All definitions of words and terms used herein, except as specifically otherwise noted, shall be defined in accordance with the provisions of N.J.S.A. 52:27D-192 et seq. and N.J.A.C. 5:70 et seq.
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383), N.J.S.A. 52:27D-202, the New Jersey Uniform Fire Code shall be locally enforced in the Borough of Montvale.
The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Borough of Montvale, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 203-3 of this article shall carry out the periodic inspection of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 203-3 of this article shall be under the direct supervision and control of the governing body of the Borough of Montvale, which body may from time to time delegate to the Borough Administrator such supervisory functions as it deems appropriate.
A. 
Appointment. The Fire Official shall be appointed by the Mayor with the advice and consent of the Council upon due consideration being given to the recommendation of the Board of Fire Commissioners of the Borough of Montvale, which recommendation shall not be deemed binding.
B. 
Term of office. The Fire Official shall serve for a term of one year, or thereafter until his successor shall be appointed. Any vacancy shall be filled for the unexpired term.
Such inspectors and other employees as may be deemed necessary by the governing body in the local enforcing agency shall be appointed by the Mayor with the advice and consent of the Council after having afforded the Fire Official and Chief of the Fire Department an opportunity to recommend to the Mayor and governing body the names of those persons deemed in their opinion to be qualified.
The Fire Official, inspectors and other employees of the enforcing agency shall be subject to removal, during the term for which they have been appointed, by the governing body for good cause, inefficiency and misconduct. Each Fire Official, inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, N.J.S.A. 52:27D-206 and 52:27D-208, any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of the County of Bergen.
A. 
The annual registration fee for life-hazard uses shall be as per the provisions of N.J.A.C. 5:70 et seq.

B. 
Except as otherwise specified for storage or manufacturing operations in N.J.A.C. 5:70-2.9(b), where more than one life-hazard use exists under one ownership at a given location, the highest life-hazard use shall be registered at full fee and subsequent life hazard uses at 1/2 the scheduled fee. Each life hazard use that is separately owned shall be registered at full fee.

C. 
The application fee for a permit shall be as per the provisions of N.J.A.C. 5:70 et seq.

D. 
In addition, the annual registration, permit and inspection fees for non-life-hazard uses shall be in accordance with the provisions of the New Jersey Uniform Fire Code, except as hereinafter set forth.

The above fees shall be applicable to all multiunit dwellings, including, without limitation, apartments, condominiums, and cooperative housing complexes, and all single-unit, non-owner-occupied dwelling units.

Pursuant to N.J.S.A. 52:27D-213b, buildings, structures and premises owned or operated by the state, its agencies, departments, political subdivisions (municipality and county) or instrumentalities or an interstate agency shall be inspected exclusively by the Department of Community Affairs or any agent thereof, including the Fire Prevention Bureau, provided that said agent has been given express written authorization by the Department of Community Affairs pursuant to duly enacted regulations delegating said inspection authority.
The Fire Prevention Bureau shall annually adopt a budget substantially consistent with the Local Fiscal Affairs Law, N.J.S.A. 40A:5-1 et seq., in general and in particular in accordance with the Fiscal Guidelines Pertaining to Implementation and Administration of the Uniform Fire Code as promulgated by the New Jersey Department of Community Affairs.

A. 
Collection of annual registration fees shall be made through the local enforcing agency pursuant to the provisions of N.J.A.C. 5:70, Subchapter 2.
B. 
Permit fees provided for by the code and otherwise by this article or any penalties collected shall be made in accordance with the provisions of N.J.A.C. 5:70, Subchapter 2.
All ordinances or parts of ordinances inconsistent with this article are hereby repealed.
If any section, subsection, sentence, clause, phrase or portion of this article is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
