Any Industrial User who is found to have violated an Order of the POTW or who has failed to comply with any provision of this ordinance and the orders, rules and regulations and Wastewater Discharge Permits issued hereunder, shall be fined in an amount not less than $5 nor more than $1,000 for each violation. For the purpose of this section, each day in which any such violation shall occur, shall be deemed separate violation, and a separate violation shall be deemed to have occurred for each constituent which has limitations listed in Article III of this ordinance found to exceed the limits established in this ordinance during any such day. In addition to the penalties provided herein, the POTW may recover reasonable attorney's fees, court costs, court reporter fees and other expenses of litigation by appropriate suit at law against the person found to have violated this ordinance or the orders, rules, regulations and permits issued hereunder.
Any person who knowingly makes any false statements, representation
or certification in any application, record, report, plan or other
document filed or required to be maintained pursuant to this ordinance
or wastewater discharge permit, or who falsifies, tampers with, or
knowingly renders inaccurate any monitoring device or method required
under this ordinance, shall be subject to the penalties and costs
provided in § 600.100 and shall in addition be guilty of
a misdemeanor and upon conviction, by punished by a fine of not established
to $1,000.
