In the interests of the public health, the prevention of disease, the elimination of pollution and the exclusion of contamination of the water and in order to protect and safeguard the sanitation of bathing, as well as the general health of the citizens, residents and visitors of the Borough of Wildwood Crest, certain rules and regulations are hereby found to be required concerning the use of all waters within the territorial limits of the Borough of Wildwood Crest.
A. 
No person shall dump or discard garbage, food, waste, offal or other waste refuse or sewerage materials into any of said waters.
B. 
No person shall live upon, cook upon or discharge toilet wastes from any boat docked, moored or operated in said waters.[1]

A. 
No person shall operate any boat propelled by an engine burning gasoline, naphtha, fuel oil, kerosene or other fuel used in internal-combustion engines upon waters within or bounding the municipality of Wildwood Crest without having the exhaust of said engine or motor muffled. An exhaust system which shall exhume its exhaust fumes entirely underwater at all times while the boat is in motion shall be considered as muffled. The motor of any boat with an inboard motor or engine shall be considered muffled if the water from the cooling system is expelled through the exhaust of the engine.
B. 
The provisions of this section shall not apply to any watercraft while in use during any official speedboat regatta authorized to be held by resolution of the Board of Commissioners of the Borough of Wildwood Crest, which regatta is sponsored by a duly recognized yacht club and which regatta is sanctioned by the American Power Boat Association.[1]

A. 
All jet skis owned by jet ski rental businesses shall be marked by the owner thereof with a large, easily visible number or color, as directed by the Borough of Wildwood Crest, which marking shall identify the owner of the jet ski rental business which owns such jet skis.
B. 
No jet skis shall be rented to a person who is less than 18 years of age unless such would-be jet ski renter is accompanied by a parent or legal guardian. The owner of such jet ski rental business shall obtain identification from the would-be renter in the form of a driver's license or other alternate form of identification containing the name, address and telephone number of the would-be jet ski renter. The license or alternate form of identification shall be held as a deposit by the owner of the jet ski rental until the return of the jet ski to the owner. Each owner of such jet ski rental business shall maintain a daily log of all rentals made by the jet ski rental business.
C. 
Jet skis shall not be rented between the hours of 7:00 p.m. and 8:00 a.m.
D. 
Jet ski riders must maintain a prone or kneeling position when operating the jet skis within the waters of the Borough of Wildwood Crest. The owner of each jet ski rental business shall instruct their jet ski renters of this requirement. Failure to so instruct each jet ski renter of said requirements shall subject the owner of a jet ski rental business failing to instruct such jet ski renter to a violation of this section.
E. 
Each jet ski business owner shall have a patrol boat on the water which shall supervise the operation and conduct of the renters during all hours of operation.
F. 
The owner of each jet ski rental business shall obtain the signed consent of the parent or legal guardian of any minor operator which assumes responsibility for the conduct of the minor operator in the use of the jet ski.
G. 
The Board of Commissioners may adopt such further rules and regulations pertaining to the operation of jet ski businesses by resolution as may be deemed necessary.
H. 
All rentals shall meet the New Jersey State laws for Boating Safety Certificates and Boating Licenses.
A. 
No person shall launch or beach any boat over or across any bulkhead at any street end within the Borough of Wildwood Crest or over or across any other public land, except at such place or places as may have been designated for that purpose.
B. 
No person shall dock or moor any boat so that any part thereof may protrude into or extend over or into those areas of the tidal waters lying between the bulkhead on the easterly side and the two curblines of any street, as extended westwardly to the pierline heretofore established on the westerly side; nor shall any person dock or moor any boat therein so that the same or any part thereof protrudes into or extends over or into the waters abutting the lands of an owner of adjacent property against their will or over the objection of such adjacent property owner.
C. 
No person shall moor any boat or fasten the same to any bulkhead or float provided for that purpose at any street end within the Borough of Wildwood Crest.

A. 
Unless otherwise provided by law, any person violating the terms of this ordinance or refusing or neglecting to comply with any of the provisions hereof shall, upon conviction therefor, be subject to a fine of not more than $2,000 or imprisonment in the County Jail for a period of not more than 90 days, or both, in the discretion of the court before whom such conviction is had.
B. 
Each day's persistence in the things or acts prohibited by this ordinance shall be and constitute a separate and distinct offense subject to any and all penalties prescribed in this ordinance.
