A certain document, one (1) copy of which is on file in the office of the City Clerk of Merriam Woods, Missouri, being marked and designated as the International Plumbing Code, 2003 edition, including Appendix Chapter A, as published by the International Code Council, be and is hereby adopted as the Plumbing Code of the City of Merriam Woods, Missouri, regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair location, relocation, replacement, addition to, use or maintenance of plumbing systems as herein provided and each and all of the regulations, provisions, penalties, conditions and terms of said Plumbing Code on file in the office of the City are hereby referred to adopted, and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions, and changes, if any, prescribed in Section 500.050 of this Article.

A. 
The following Sections are hereby revised:
1. 
Section 101.1, insert "the City of Merriam Woods."
2. 
Section 108.4, insert "guilty of an ordinance violation," "not more than five hundred dollars ($500.00)," "not exceeding thirty (30) days."
3. 
Section 108.5, insert "not less than twenty five dollars ($25.00)" and "more than five hundred dollars ($500.00)."
4. 
Section 305.6.1, insert "minimum of thirty (30) inches" and "minimum of thirty (30) inches."
5. 
Section 904.1, insert "at least six (6) inches."
A. 
For any violation of the code adopted hereby, the violator, upon conviction, shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the City or County Jail not exceeding ninety (90) days, or by both such fine and imprisonment. Every day any violation shall continue shall constitute a separate offense.
B. 
Whenever any act is prohibited by the code adopted hereby, by an amendment thereof, or by any rule or regulation adopted there under, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act. Whenever any act is prohibited by the code adopted hereby, an attempt to do the act is likewise prohibited.

If any Section, Subsection, sentence, clause, or phrase of this Article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Article. The Board of Aldermen hereby declares that it would have passed this Article, and each Section, Subsection, clause, or phrase thereof, irrespective of the fact that any one (1) or more Sections, Subsections, clauses, or phrases be declared unconstitutional.
