There is hereby established the Department of Finance of the
Borough of Bloomingdale, consisting of a Chief Financial Officer,
Treasurer, Assistant Treasurer and such other personnel as the governing
body may appoint.

a. Position Created; Qualifications.
1. The position of Chief Financial Officer is hereby created pursuant
to the provisions of N.J.S.A. 40A:9-140.10 et seq. to carry out the
responsibilities set forth under N.J.S.A. 52:27BB-26 et seq.
2. The Chief Financial Officer shall be a Certified Municipal Finance
Officer in accordance with N.J.S.A. 40A:9-140.13. The position may
be full-time or part-time as established by the governing body. A
full-time Chief Financial Officer may also serve as Treasurer. The
Chief Financial Officer shall exercise fiscal supervision of the Department.
b. Residency Requirements. The Chief Financial Officer need not be a
resident of the Borough.
c. Appointment. The Chief Financial Officer shall be appointed by the
governing body.
d. Term. The term of office for the Chief Financial Officer shall be
four years, which shall run from January 1 in the year in which the
Chief Financial Officer is appointed.
e. Conflicts of Interest. The Chief Financial Officer shall not have
any interest, directly or indirectly, in any contract, subcontract,
job for work, materials for services or the profit thereof to be furnished
to or performed for the Borough.
f. Additional Employment. The Chief Financial Officer shall hold no
other employment, nor engage in any activities for profit without
the consent of the governing body by resolution duly adopted. The
decision as to whether the Chief Financial Officer shall be given
such consent shall be in the unreviewable discretion of the governing
body.

The Municipal Treasurer shall be appointed by the governing
body. The Municipal Treasurer shall assist the Chief Financial Officer
in the work involved in the disbursement, accounting and reconciliation
of funds received and disbursed, in the negotiations of loans and
sale of bonds, investment of funds and preparation of payroll. The
Municipal Treasurer must have five years of supervisory accounting
experience in work involving the installation, operation and reconciliation
of a large-scale system of accounts, two years of which shall have
been in municipal accounting or auditing.

The Assistant Municipal Treasurer shall be appointed by the
governing body. The Assistant Municipal Treasurer shall assist the
Treasurer in the work involved in the disbursement, accounting and
reconciliation of funds received and disbursed, in the negotiation
of lands and sale of bonds, investment of funds and preparation of
payroll. The Assistant Municipal Treasurer must have three years of
supervisory accounting experience in work involving the installation,
operation and reconciliation of a large-scale system of accounts,
one year of which shall have been in municipal accounting or auditing.

The terms of the Municipal Treasurer and Assistant Municipal
Treasurer shall be four years, which shall run from January 1 in the
year in which the Municipal Treasurer or Assistant Municipal Treasurer
is appointed.

There may be a Payroll Clerk and such other personnel as the
governing body shall appoint. The Payroll Clerk shall have as his/her
primary duties the preparation of payroll, maintenance of Workers'
Compensation records and such other duties as required.

Compensation for all positions in the Finance Department shall
be as provided in the annual Salary Ordinance.

There is hereby established the Department of Revenue of the
Borough of Bloomingdale. The Department shall consist of a Division
of Tax Collection and a Division of Tax Assessment.

a. Office Created. Pursuant to N.J.S.A. 40A:9-141 et seq., there is
hereby created the office of Tax Collector of the Borough of Bloomingdale.
b. Qualifications. The Tax Collector shall be a person not less than
21 years of age, a citizen of the United States and shall meet all
of the requirements of N.J.S.A. 40A:9-141 et seq. as they become applicable.
c. Duties; Term.
1. The Tax Collector shall be charged with the duty of collecting taxes
upon the real personal property in the municipality and with all duties
attendant thereto.
2. The Division of Tax Collection shall be directed by the Tax Collector,
who shall hold a Tax Collector Certificate in accordance with N.J.S.A.
40A:9-145.7. The term of the Tax Collector shall be four years from
the first day of January next following his/her appointment or as
provided by N.J.S.A. 40A:9-142. The Tax Collector shall also serve
as Collector of Arrears of Taxes. When the Tax Assessor serves part-time,
the Tax Collector shall have administrative supervision over any other
employees in the Division of Tax Assessment.
d. Appointment. The Tax Collector shall be appointed by the Mayor with
the advice and consent of the full authorized membership of the Council.
e. Clerical. There may be a Clerk/cashier and such other personnel as
the Mayor and Council shall appoint. They shall assist the Tax Collector
in the collection of taxes and such other work as may be required.

a. Authorization. The provisions of an Act of the Legislature of the
State of New Jersey entitled, "An Act Authorizing and Empowering Townships
and Boroughs in this State to Appoint a Board of Assessors to Make
Assessment for Taxes Therein and to Regulate Salaries and Compensation
of the Members Thereof," approved March 31, 1926, hereby are accepted
and adopted.
b. Assessor of Borough. There shall be created the Office of Tax Assessor
for the Borough of Bloomingdale.
c. Powers and Duties of Assessor; Term.
1. The office of Tax Assessor shall consist of one Assessor of Taxes
for the Borough to appraise and value the property of the Borough
and perform all of the duties imposed by the law upon an Assessor
in a borough.
2. The Division of Tax Assessment shall consist of one Assessor of Taxes
for the Borough to appraise and value the property of the Borough
and perform all of the duties imposed by the law upon an Assessor
in a borough.
3. The Division of Tax Assessment shall be directed by the Tax Assessor
who shall hold a Tax Assessor Certificate in accordance with N.J.S.A.
54:1-35.30. The term of the Tax Assessor shall be four years from
the first day of July next following his/her appointment or as provided
for in N.J.S.A. 40A:9-148.
d. Appointment. The Tax Assessor shall be appointed by the Mayor with
the advice and consent of the full authorized membership of the Council.
e. Clerical. There may be one or more clerical employees as the Mayor
and Council may appoint from time to time. They shall be responsible
for aspects of the Division as may be assigned. If the Tax Assessor
is part-time, administrative supervision of clerical personnel shall
be under the Tax Collector. The Tax Assessor's clerical personnel
shall be assigned duties and responsibilities from the Tax Assessor.

Compensation for all positions in the Revenue Department shall
be provided in the Salary Ordinance.

A Department of Public Works is hereby created which is to have
five divisions as follows:
(1) The Division of Sanitation and Recycling;
(2) The Division of Public Buildings and Grounds;
(4) The Division of Automotive and Equipment Maintenance; and
(5) The Division of Municipal Utility Services.
The Department of Public Works shall be organized as follows:

The position of Superintendent of Public Works is hereby created.
The Superintendent shall be responsible:
a. To the Council for the general policies and procedures of the Department.
b. To the Borough Administrator for the overall administration of the
Department.
c. For project planning and control.
d. For processing purchasing beyond requisitioning and keeping all the
records of same according to the voucher-encumbrance system in effect.
e. For handling matters, including all citizen complaints, involving
citizen-owned property and for the prompt response to same to the
satisfaction of the citizen and the Borough administration, whenever
possible.
f. As Equipment Manager of the Borough, for the prompt repair and maintenance
of all vehicles and equipment according to a comprehensive preventive
maintenance program.
g. For special studies to promote the efficiency and effectiveness of
the Department.
h. For developing, implementing and updating a safety program for the
Borough and for compliance of the Department of Public Works with
all State Statutes and regulations pertaining to the functions of
the Department of Public Works.
i. For developing, in conjunction with the offices of the Borough Administrator,
annual, three and five year programs for public works and Borough
property and equipment, including drainage improvement and road maintenance
and vehicles, as input to the capital budget.
j. For preparing the Department budgets.
k. For supervising all the daily operations in the Division of Sanitation
and Recycling; the Division of Public Buildings and Grounds; the Division
of Roads; the Division of Automotive and Equipment Maintenance; and
the Division of Municipal Utility Services.
l. For assigning the appropriate personnel to the daily tasks.
m. For supervising the employees assigned to the Department of Public
Works in their assigned tasks.
n. For maintaining accurate time logs for all the assigned employees.
o. For verifying all the requested purchase vouchers.
p. For performing or assigning all administrative functions.

The position of Assistant Superintendent of Public Works is hereby created. The Assistant Superintendent shall assist the Superintendent in the performance of the Superintendent's duties as set forth in Subsection
2-34.2 in the manner as may be directed by the Superintendent. In addition, the Assistant Superintendent shall perform all the duties of the Superintendent in the absence or inability of the Superintendent to perform such duties.

Employees of the Department of Public Works shall be under the
direct supervision of the Superintendent of Public Works.

The Superintendent shall have the authority to assign employees
and equipment among the various divisions of the Department.

The Division of Public Buildings and Grounds shall be responsible
for maintenance of all Borough-owned buildings, all Borough-owned
parks, and any other public property.

The Division of Roads shall be responsible for maintenance and
construction of all municipally-accepted streets and roads; maintenance
and construction of the municipal storm drain system; and planning
and implementation of snow removal and sanding operations.

If the Borough has undertaken to collect refuse and recycling,
the Division of Sanitation and Recycling shall be responsible for
such collection within the Borough limits and its deposit at the disposal
sites designated by the Borough.

The Division of Automotive and Equipment Maintenance is responsible
for the maintenance of all Borough-owned vehicles and equipment.

The Division of Municipal Utility Services is responsible for the operation and maintenance of the water supply system and the sanitary sewer disposal system. The Division of Municipal Utility Services shall operate in accordance with, and be governed by, any all provisions comprising Chapters
17, Water, and
18, Sewers, of the Revised General Ordinances of the Borough of Bloomingdale, and any and all applicable rules and regulations heretofore duly enacted by the Borough of Bloomingdale.

a. Position Created. The position of General Foreman of the Department
of Public Works is hereby created.
b. Appointment; Compensation. Pursuant to N.J.S.A. 40A:9-154 et seq.,
a General Foreman shall be appointed by the Mayor with the advice
and consent of the Council. His or her compensation shall be fixed
in the Salary Ordinance.
c. Powers and Duties. The duties of the General Foreman shall be any
Department of Public Works duties as assigned by the Superintendent
or Assistant Superintendent of Public Works. The General Foreman shall
report any problems to the Superintendent.

The Police Department of the Borough of Bloomingdale is hereby
established and shall consist of a Chief of Police, not more than
two Captains, not more than four Lieutenants, not more than 10 Sergeants,
a minimum of eight but not more than 25 patrolmen and not more than
four special officers.

The officers and members of the Police Department shall be appointed
by the Borough Council to hold office as provided by law and shall
receive such salary as the Township Council may determine.

The Borough of Bloomingdale Council/Mayor shall serve as the
appropriate authority, as the same is defined in N.J.S.A. 40A:14-118,
to whom the Police Chief shall be directly responsible for the efficiency
and routine day-to-day operations of the Police Department.

The Mayor shall, each year as soon after the reorganization
of the Borough Council as may be possible, select and designate three
members of the Township Public Safety Committee who shall constitute
the Police Committee. The Mayor shall designate one of the members
as Chairman of the Committee, who shall be known as the Public Safety
Chairman, and the second member as Vice Chairman, who shall be known
as the Deputy Chairperson. Subject to the direction of the Police
Committee and further subject to the authority vested in the Borough
Council, the Public Safety Chairman or, in the case of his/her absence
from the Borough of Bloomingdale for more than three days, the Deputy
Chairperson shall oversee the operations of the Police Department.

The Borough Council shall establish by resolution and may from
time to time amend and repeal by resolution such rules and regulations
as it may deem necessary for the government and efficient working
of the entire Department. When adopted, these rules and regulations
shall be posted at Police headquarters by the Police Commissioner
within five days after their adoption, and a copy thereof shall be
delivered to each member of the Department within five days after
adoption.

a. Each applicant for membership in the Police Department shall be a
United States citizen and shall comply with all of the laws of the
State of New Jersey pertaining thereto. The applicant must be of good
moral character, sound in body and in good health, able to read, write
and speak the English language well and intelligently and shall possess
a New Jersey driver's license which is in effect at the time of his/her
appointment.
b. No person shall be given nor shall be/she accept a permanent appointment
in the Borough as a Police Officer unless such person has successfully
completed a police training course at a school approved and authorized
by the Police Training Commission in the Department of Law and Public
Safety, pursuant to the Police Training Act, N.J.S.A. 52:17B-66 et
seq.
c. A qualified person for the Borough of Bloomingdale Police department
shall be given a probationary or temporary appointment as a Police
Officer in the Borough for a total period not exceeding one year for
the purpose of enabling the person seeking permanent appointment to
take a police training course as prescribed in the Police Training
Act, N.J.S.A. 52:17B-66, et seq. However, the time period set forth
above may exceed one year for those persons enrolled prior to the
one-year limit in a police training course scheduled to end subsequent
to the one-year limit, and for those persons who, prior to the one-year
limit have been scheduled to attend a police training course which
commences subsequent to the one-year limit. In no case shall any extension
be granted for the reasons herein listed exceed six months.
d. Upon successful completion of the police training course as set forth in Subsection
c herein, the probationary or temporary appointment of the person shall continue for 12 months. The purpose of the additional twelve-month probationary or temporary appointment is to permit the Borough of Bloomingdale to determine whether the person satisfactorily performs his/her duties as a Borough Police Officer. The additional twelve-month probationary or temporary appointment period shall commence on the date of graduation from the police training course set forth above.

Each member of the Police Department shall, before entering
upon the performance of his duties, take and subscribe an oath to
bear true faith and allegiance to the government established in this
State, to support the Constitution of the United States of America
and the State of New Jersey and to faithfully, impartially and justly
discharge and perform all the duties of his office, which oath or
affirmation shall be filed with the Clerk.

a. The Chief of Police shall be the executive head of the Police Department
and shall be responsible to the Public Safety Committee. The Chief
of Police shall, with the consent of the Police Chairman, appoint
an officer holding the rank of Sergeant or higher to act as the officer
in charge. The officer in charge, in the event of a planned absence
of the Chief of Police, shall be required to perform all of the duties
and he shall maintain all of the responsibilities of the Chief of
Police as delineated by both local ordinance and State statute. In
the event of the unplanned incapacitation of the Chief of Police,
the officer in charge, as previously designated by the Police Chief,
shall perform the above functions until such time as the Borough Council
shall meet to select an officer in charge.
b. The control and discipline of the Police Department and of its members
shall be vested in the Chief of Police and he shall have the power
to enforce all the rules and regulations herein provided and any general
and special orders or instructions which he may from time to time
promulgate, provided that such rules, regulations, general or special
orders or instruction do not conflict with the rules and regulations,
orders or instructions issued by resolution of the Borough Council
or promulgated by the Public Safety Committee. He shall enforce these
rules and regulations, orders or instruction, whether promulgated
by him or by the Public Safety Committee or by the Township Council,
and may punish their violation by reprimand. If the Chief deems the
violation to be of a sufficiently flagrant nature, he shall report
it to the Public Safety Committee with his recommendations with reference
to the filing of charges.
c. The Chief of Police, with the assistance of the other members of
the Department who are detailed for the purpose, shall keep a complete
record as prescribed in the rules and regulations adopted by the Borough
Council, and the Chief of Police shall report to the Chairman of the
Public Safety Committee for presentation to the Borough Council at
its first regular meeting in each month on all matters of importance
pertaining to the Department and make such recommendations as in his
opinion will increase the efficiency of the Department.
d. The Chief of Police shall recommend to the Police Committee from
time to time the purchase of new equipment or the repair or rearrangement
of such old equipment as will increase the efficiency of the Department.
He shall have full charge and control of all the apparatus and equipment
of the Department and its assignment and use and shall be held responsible
for its care, cleanliness and safekeeping.
e. The Chief of Police shall, at his discretion, assign members of the
Bloomingdale Police Department to work assigned work functions, and
the officers assigned within these functions may be changed from time
to time as necessary to efficiently carry out the duties of the Department.

The Police Department, through its Chief, shall:
a. Preserve the public peace; protect life and property; prevent crime;
detect and arrest offenders against the penal laws and ordinances
effective within the Borough; suppress riots, mobs and insurrections;
disperse unlawful or dangerous assemblage; and preserve order at all
elections and public meetings and assemblages.
b. Administer and enforce laws and ordinances to regulate, direct, control
and restrict the movement of vehicular and pedestrian traffic and
the use of the streets by vehicles and persons; to protect the safety
and facilitate the convenience of motorists and pedestrians; and to
make and enforce rules and regulations not inconsistent with the ordinances
and resolutions of the Borough for such purposes.
c. Remove or cause to be removed all nuisances in the public streets,
parks and other public places of the Borough of Bloomingdale and inspect
and observe all places of public amusement or assemblage and all places
of business requiring any State or municipal license or permit and
report thereon to the appropriate department.
d. Provide proper police attendance and protection at fires.
e. Provide for the attendance of its members in court as necessary for
the prosecution and trial of persons charged with crimes and offenses
and shall cooperate fully with the law enforcement and prosecuting
authorities of Federal, State and county governments.
f. Operate a training program to maintain and improve the police efficiency
of the members of the Department.

a. The Chief, subject to the approval by resolution of the Borough Council,
may appoint Special Policemen for terms not exceeding one year and
may revoke such appointments without cause or hearing. Special policemen
shall carry out their duties and responsibilities under the direct
supervision of the Chief of Police, and their powers, rights and duties
shall be specifically defined by the Chief of Police. The powers,
rights and duties shall immediately cease at the expiration of the
term for which they were appointed or upon revocation of their appointment.
Special Officers shall not carry revolvers or other weapons at any
time except as otherwise directed by the Chief of Police. The resolution
approving appointment of Special Police Officers shall designate the
rate of pay, if any.
b. No person shall be appointed as a Special Policeman unless he is
a citizen of the United States, is able to read, write and speak the
English language, is physically qualified and of good moral character
and has not been convicted of any crime. Every such Special Policeman
shall be fingerprinted and his fingerprints shall be filed with the
Division of the State Police and the Federal Bureau of Investigation.
Reports shall be made by the Chief of Police to the Borough Council
concerning the eligibility and qualifications of any person proposed
to be appointed as a Special Policemen.

The hours of employment of uniformed members of the Police Department
shall not exceed 16 consecutive hours in any one day, provided that,
in case of an emergency, the officer, board or other official having
charge or control of the Police Department or the police system shall
have full authority to summon and keep on duty any and all such members
during the period of emergency.

a. Each regular Police Officer shall hold his office and continue in
employment during good behavior and efficiency, and no person shall
be removed from office or employment for any other causes that incapacity,
misconduct, neglect of duty, conduct unbecoming a Police Officer,
disobedience of the rules and regulations established or hereafter
established for the Department or absence from duty without just cause
for five days or more.
b. Any member of the Department may be suspended, removed, fined or
reduced from his office or employment for just cause upon due notice
and service of written charges and a hearing.

All members of the Police Department shall provide and maintain
in clean and serviceable condition such wearing apparel and equipment
as is prescribed by the Police Chief. The first uniform(s) shall be
furnished at the expense of the Borough.

All firearms shall be provided by the Borough and shall remain
the property of the Borough.

Promotion denotes vertical movement in the organizational hierarchy
from one rank classification to another, accompanied by increases
in salary. Validity of the promotional process can only be accomplished
through clear concise procedures. A promotional process has been developed
to identify employees who possess the ability to assume greater responsibilities
combined with the necessary skills and knowledge to perform competently
at a higher organizational level. This policy is established for the
positions of Sergeant, Lieutenant, Captain and Chief of Police.
a. Promotional Responsibilities - Chief of Police/Police Promotional
Committee.
1. The Police Chief or his/her designee shall be responsible for all
examination phases of the promotional process for the positions of
Sergeant, Lieutenant and Captain. The Mayor, Council, and Police Promotional
Committee shall be responsible for the promotional process for Chief
of Police.
2. No member of the Police Department shall be promoted unless and until
the Borough adopts a resolution approving the recommendation of Chief
of Police to the Council's Public Safety Committee or Police Promotional
Committee, as may be applicable to the promotion being considered.
b. Eligibility.
1. Officer; Sergeant:
(a)
An officer of the Borough of Bloomingdale Police Department
shall be eligible to participate in the promotional process to the
rank of Sergeant, provided that he/she has completed five years of
service, including probationary service, with the Borough of Bloomingdale
Police Department.
2. Officer; Lieutenant and Captain:
(a)
Sergeants shall be eligible for promotion to the ranks of Lieutenant
and Captain, provided that they have served a minimum of one year
as a Sergeant.
3. Officer; Chief of Police:
(a)
Lieutenants and Captains shall be eligible for promotion to
Chief of Police.
(b)
Sergeants who are suitable candidate(s) for Chief of Police
may also be deemed eligible.
(c)
Candidates for the position of Chief of Police shall submit
professional résumés to the Mayor, Council, and members
of the Police Promotional Committee.
4. All prerequisites for eligibility for promotions, including years
of service and/or years in present rank, must be met as of the date
the notice of a promotional examination.
5. All promotions to the level of Chief of Police, Captain, Lieutenant,
and Sergeant shall be made from the membership of the Borough of Bloomingdale
Police Department, provided that the candidate meets the eligibility
requirements of this subsection and successfully completes the examination
process, if required, as contained here.
6. All qualified candidates shall state their intention to participate
in the promotional process by notifying the Chief of Police in writing
of their intention to participate within seven days of the date of
the notice of the promotional examination.
c. Phase I: New Jersey State Association of Chiefs of Police Examination.
1. New Jersey State Association of Chiefs of Police Written Examination.
(a)
The New Jersey State Association of Chiefs of Police written
examination shall only be administered and apply to candidates for
the rank of Sergeant. The NJSACOP written examination shall not apply
to candidate for the rank of Lieutenant, Captain or Chief.
(b)
All candidates for promotion to the rank of Sergeant shall submit
to a written examination. The NJSACOP shall administer the written
testing process.
(c)
The maximum attainable score on the written examination shall
be 100%. A score of 70% or greater shall be considered a passing score.
(d)
The written examination shall account for 60% of the candidates'
total score for the rank of Sergeant.
(e)
At least 60 days prior to the date a written examination is
scheduled, a notice shall be posted at the Police Department that
will set forth the following:
(1)
The position available through promotion;
(2)
The date the examination will be conducted;
(3)
The location of the examination;
(4)
The time the examination will begin;
(5)
A list of recommended study materials.
2. New Jersey State Association Chiefs of Police Association Oral Examination.
(a)
Those candidates for promotion to the rank of Lieutenant and
Captain are eligible to participate in the NJSACOP oral examination
phase, as set forth in this subsection. The NJSACOP oral examination
shall not apply to candidates for the rank of Sergeant or Chief.
(b)
All candidates for promotion to the rank of Lieutenant and Captain
shall submit to an oral examination. The NJSACOP shall administer
the oral examination process.
(c)
The Chief of Police shall notify eligible candidates that they
have been scheduled to attend an oral examination. The candidates
will also be notified of the date, time and place of the scheduled
interview at least 30 days ahead of the scheduled interview.
(d)
A list of study materials will be provided to all candidates
if necessary.
(e)
The maximum attainable score on the oral examination shall be
100%. A score of 70% or greater shall be considered a passing score.
(f)
The oral examination shall account for 70% of the candidates'
total score for the rank of Lieutenant and/or Captain.
d. Phase II: Oral Question-and-Answer Examination/Personal Interview.
1. The Chief of Police and the Borough Council's Public Safety Committee
(hereinafter collectively referred to as the 'Committee'), shall conduct
an oral question-and-answer examination and shall interview candidates
for promotion to the ranks of Sergeant, Lieutenant, and Captain. Exam
questions shall be produced by the Chief of Police.
2. Those candidates for promotion who have received passing scores (70%
or greater) on the NJSACOP's written (Sergeant) or oral (Lieutenant
and Captain) examination shall be eligible to participate in the oral
question-and-answer examination/personal interview and shall be notified
of their scheduled examination and interview date at least 10 days
prior to that date.
3. The question-and-answer examination shall consist of questions posed
to the candidates to which the candidates must provide oral answers.
The questions shall be based on but not limited to hypothetical situations,
and the same questions shall be given to each of the candidates. The
questions shall not exceed 10 total. The candidate's oral answers
to the questions posed shall be evaluated by the Committee with regard
to the candidate's practical application of acceptable police operating
procedures applicable to the situations presented. Each Committee
member shall score each oral answer, with 100% being the maximum attainable
score for the overall oral. The candidate's overall score for each
answer shall be the average of the combined scores of each Committee
member.
4. Factors to be considered during the question and answer examination/
personal interview shall include:
(a)
The candidate's performance/leadership skill;
(b)
The candidate's initiative;
(c)
The candidate's breadth of information;
(d)
The candidate's educational background;
(e)
The candidate's training;
(f)
The candidate's career development;
(g)
The candidate's supervisory knowledge;
(h)
The candidate's supervisory experience;
(i)
The candidate's attendance;
(j)
The candidate's attitude in supporting Departmental goals and
objectives;
(k)
The candidate's loyalty to the Department and the Borough of
Bloomingdale;
(l)
The candidate's loyalty to the Constitutions of the United States
and the State of New Jersey;
(m)
The candidate's civic service;
(n)
The candidate's efforts in supporting Department goals and objectives;
(o)
The candidate's handling of Department equipment;
(p)
The candidate's attitude and treatment of fellow employees and
the public;
(q)
The candidate's length of service;
(r)
The candidate's disciplinary history;
(s)
The candidate's commendation history; and
(t)
The candidate's professional demeanor.
5. Letters of approbation from outside the Department concerning a potential
candidate received between the date that notice of a promotional examination
is posted and the conclusion of the promotional examination shall
not be considered for the posted examination.
6. The Mayor, Council, and members of the Police Promotional Committee
shall conduct oral interviews for candidates for the position of Chief
of Police and serve as the sole authority for selecting a Chief of
Police.
e. Examination Final Overall Score.
1. The Chief of Police shall provide the three candidates receiving
the highest overall final scores for the ranks of Captain, Lieutenant
and Sergeant, and should, but is not required to recommend the top
scoring candidate for promotion, based upon exigent circumstances
to the Council's Public Safety Committee for the consideration by
the Mayor and Council. The Mayor and Council shall approve the candidate
to be promoted.
2. The candidate receiving the highest overall final score for the rank
of Chief of Police shall be recommended by Promotional Selection Committee
for approval by the Mayor and Council.
f. Provision of Test Results.
1. If applicable, a candidate may view his/her written test and compare
the answers with the answers from the answer key. Each candidate wishing
to do so shall have 10 days from the date of release of the promotional
list; after 10 days, he/she will not be allowed to view the written
examination and/or answer key.
2. Upon completion of the examination process, each candidate will be
provided with testing results in a written review form which includes
his/her:
(a)
Written examination (if applicable);
(b)
Oral examination (if applicable);
(c)
Question and Answer/Personal Interview results;
g. Examination Eligibility List. Candidates who successfully complete
the promotional examination process, but do not receive a promotion
at the conclusion of the process may be placed on a promotional list
for the same rank for which the candidates were examined.
1. The promotional list will be active for three years from the date
of final results being published. A candidate on the list may be recommended
for promotion to the appropriate rank without further examination
within the three-year time period.
2. The establishment of a list will be made upon recommendation of the
Chief of Police to the Mayor and Borough Council and the adoption
of a resolution establishing the list by the Borough Council.
h. Appeal of Promotional Process Results.
1. Candidates are entitled to appeal the results of the promotional
process within 10 days of the posting of the promotional list. In
order to appeal, the appellant must make his or her request in writing
and submit same to the Council's Public Safety Committee for consideration
by the Mayor and Borough Council.

The positions of Emergency Dispatchers are hereby established.
An Emergency Dispatcher may be appointed by the Borough Council for
a term not exceeding one year. Any such appointment may be revoked
at any time without notice and without hearing.

Pursuant to N.J.S.A. 40A:14-156.1, there is hereby established
a Mutual Police Aid Agreement between the Borough of Bloomingdale
and each of the following municipalities which adopts a reciprocal
ordinance: West Milford Township; Butler Borough, Riverdale Borough,
Kinnelon Borough; Wanaque Borough and the Borough of Pompton Lakes.

The Chief of Police of the Borough of Bloomingdale, or his designee,
is authorized to request assistance from the Chief of Police or other
head of the Police Department of any other municipality that adopts
a reciprocal ordinance, to provide aid during and after any emergency
in order to protect life and property or to assist in suppressing
a riot or disorder.

The Chief of Police of the Borough of Bloomingdale, or his designee,
shall provide assistance to any other municipality that accepts the
terms of this agreement and makes a valid request to supply such personnel
and equipment, to the extent possible without endangering persons
or property within the Borough of Bloomingdale. The members of the
Bloomingdale Police Department supplying such aid shall have the same
powers, authority, rights and immunities as the members of the police
force of the municipality to which assistance is rendered.

The Borough of Bloomingdale shall, upon providing assistance
to another municipality which has enacted a reciprocal mutual aid
ordinance, assume the cost and expense of providing its personnel
and equipment to the requesting municipality, except in such instances
where the requesting municipality receives State or Federal aid by
way of reimbursement. Under those circumstances, the costs incurred
by the Borough of Bloomingdale shall be submitted to the municipality
requesting assistance for reimbursement out of the funds received
by way of State or Federal aid.

Members of the Bloomingdale Police Department suffering injury,
or their legal representatives if death results while rendering assistance
in another municipality, shall be entitled to all such benefits they
would have realized if injury or death had occurred in the performance
of normal duties within the Borough of Bloomingdale.

The Chief of Police of the Borough of Bloomingdale, or his designee,
and the chiefs of the other participating municipalities or their
designees shall jointly prepare written standard operating procedures
(SOP) which shall address the implementation of this mutual police
aid agreement. A copy of the SOP, and all amendments and revisions
thereto, shall be filed with each participating Police Department
and the respective clerks of each participating municipality and with
the police dispatcher for each such municipality.

This Mutual Police Aid Agreement shall have an initial term
of one year and shall be automatically renewed for additional and
successive one-year terms, unless and until one of the parties hereto
elects to terminate the agreement by providing prior written notice
to the other party to the agreement.
A copy of this Part 2 shall be transmitted to the Municipal
Clerk of each municipality named herein no later than five business
days following final adoption.

Police Service Agreements

a. 9-1-1 Services. Pursuant to N.J.S.A. 40:8A-1 et seq., there is hereby
established a 9-1-1 services agreement with the Borough of Pompton
Lakes. Pursuant to this agreement and subject to the consideration
provided therein, the Police Department of the Borough of Pompton
Lakes shall operate and man a base station on a seven day per week,
24 hour per day basis for the purpose of providing 9-1-1 services
on behalf of the all the parties thereto and on an equal basis.
b. Police Dispatch Services. Pursuant to N.J.S.A. 40:8A-1 et seq., there
is hereby established a Police dispatch agreement with the Borough
of Pompton Lakes. Pursuant to this agreement and subject to the consideration
provided therein, the Police Department of the Borough of Pompton
Lakes shall operate and man a base station on a seven day-per-week
basis from 12:00 midnight until 8:00 a.m. for the purpose of providing
police dispatch services on the behalf of all parties thereto and
on an equal basis.

A Fire Department is hereby created and established for the
Borough coextensive to the territorial limit of the Borough.

The Fire Department shall consist of a Chief, First Assistant and Second Assistant Chiefs and such firefighters, engineers, lieutenants and captains as established in the Department Bylaws (Subsection
2-39.5) as shall be appointed as hereinafter set forth.

The members and officers of Chemical Company No. 1 of Bloomingdale
and Hook-and-Ladder Company No. 1 of Bloomingdale may become members
and officers of the Fire Department upon signing the membership roll
and promising to perform the duties of a Firefighter as prescribed
by law, the ordinances of the Borough and the bylaws of the Department,
which roll shall be kept by the Municipal Clerk. Hereafter, no person
shall become a member of the Department until elected by the Fire
Department and confirmed by the Borough Council.

Membership in the Department, consisting of two companies, shall
not exceed 35 men per company, a total not to exceed 70 members for
the entire Department.

The Department shall have the right to prepare its own bylaws
subject to the approval of the Borough Council.

a. No person shall be admitted to membership in the Department unless
he/she shall have been a resident of the Borough for at least one
year next preceding his or her acceptance to membership in the Department
and is not less than 18 years of age nor more than 45 years of age.
b. The maximum age for membership shall be increased at all times to
conform with State law.

The Borough Council shall have the right to expel or suspend
any member or officer of the Department upon charges preferred and
a trial by the Borough Council.

The officers of the Department shall be elected annually by
ballot at an election of the Department to be held on the third Monday
of December in each year at the firehouse in the Borough of Bloomingdale
at 8:00 p.m. and they shall hold office for one year from the first
day of January following their election; provided, however, that the
election of the Chief and Assistant Chiefs shall be confirmed by the
Borough Council before they shall assume the duties of their office,
and in case the Council shall refuse to confirm such election, the
Council shall have the right to appoint a temporary Chief and Assistant
Chiefs until such officers are elected by the Department and confirmed
by the Council as herein provided.

The Chief shall in case of fire have sole and absolute command
of the Department. The Chief shall arrange and place the members of
the Department and the fire apparatus and cause them to be used in
such manner as, in his judgment, shall most quickly and effectively
extinguish the fire. In the absence of the Chief, the First Assistant
Chief shall perform the duties of the Chief, and in the absence of
the Chief and Assistant Chiefs, the members of the Department shall
be in charge in order of their seniority as members of such Department.
a. It shall be the duty of the Chief of the Fire Department to report
to the Borough Council at the first regular meeting in each month
the condition of the Fire Department and of the apparatus, and of
any other matters of the Department that he shall deem necessary.

The Borough Council reserves the right to amend this section
and the bylaws of the Fire Department.

Each member of the Fire Department, upon signing the roll of
the Department, shall be entitled to receive a badge of the Fire Department
and certificate of membership signed by the Mayor, the Municipal Clerk
and the President of the Department. The badge shall remain the property
of the Borough and be surrendered to the Council on the death, resignation,
removal or suspension of such member.

The services rendered by the members of Fire Department shall
be voluntary and without compensation.

The Mayor and members of the Public Safety and Utility Committees
shall, at all times, be admitted to the fire house for the purpose
of examining the conditions of the fire apparatus and any property
of the Borough.

a. All members of the Fire Department shall, at the direction of the
Chief, the Assistant Chief or other members entrusted with the direction
of the Department:
1. Respond to alarms of fires within the Borough.
2. Wash down motor vehicle accidents.
3. Perform search and rescue details.
4. Respond to mutual aid calls from neighboring communities.
5. Attend community and Department drills.
6. Attend training sessions required by the State of New Jersey.
7. Clean and maintain Fire Department equipment.
8. Remove snow from fire hydrants in winter.
9. Perform ceremonial duties at funerals, parades and wet downs.
10. All of the services deemed necessary by the Fire Chief or the Mayor
and Council for the safe operation of the Department and safety of
the residents of Bloomingdale.
b. Any member of the Fire Department who is responding to one of the assignments in Subsection
a above shall be deemed to be on duty while performing these duties.

A Length of Service Awards Program (LOSAP) is herewith created
in accordance with Chapter 388 of the Laws of 1997, to reward members
of the Bloomingdale Volunteer Fire Department for their loyal, diligent,
and devoted services to the people of the Borough of Bloomingdale
and surrounding communities.

The LOSAP shall provide for fixed annual contributions to a
deferred income account for each volunteer member who meets the criteria
set forth below; that such contributions shall be made in accordance
with a plan that shall be established by the governing body of the
Borough pursuant to P.L. 1997, c.388; and that such plan shall be
administered in accordance with the laws of the State of New Jersey,
the U.S. Internal Revenue Code, and this section.

The LOSAP shall provide for annual contributions to each eligible
member who meets the following criteria:
a. Credits Based Upon Years of Service. An active volunteer member shall
receive one credit for each year of active emergency service in the
Bloomingdale Volunteer Fire Department, inclusive of prior year service.
b. Credits Based Upon Fire Department Point System. An active volunteer
member shall receive one credit for each qualifying year earned by
such member. A qualifying year shall be defined as a calendar year
during which such member has been awarded at least 100 points pursuant

member shall be $100 per year.

The estimated cost of the LOSAP has been computed as follows:
a. For the calendar year 2002, the estimated annual contribution is
$21,713.
b. For the calendar year 2003, the estimated annual contribution is

The LOSAP Program, as prescribed herein, shall not take effect
unless approved by the voters as a public question at the next general
election, and if approved, shall become effective on January 1, 2002.

There is hereby established as an auxiliary to the Bloomingdale
Volunteer Fire Department a "Junior Firefighters' Auxiliary," which
shall operate under and pursuant to N.J.S.A. 40A:14-95.

Any individual interested in becoming a member of the Junior
Firefighters' Auxiliary must meet the following qualifications:
a. Be between 14 and 17 years of age.
b. Obtain permission from such individual's parents or legal guardian.
Such permission shall be in writing and notarized by a notary public
of the State of New Jersey. A copy of the written permission shall
be submitted to the Borough Clerk.
c. Be interviewed, with his or her parent or legal guardian present,
by the New Member Investigating Committee.
d. Pass a physical examination to establish his or her physical capability
to perform the duties of a Junior Firefighter.

All Junior Firefighters shall comply with the following rules
and regulations:
a. They shall observe all rules and by-laws of the Fire Department and
demonstrate an active interest in the Fire Department and its functions.
They shall be required to observe the direction of the officers and
members of the Fire Department.
b. They shall not deliberately and/or willfully misuse, damage or destroy
Fire Department equipment or property.
c. They shall maintain a school grade point average of at least a "C."
If the grade point average falls below a "C," the individual will
be suspended or restricted from firefighting and/or the firehouse
until such time as the Junior Firefighter can show sufficient evidence
that his or her grades have improved.
d. They shall not be present in a firehouse or the Firemen's Hall unless
a regular member is present.
e. A curfew of 11:00 p.m. shall be observed at all times, with the exception
of approved Fire Department functions. Junior Firefighters shall not
leave school to attend any fires or Fire Department functions unless
requested by the Fire Chief of his designee.
f. They shall not be permitted to use blue lights.
g. They shall be assigned a mentor, who is a regular member.

At all times, the rules and regulations set by the New Jersey
Department of Labor as they pertain to minors shall be applicable.
In addition, the activities of the Junior Firefighters are limited
by N.J.S.A. 40A:14-98.
Junior Firefighters shall not be allowed to perform duties that
would expose them to the same degree of life hazard to which a regular
member of the Fire Department is subject. Junior Firefighters shall
be subject to safety regulations that shall include, but not be limited
to the following:
a. They shall not enter any burning or unstable structure, or actively
participate in any technical rescue.
b. They shall always be seated and belted in a secure position when
riding on any fire apparatus.
c. They shall be issued the same personal protective ensembles as are
issued to regular members of the Fire Department. The equipment shall
be worn at all fire calls and drills as necessary.
d. They shall not be permitted to operate any motorized power equipment,
such as the Jaws of Life, chain saws and vent saws.
e. They shall not be permitted to ride the apparatus for mutual aid
call, other than Car 666 and 667.

Junior Firefighters are required to be trained in basic fire
operations including, but not limited to, fire stream operations,
ladder operations, rescue operations, fire suppression and use of
firefighting equipment.

Persons desiring appointment as Special Fire Police shall make
application to the Fire Chief upon forms prescribed by the Fire Chief
and containing such information as the Fire Chief shall require.

The Fire Chief shall appoint Special Fire Police Officer to
serve in this capacity after a background investigation has been completed
by the Chief of Police or his designee and with Mayor and Council
approval.

Special Fire Police Officer shall be empowered to direct traffic,
to participate in crowd control measures and to act pursuant to specific
direction and authorization of the Police Department or Fire Department
at the scene of fires, accidents, or when called to duty by either
the Police Department or Fire Department. Such Special Fire Police
Officer shall have none of the other powers of a regular Police or
Fire Officer and shall serve only during his or her term of office.
Such Special Fire Police Officer shall not wear a uniform or cap in
a color or style similar to that worn by the regular Police Officers
of the Borough. Such Special Fire Police Officer shall not have the
power of arrest or issue legal process, and shall not wear, carry
or otherwise display any firearm. Such Special Fire Police Officer
shall be authorized to equip his/her motor vehicle with a blue light
in accordance with N.J.A.C. 13:24-5. This authorization shall be contingent
on the member making application to the Fire Chief, and shall be governed
by the same application process and regulations already established
for members of the Bloomingdale Fire Department.

The members of the Special Fire Police shall serve under the
control and supervision of the Chief of Police and the Fire Chief.
The Chief of Police and the Fire Chief are authorized to prescribe
the organization, training, and such other regulations and conditions
of the membership as the Chiefs shall deem necessary or appropriate.
The Chiefs may suspend a Special Fire Police Officer for cause and
may institute such disciplinary actions as the Chiefs deem necessary
or appropriate for violation of this section or any regulations.

Fire Police are a Fire Department resource and answer to the
Office in Charge (OIC) of the Fire Department in attendance. Where
no other Fire Department resources are present, they will usually
be assisting Police and therefore be taking direction from the Police
OIC. They may also act autonomously depending upon special circumstances.
a. Traffic Control at Emergency Scene. Managing the flow of vehicles
around or through the immediate vicinity of an emergency. This may
entail road enclosures, diversions, full points control of intersections
or one-way streets where the road is reduced to one lane and the direction
is alternated in a controlled fashion.
b. Scene Safety. Fire Police Officers are utilized to assist in ensuring
that the scene of an incident is safe for those working in the vicinity;
this includes both Firefighters and other Emergency Service workers,
not to mention members of the public.
c. Crowd Control and Liaison. Residents, owners, occupants, relatives,
transients, spectators, and the media are among those who may approach
the scene of an incident. Fire Police are in a position to prevent
them from coming into harm, and from hampering the operations of emergency
services personnel at the scene. These Fire Police Officers are often
the first point of contact and as such must have good skills in public
relations.
d. Scene Security. Fire Police may be asked to provide security at a
scene to stand guard in order to prevent looting or theft. Also, they
may be called upon to safeguard and monitor unattended Fire Department
equipment.
e. Police Assistance. Fire Police are often called upon by police to
assist law enforcement agencies to supplement storages of manpower.
Many of the above functions can fall within the area of responsibility
of the Police when called upon to assist at a scene. The use of Fire
Police Officers when on the scene, may allow the Police Officers to
concentrate on critical issues or more specific areas of their expertise.
f. Logistics. Fire Police may provide a logistics resource vehicle movements,
communications or similar activities. This would particularly be the
case at a scene controlled by the Fire Department, but they may be
called upon by other agencies.

a. Class III special law enforcement officers shall be responsible for
providing armed security at all public schools and facilities within
the Borough and/or at official school functions attended by students
outside of school facilities, as may be directed by the Chief of Police,
or his or her designee, subject to the provisions of N.J.S.A. 40A:14-146.11.
b. When on duty, all Class III special law enforcement officers shall
exercise the full powers and duties, including the carrying and use
of a firearm and other mechanical force devices as prescribed by the
Chief of Police, as sworn police officers of the Borough of Bloomingdale
Police Department. Class III special law enforcement officers are
authorized to respond to offenses and emergencies off school property
if they occur in their presence.
c. In times of disaster and/or emergency, the Chief of Police, or his
or her designee, may activate, recall and/or otherwise assign any
Class III special law enforcement officer to any duty in support of
the operations of the Bloomingdale Police Department's response to
said disaster and/or emergency.
d. Class III special law enforcement officers shall be issued a firearm,
mechanical force devices and any such other equipment or supplies
necessary to perform their duties as determined by the Chief of Police,
who shall also prescribe uniforms that the special officers are responsible
for acquiring. Class III special law enforcement officers shall be
responsible for the care and maintenance of their uniforms and equipment
and shall wear the uniform of the day and carry a firearm and other
mechanical force devices and equipment as prescribed by the Chief
of Police at all times when on duty.

a. All Class III special law enforcement officers shall meet the qualifications
set forth in N.J.S.A. 40A:14-146.10. In addition to the qualifications
required by N.J.S.A. 40A:14-146.10, all Class III special law enforcement
officers shall:
1. Be a citizen of the United States.
2. Be currently living in New Jersey and possess a valid New Jersey
driver's license.
3. Be a retired police officer who has previously served as a duly qualified,
full-time law enforcement officer in any municipality, county, agency
of this state, bi-state agency, or federal agency. [Break in service
must not exceed three years.]
4. Be retired from that agency in good standing.
5. Be less than 65 years of age for the appointment.
6. Pass a psychological exam, a medical exam, and a drug screening pursuant
to the Attorney General's Law Enforcement Drug Testing Policy.
7. Successfully pass a background investigation to be conducted by the
Bloomingdale Police Department.
8. Successfully complete School Resource Officer training within 12
months of appointment.

a. All qualified persons desiring to be appointed as Class III special
law enforcement officers shall apply as prescribed by the Chief of
Police and/or his or her designee.
b. All applicants will be subject to a background check, a motor vehicle
driving record check and medical, physical, psychological, and/or
drug screening examinations.
c. All applicants will be evaluated based upon their resume, qualifications,
education, service record and interviews with, and recommendations
of, the Chief of Police and the Borough Administrator, as well as
any other Borough officials involved in the evaluation and hiring
process.
d. The Chief of Police and the Borough Administrator shall recommend
the most qualified applicant(s) to the Mayor and Council for appointment.
e. After appointment by the Mayor and Council, all appointees shall
swear or affirm an oath of office as a Class III special law enforcement
officer of the Borough of Bloomingdale, shall be issued a badge and
identification and shall report as ordered to the Chief of Police
for training and deployment.
f. This shall be a part-time appointment for a term of one year from
the date of appointment.
g. Appointees who fail to successfully complete any training, continuing
education, or weapons qualification, as mandated by state statute,
the rules and regulations of the Bloomingdale Police Department or
the Chief of Police, shall be immediately terminated.

a. The terms of employment for all Class III special law enforcement
officers shall be governed by the provisions of this chapter, the
Borough of Bloomingdale Employee Personnel Policy Handbook and any
other such ordinances or resolutions as may be adopted by the Mayor
and Council.
b. Notwithstanding any other provisions to the contrary, Class III special
law enforcement officers shall not be eligible, as a result of their
employment as a special law enforcement officer, for the following
benefits:
1. Health, dental or prescription benefits.
2. Enrollment in any state pension system.
4. Unemployment compensation.
5. Any severance, terminal leave, retirement or separation benefits.
c. The salary and wages of all Class III special law enforcement officers
shall be established pursuant to the Salary Ordinance adopted by the
Mayor and Council. Wages will be paid only for hours worked, including
hours attending mandated training, continuing education and weapon
qualification, unless otherwise specified in this chapter.
d. During each term of appointment, Class III special law enforcement
officers shall be permitted to take paid time off under the Paid Sick
Leave Act.
e. Class III special law enforcement officers shall be available for
work on all official school days in the academic calendar when faculty
is working in the school buildings. The work schedule and post for
all Class III special law enforcement officers shall be established
by the Chief of Police or his or her designee.
f. Any and all policies and rules governing the hiring, employment,
performance, conduct, deployment, scheduling, and/or duties of Class
III special law enforcement officers, not otherwise provided for in
this chapter, shall be governed by the Borough of Bloomingdale Employee
Personnel Policy Handbook, the Salary Ordinance, the rules and regulations
of the Bloomingdale Police Department and the policies and decisions
of the Chief of Police and the Borough Administrator.
