1. 
The Board of Commissioners is hereby authorized to establish a Municipal Pound, under the jurisdiction of the Chief of Police or the Animal Control Officer who shall provide proper sustenance for all animals impounded and shall treat them in a humane manner.

The Municipal Pound may be established on a shared or contractual basis with other units of government or with a private individual or firm, and need not be physically located within the City of Weatherford.

It shall be the duty of the Animal Control (or any other designated officer or employee of the city) to take into custody and impound any animal running at large in violation of the provisions of this Chapter.
2. 
The Animal Control Officer may also proceed to impound any animal that is barking, howling, or otherwise disturbs the peace and quiet of any person or damages any public or private property.
3. 
The Animal Control Officer may immediately capture and impound any animal or animals which are kept, owned, possessed or harbored in violation of any of the terms and provisions of this Code.
4. 
Any person appearing at the Municipal Pound who shall satisfy the keeper of the same of the fact of ownership or the rights to the possession of any animal therein impounded, shall have such animal returned to him, upon payment of the charges due, as authorized by the provision of this Chapter.
5. 
Animals which are taken into custody as provided in this section, shall be destroyed in a humane manner by the officer or employee of the city in charge of such animal or by the Animal Control Officer after five days of impoundment.
6. 
Animals which are taken into custody as provided in this section that are sick or injured may be destroyed immediately by the officer or employee of the city in charge of such animal or by the Animal Control Officer.
7. 
Should any licensed institution request of the Animal Control Officer that animals be delivered to it for scientific or educational research, such animals may be released to said institutions, provided that no animal taken into custody shall be delivered to such institution until such animal has been impounded for at least five days and remains unclaimed and unredeemed by its owners of any person desiring such as a pet.

No unauthorized person shall break, or attempt to break open the pound, or take or let out any animal therefrom, or take or attempt to take from any officer or employee of the city any animal taken into custody as provided by ordinance, or in any manner interfere with or hinder such officer or employee in the discharge of his duties relating to the taking into custody and impounding of animals as provided in this Chapter.

The fees for impounding and keeping an impounded animal, to be paid upon redemption, shall be determined by the Board of Commissioners by motion or resolution.

Any person redeeming an impounded animal shall pay the required fees to the Police Department and present his receipt therefor to the person in charge of the pound before the latter releases the animal.

Any person, firm, or corporation who knowingly harbors a vicious animal, as defined by Section 3-1, paragraph 12, of this Chapter, within the limits of the City of Weatherford, which allows in any manner, except as provided, said vicious animal to commit or attempt to commit an unprovoked attack on any person shall be guilty of an offense and subject to the penalty provided for in said offense.

Nothing in paragraph 1 above shall be deemed an offense if the vicious animal attacks, provoked or unprovoked, any person who is committing any criminal act inside the area of confinement of said vicious animal.
3. 
Any person, firm, or corporation who violates any of the provisions of paragraph 1 of this section shall be fined in a sum as provided in Section 9-31 this Code and/or said vicious animal may be ordered, by the Municipal Judge, destroyed or removed from the limits of the City of Weatherford. Each day upon which a violation of paragraph 1 continues shall be deemed a separate offense.
