For the purpose of this article, the following terms shall have the following meanings:
LICENSED GROSS WEIGHT
The sum of the empty weights of a truck or truck-tractor and the empty weights of any trailer, semitrailer or combination thereof with which it is to be operated in combination at any one time, plus the weight of the maximum load to be carried thereon at any one time.
SEMITRAILER
Any trailer so constructed that some part of its weight and that of its load rests upon or is carried by the towing vehicle.
TRAILER
Any device without motive power designed for carrying persons or property and being towed by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
TRUCK
Any motor vehicle designed, used, or maintained primarily for the transportation of property or designated as a truck by the manufacturer.
The Public Works Director or his/her designee shall designate the streets, highways, alleys, avenues or boulevards to be used as truck routes within the corporate limits of the City. Such designation shall consist of a list of the streets, highways, alleys, avenues or boulevards to be used as truck routes, and a map showing the designated truck routes. The list and map shall include extensions of the truck routes beyond the City's corporate limits, and those extended shall be automatically included as designated truck routes upon annexation into the City. When the list and the map of the designated truck routes have been approved by resolution of the City Council, they shall be the official designated truck routes of the City. Copies of the current, updated official truck route list and map shall be kept on file by the Public Works Department and the City Clerk, and shall be available on the City official website.
The Public Works Director or his/her designee may install, or cause to be installed, appropriate signs indicating streets which are designated truck routes. Notwithstanding the presence or absence of signage, the operator of a truck shall be obligated to comply with this article and with all required truck routes throughout the corporate limits of the City.
A. 
All trucks having a licensed gross weight in excess of 10 tons shall only be operated upon designated truck routes, and only in accordance with all existing rules, regulations and laws.
B. 
All trucks which have a licensed gross weight of 10 tons or less may be operated upon all paved City streets in accordance with all existing rules, regulations and laws, unless otherwise directed by signage posted on any such street.
C. 
It shall be unlawful for any person to operate a truck with a licensed gross weight in excess of 10 tons upon any of the streets, highways, alleys, avenues or boulevards of the City, unless such truck is operated upon a designated truck route or unless such truck qualifies under one or more of the exceptions stated in this article.
Nothing contained in the provisions of this article shall be construed to prohibit the operation of a truck on a street, highway, alley, avenue or boulevard within the City other than a designated truck route, if the operation of the truck qualifies under one or more of the following exceptions:
A. 
Solid waste collection.
B. 
Travel to or from the delivery or pickup of goods or services, using the most direct route to and from the nearest truck route.
C. 
Service or repair of such truck, using the most direct route to and from the nearest truck route.
D. 
Travel to or from storage or parking of such truck completely enclosed within a structure or on an open storage lot, if the property is properly zoned for such purpose, using the most direct route to and from the nearest truck route.
E. 
Maintenance or construction of streets or utilities.
F. 
Passenger buses.
G. 
The City Council may by resolution grant a waiver to allow an individual, company or other entity to operate specified trucks with licensed gross weight exceeding 10 tons upon an alternative truck route. An individual, company, or other entity may request such a waiver by filing a written application with the City Clerk. The application shall state the proposed alternative truck route, the specific trucks with licensed gross weight exceeding 10 tons which will be using the alternative truck route, and the factual grounds for such a waiver under this subsection. The City Council may grant such a waiver only to an applicant who proves 1) that the alternative truck route is necessary to serve an existing legal nonconforming use on the applicant's property, and 2) that compliance with the general truck route rules of this article would impose an unusual and practical difficulty upon the applicant. The waiver resolution shall identify the alternative truck route, the specific trucks with licensed gross weight exceeding 10 tons which will be using the alternative truck route, and any further relevant conditions that the City Council deems appropriate. The waiver shall be a revocable privilege, and not a right. The City Council may by resolution suspend or revoke the waiver for violation of the said conditions or of applicable laws, or for other grounds affecting public health and safety. The waiver shall terminate upon the waiver holder's transfer of the property or transfer of the business, or upon the termination of the legal nonconforming use status of the waiver holder's property.
It shall be unlawful for any person to operate a truck on any street, highway, alley, avenue or boulevard on which signs have been erected indicating that trucks are prohibited, except when allowed by one or more of the exceptions stated in this article.
