in addition to the penalty provided in Section 124-21 of this Article.
A. 
Any person who violates or fails to comply with any provision of this Article or who violates or fails to comply with any order made pursuant to this Article shall be subject to a warning for the first violation, a fine of $250 for the second violation and a fine not to exceed $500 for each subsequent offense. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
B. 
There shall be a presumption that the person or persons who have violated this provision are (1) those who control the private property on which the equipment or apparatus is situated, or if the equipment or apparatus is in a public right-of-way, (2) those who control the private property closet to the equipment or apparatus.
