Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police of the Borough, or in his/her absence, disability or inability to act, the ranking member of the Police Department, is hereby authorized to provide, by regulation, for the closing of any street, or portion thereof, to motor vehicle traffic on any day or days, during specified hours on any day or days, whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police, and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of a regulation promulgated hereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

a. 
Any vehicle parked in violation of this chapter or the provisions of Title 39 of the New Jersey Statutes shall be deemed a nuisance and menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle.
b. 
The vehicle shall be towed by the operators of towers and wreckers authorized pursuant to provisions of Chapter 4, Section 4-6, Towers and Wreckers, and subject to the storage and fee provisions of Section 4-6, and as same may be amended.

Unless another penalty is expressly provided by New Jersey statute, or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Ringwood are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The Governing Body finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below ground, which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.
The Borough of Ringwood, in the County of Passaic, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of the Borough of Ringwood is in violation of this section.

The person, contractor or utility shall provide the Police Department with at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contact must be made, or if the emergency contact person does not respond to a call from the Police Department to correct such hazardous condition, the Borough may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Borough shall be charged to the person, contractor, or utility responsible for the condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Traffic Bureau of the Police Department. If it is determined by the officer in charge of the Traffic Bureau of the Police Department that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m.

Road closings and/or traffic detours shall not be permitted unless approved by the Borough of Ringwood Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Borough Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Traffic Bureau of the Ringwood Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk until all construction, signs, lights, devices and pavement markings are installed.

In the case of emergency repair work where construction maintenance operations or emergency utility work must be performed that will obstruct, interfere or detour traffic on any roadway in the Borough, the person, contractor or utility performing such operation shall notify the Ringwood Police Department of such emergency operation. The person, contractor or utility shall disclose the nature of the emergency, location and hours of operation.
All emergency construction and maintenance operations shall be performed with full regard to safety and to keep traffic interference to an absolute minimum. During such emergency repair work, the person, contractor, or utility shall comply with the provisions of the M.U.T.C.D. while performing such emergency repair work.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This chapter shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this section is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets and highways of the Borough of Ringwood, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
b. 
The parking prohibitions listed below shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
c. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
d. 
The effectiveness of this section is contingent upon the signs being erected as required by law.

The owners of the premises referred to in subsections 7-40.2 and 7-40.3 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

The penalty for a violation and conviction of this section shall be not less than $50 nor more than $1,000 and/or imprisonment in the county jail for a term not to exceed 90 days, or by a period of community service not to exceed 90 days.

No vehicle shall be parked in an area designated "Park and Ride Commuter Parking Area" unless it displays a valid and current parking permit issued by the Borough Clerk. The Borough of Ringwood is not responsible for any damage incurred in the Ringwood Park and Ride.
The permit must be fixed to the bottom left corner of the driver's side passenger window.

Application for Permit. A parking permit shall be issued annually for the period July 1 to June 30 upon application to the Borough Clerk and only upon the display of a current and valid motor vehicle registration certificate for all household vehicles showing the name and address of the applicant and proof of insurance coverage.
b. 
Permit Fee.
1. 
Fees shall be $150 per annum. The yearly permit runs July 1 to June 30.
2. 
For any permit issued for a six-month period, the fee for the six months shall be $80. The first six-month period is July 1 - December 31. The second six-month period is January 1 - June 30.
3. 
For any permit issued on a quarterly basis, the fee for each quarter shall be $45. The first quarter is July 1 - September 30; the second quarter is October 1 - December 31; the third quarter is January 1 - March 31; and the fourth quarter is April 1 - June 30.
4. 
For any permits issued on a monthly basis, the fee for the month shall be $30. The month starts on the first of the month and ends on the last day of the same month.
5. 
For any permit issued on a weekly basis, the fee for any week shall be $10. A weekly permit is Monday through Sunday.
c. 
Permit Nontransferable. Parking permit shall be issued to the household and shall be nontransferable to persons outside that household.
d. 
Sale or Purchase of Vehicle. Applicant shall notify Borough Clerk of any deletions or additions of household vehicles.
e. 
Contents of Permit. All parking permits shall have written thereon "Borough of Ringwood Parking Permit" together with the number of the permit.
f. 
Records. The Borough Clerk shall keep a record of all permits by number, date of issuance, name and address of person to whom issued, make, model, color and year of the motor vehicle for which issued.

Day parking shall be by appointment only. Applicant shall contact the Borough Clerk, in person, by phone or email to request a day parking permit. Applicant will provide information regarding the vehicle being used for that day to the Borough Clerk.
The Borough Clerk may permit parking as provided in this subsection for a limited period of time greater than one day, under special and exceptional circumstances.

After a parking permit has been affixed to the motor vehicle, the applicant may park the motor vehicle in the area provided, within the lines established for the parking of one motor vehicle, daily throughout the year, except between the hours of 2:00 a.m. and 5:00 a.m. If a permit-bearing vehicle is to remain in the lot between 2:00 a.m. and 5:00 a.m., the owner shall notify the Police Department.
Parking shall be limited to a private passenger car, vans and those trucks not exceeding 1 1/2 tons, (7,500 RGVW [registered gross vehicle weight]).

If the number of applicants shall exceed the number of spaces available, the Borough Clerk will hold a lottery among the applicants. The lottery will be in three sections:
a. 
Spaces allocated for residents of Ringwood;
b. 
Spaces allocated for the general public; and
c. 
Handicapped parking spaces. The residents' lottery will be held first. Applications of residents who lose the residents' lottery will be placed in the general public lottery. Remaining applications will be held and additional lotteries will be performed throughout the year for any cancellation of parking permits.

In the event that any permit shall be lost, mislaid, or destroyed, the holder of such permit shall make application to the Borough Clerk for the issuance of a substitute. The charge for the issuance of a substitute permit shall be $10.
