The Borough of Plymouth hereby signifies its intention and desire to organize an Authority under the Municipality Authorities Act, approved May 2, 1945, P.L. 382, and its amendments.[1]

The President and the Secretary of the Borough Council are hereby authorized and directed to execute on behalf of the Borough of Plymouth Articles of Incorporation for said Authority in substantially the following form:
ARTICLES OF INCORPORATION
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with the requirements of the Act of May 2, 1945, P.L. 382, as amended,[1] the Council of the Borough of Plymouth, a municipal corporation of the County of Luzerne and Commonwealth of Pennsylvania, desiring to organize an Authority thereunder, does hereby certify:
1.
The name of the Authority is the "Municipal Authority of the Borough of Plymouth."
2.
Said Authority is formed under the Act of May 2, 1945, P.L. 382, as amended and supplemented.
3.
No other Authority organized under said Act of May 2, 1945, as amended and supplemented, or by any previous act of Assembly authorizing and regulating municipal authorities, is in existence in or for the incorporating municipality, said Borough of Plymouth, County of Luzerne and Commonwealth of Pennsylvania.
4.
The name of the incorporating municipality is the "Borough of Plymouth," and the names and addresses of its municipal authorities are as follows.[2]
5.
The names, addresses and terms of office of the first members of the Board of said Authority are as follows.[3]
6.
The project or projects to be undertaken by said Authority shall be projects permitted and authorized by the laws of the Commonwealth of Pennsylvania as the Borough of Plymouth may, from time to time, by resolution or ordinance, specify.

There be and is hereby established a salary, as contained in the Salary Ordinance, to be paid each member of the Board of the Municipal Authority from the funds derived from the operation of authorized projects by the Board. Said salary shall be paid in monthly installments.
All ordinances enacted prior hereto relating to the creation of a Municipal Authority be and are hereby repealed.
