Permits must be obtained for the construction of private family pools in compliance with the existing building and zoning codes. The Construction Official shall determine the fee for the construction permit and the zoning permit fee is in accordance with Chapter 175-11.
Plans shall accurately show the dimensions and construction of the pool and appurtenances and properly established distances from lot lines and buildings.
The provisions in this section were updated, at the request of the borough, to conform to the zoning regulations for accessory uses in a residential district pursuant to Ord. No. 78-02-260, as amended by Ord. No. 80-08-280. See Ch. 175, Zoning and Subdivision, Schedule of Uses and Requirements.
Private swimming pools shall not encroach on any front yard. No wall of a swimming pool shall be located less than 10 feet from any rear or side property line or 25 feet from any street property line. (For provisions on fences in yards containing swimming pools, see 175-33A of Ch. 175, Zoning and Subdivision.)
Any constructed pool which is used or intended to be used as a swimming pool in connection with a single-family residence and available only to the family of the householder and his private guests shall be classified as a private swimming pool.
All pools shall be for private family use and their guests. No fee shall be charged, either directly or indirectly, at any time. No commercial pools are allowed.
The pool structure shall be engineered and designed to withstand the expected forces to which it will be subjected. Any pool having a capacity in excess of 750 gallons shall have commercially designed and constructed pumps, filters and disinfecting equipment. It shall be designed and installed so that there is a pool water turnover at least every 18 hours. Filters shall not filter water at a rate in excess of five gallons per minute per square foot of surface area. The builder or supplier shall instruct the owner of a swimming pool as to the amount and proper use of disinfectants.
An adequate discharge system must be provided when the pool water and filter backwash water may be disposed of, in a manner not to cause flooding of adjacent properties. No discharge shall be connected to any present or future borough drainpipe.
All plumbing work will be in accordance with the Borough Building Code. (See Ch. 63. Building Construction.) All water used shall be of drinking quality and subject to inspection by the Board of Health of the Borough of Pine Beach.
Every person owning land on which there is situated a swimming pool or other body of water which constitutes an obvious hazard and contains 12 or more inches of depth at any point shall erect and maintain thereon an adequate enclosure, either surrounding the property or the pool area, sufficient to make such body of water inaccessible to small children. Such enclosures, including gates and locking facilities therein, must be not less than four feet above the underlying ground, making it inaccessible from the outside for small children to enter. (For additional provisions on this subject, see ยงย 175-33A of Ch. 175, Zoning and Subdivision.) This stipulation applies to pools only.
No overhead electrical conductors shall be installed within 15 feet of any swimming pool. All metal fences, enclosures or railings near or adjacent to a swimming pool to which bathers have access, which may become electrically alive as a result of contact with broken overhead conductors or from any other cause, shall be effectively grounded.

All persons who violate any provision of this chapter shall be subject to one or more of the following: a fine not to exceed $1,000, imprisonment for a term not to exceed 90 days or community service for a period not to exceed 90 days for each violation. Any continuation of any violation after sufficient notice has been given shall constitute a new violation.
Under the penalty of being a disorderly person, owners of pools shall not allow noise or lighting to be an annoyance to others.
