A code regulating the location, construction, alteration, use
and supervision of individual and semipublic water supplies, requiring
the fixing of fees and prescribing penalties for violations is adopted
pursuant to P.L. 1950, c. 188 (N.J.S.A. 26:3-69.1 through 26:3-69.6),
as amended wherever applicable by law. In their interpretation and
application, the provisions of this chapter shall be held to be the
minimum requirements adopted for the promotion of the public health,
safety and welfare. To protect the public, among other purposes, such
provisions are intended to provide for an adequate water supply which
is free from deleterious substances and fit for human consumption.
The code established and adopted by this chapter is described
and commonly known as the "Individual and Semipublic Water Supply
Code of New Jersey (1966)" and has been placed on file in the office
of the Secretary of the Board of Health and shall remain on file there
for use and examination by the public.

Permit required. No person shall
locate, construct or alter any water supply until a permit for the
location, construction or alteration of the water supply shall have
been issued by the administrative authority.
B.Â
Application for permit. Application
for a permit to locate, construct or alter any potable water supply
system shall be made to the administrative authority by the well driller,
on forms furnished by the administrative authority.

Approval of location by administrative
authority. No permit to locate and construct a new potable water supply
shall be issued until the design and location of the sewage disposal
system on the property have been approved by the administrative authority.
No permit to alter an existing water supply shall be issued until
the location of the existing sewage disposal system on the property
has been approved by the administrative authority. No permit shall
be issued to construct a new water supply or to alter an existing
potable water supply where there is danger of pollution of the water
supply from any sewage disposal system.

Denial of permit. In case any
permit or certification required by this chapter is denied by the
administrative authority, a hearing shall be held thereon before the
Board of Health within 15 days after request therefor is made by the
applicant. Upon the hearing, the Board of Health may affirm, modify
or reverse its previous determination and must announce its decision
within 15 days after the date of the hearing.

Adequate water supply required.
The well driller shall, upon request, furnish the Board of Health
with proof satisfactory to the Board that the proposed water supply
will have sufficient depth and pump sufficient gallons of water per
minute to be adequate to supply the home or homes in the areas to
be served by the water supply.

Requirements. All casings shall
be of new and undamaged pipe of standard wrought iron or steel. They
shall extend to a minimum of 50 feet below grade, or additional casing
necessary to go 10 feet into solid rock, and be sealed with a one
sand, one cement wet mixture. No casing shall be sealed without the
administrative authority present.

Well shafts. All well shafts must
be four inches larger than casing to provide proper sealing for a
one sand, one cement mixture of approved consistency, extending from
the bottom of the casing to surface slab, and shall be placed in one
continuous operation.
D.Â
Couplings. Sections of casings
shall be joined with couplings with ample full-threaded joints, drive
pipe couplings, or by welding, so that all joints shall be closed
and made watertight.
The location of the well for any new water supply shall be shown
on the plan of any sewage disposal system, and no change in the location
of either shall be made without approval of the administrative authority.

When the
well is ready for inspection, the well driller shall notify the administrative
authority at least one day in advance, exclusive of mailing time and
Saturdays, Sundays, and holidays, that the work is ready for inspection.

The well
driller or his or her representative shall be present when the inspection
is made. Any test the Board of Health or the administrative authority
may require shall be performed by the well driller at his or her expense.
C.Â
Upon the
completion of the installation of a water supply system or following
repairs to its pumping equipment, it shall be flushed and disinfected
with chlorine solution, and the chlorine solution shall remain in
the well for a minimum of 24 hours; then the well shall be thoroughly
reflushed to remove all traces of chlorine.
When the work is completed, the owner shall submit a well record
on forms furnished by the Board of Health. The record must be certified
by the well driller, stating that the water supply system has been
located and constructed in accordance with the requirements of the
Water Supply Code of New Jersey (1959) and this chapter. Application
for a certificate of occupancy shall not be approved until the well
record, fully completed, is submitted.
The Board of Health may adopt such rules and regulations as
it deems necessary in connection with this chapter and the code.
A.Â
Mandatory installation of valves.
The owner of every house, building or structure, now or hereafter
constructed, assembled or moved to any lot or lots in the Township
intended for residential or commercial use or professional occupancy,
when connecting such house, building or structure to the public water
supply stream, shall install a check valve which is to be placed next
to the water meter on the interior side of the waterline closest to
such house, structure or building.

Failure to comply. Failure to
install a check valve as required is declared to be a health hazard
and annoyance.
C.Â
Inspection. The Plumbing Inspector
or any authorized agent shall have free access to all parts of any
premises to which public water services are supplied or connected
for the purpose of inspection, examination, or doing anything in connection
with such inspection or examination of check valves for the purpose
of protecting the interests of the inhabitants of the Township by
enforcing the provisions of this section.
D.Â
Penalty. Any person who shall
violate this section by failing to install a check valve as required
shall be subject to a fine of $25. Each day of noncompliance, after
notification by the Plumbing Inspector, shall be considered a separate
offense.
