A.
The Borough has fees, fines and other matters in which citizens or
persons submit personal or business checks to pay for the same;
B.
From time to time the Borough has received checks that are not collectable
due to insufficient funds;
C.
When the check is uncollectable, the Borough sustains a service charge
placed upon its accounts in which said check was deposited and in
addition incurs unnecessary work on the part of its clerical staff
due to the noncollectability of the bad check;
D.
The Borough should not sustain any loss due to the receipt of a bad
check;
The Plymouth Borough Council, for the reasons set forth above
and incorporated herein, hereby imposes a charge of $50 for each and
every bad check presented to the Borough that does not clear when
deposited in any Borough account to cover fees charged to the Borough
for depositing a bad check and to cover administrative costs resulting
from dealing with the bad check. In addition, upon failure of the
maker, their agent or employ to make good the amount of the initial
check tendered to the Borough and the $50 charge within seven business
days of the mailing date of notice of the same from the Borough shall
be subject to the all fees and costs connected with the filing of
a complaint with the Magisterial District Judge having jurisdiction
over Plymouth Borough matters in addition to the payment of the amount
of the initial bad check and the $50 charge. This remedy shall be
in addition to and shall not preclude the filing of criminal charges
to redress the issuance of the bad check.
This chapter will be effect as per the Borough Code, 8 Pa.C.S.A. § 3301.3.
