Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of the State of New Jersey shall be deemed to
apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.
a.
The
Chief of Police of this Borough is hereby authorized to provide by
regulation for the closing of any street or portion thereof to motor
vehicle traffic on any day or days whenever he finds that such closing
is necessary for the preservation of the public safety, health or
welfare.
b.
Any
regulations promulgated by the Chief of Police and in accordance with
paragraph a above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c.
Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed $50.
d.
Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage,
which may result from such removal before regaining possession of
the vehicle.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $100 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.
All former traffic ordinances of the Borough of East Newark
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
The Borough Council of the Borough of East Newark finds and
declares that problems of traffic control occur when traffic must
be moved through or around street construction, maintenance operations,
and utility work, above and below ground, which requires blocking
the roadway and obstructing the normal flow of traffic; and that such
obstructions are or can become dangerous when not properly controlled.
In order to better promote the public health, safety, peace and welfare,
it is necessary to establish controls and regulations directed to
the safe and expeditious movement of traffic through and around construction
and maintenance zones and to provide safety for the work forces performing
these operations.
The Borough of East Newark, in the County of Hudson, State of
New Jersey, does hereby adopt the current Manual on Uniform Traffic
Control Devices for Streets and Highways hereafter known as M.U.T.C.D.,
except as hereby supplemented and amended, as it controls and regulates
whenever construction, maintenance operations of utility work obstructs
the normal flow of traffic. Any person, contractor, or utility, that
fails to comply with the provisions of the M.U.T.C.D. while performing
such work is in violation of this section.
It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under the public utility
agreement, section 16:25-9.2, wishing to conduct work on, under or
above the street to contact the Police Department of the Borough of
East Newark, in order to arrange a pre-construction meeting and to
submit plans for the safe movement of traffic during such period of
construction or work. Any person, contractor or utility who fails
to comply with this section prior to the start of such work, or whose
plans are not approved by the Police Department of the Borough, is
in violation of this section.
The person, contractor or utility shall provide at least two
emergency contact telephone numbers to be called in case of emergency
problems at the construction or maintenance site prior to the start
of any work. If, for any reason, emergency contact must be made, or
if the emergency contact person does not respond to a call from the
Police Department to correct such hazardous condition, the Borough
of East Newark may respond to correct such hazardous condition(s).
The reasonable fees for such emergency services by the Borough of
East Newark shall be charged to the person, contractor, or utility
responsible for the condition.
There shall be no construction, maintenance, operations, or
utility work on any roadway in the Borough before the hour of 9:00
a.m. or after 4:00 p.m. The Officer-in charge of the Borough Police
Department may adjust this time limit to permit work prior to 9:00
a.m. or after 4:00 p.m. If the Officer-in-charge determines that the
construction or maintenance operations prior to 9:00 a.m. or after
4:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 9:00 a.m. and
4:00 p.m.
Road closing and/or traffic detours shall not be permitted unless
approved by the Borough Police Department.
Traffic directors shall be posted at all construction or maintenance
sites when determined by the Borough Police Department that same is
necessary to provide for the safe and expeditious movement of traffic.
The Borough Police Department shall have the authority to stop
work, including the removal of equipment and vehicles, stored material
within the street right-of-way, back filling of open excavations and/or
other related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.
It is to be expressly understood that no materials, vehicles
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, lights, devices and pavement markings are
installed.
Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than $100 nor more than $500 and/or be imprisoned
in the County jail for a term not exceeding 90 days. For a second
offense, upon conviction thereof, the person, contractor or utility
shall pay a fine of not less than $250 and/or be imprisoned in the
County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
the streets where temporary EMERGENCY NO PARKING signs are displayed.
The Chief of Police or, in his absence, the ranking Police Officer
is authorized to declare an emergency and to direct the posting of
EMERGENCY NO PARKING signs when weather conditions, accidents, road
construction, fire or public celebrations dictate or require avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that EMERGENCY NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle,
which has been parked prior to the posting of the signs.
b.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

a.
Whenever snow has fallen and the accumulation is such that it covers
the streets and highways, an emergency shall exist and no vehicle
shall be parked on the streets or highways or portions thereof indicated.
The parking prohibitions shall remain in effect after the snow
has ceased, until the streets have been plowed sufficiently, and to
the extent that parking will not interfere with the normal flow of
traffic.
b.
Any unoccupied vehicle parked or standing in violation shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic
and any Police Officer may provide for the removal of such vehicle.
The owner shall pay the reasonable costs of the removal and storage,
which may result from such removal before regaining possession of
the vehicle.

b.

The following definitions will control for the purpose of this section:
Shall mean and include all the motor vehicles used for the
transportation of passengers for hire, except commuter vans and vehicles
used in ridesharing arrangements and school buses, if the same are
not otherwise used in the transportation of passengers for hire.
Shall mean every motor vehicle operated by, or under contact
with a public or governmental agency, or religious or other charitable
organization or corporation or privately operated for compensation
for the transportation of children to or from school for secular or
religious education, which complies with the regulations of Department
of Education affecting school buses.
Shall mean every vehicle with or without motive power, designed
for carrying persons or property and for being drawn by a motor vehicle
and so constructed that some part of its weight and that of its load
rests upon or is carried by another vehicle.
Shall mean every vehicle, with or without motive power, designed
for carrying persons or property and for being drawn by a motor vehicle
and so constructed that no part of its weight rests upon the towing
vehicle.
Shall mean every motor vehicle designed, used or maintained
primarily for the transportation of property.
Shall mean every motor vehicle designed and used primarily
for drawing other vehicles and not so constructed as to carry a load
other than a part of the weight of the vehicle and load so drawn.
Shall mean all enclosed vehicles used primarily for the transportation
of goods or materials.
3.
This overnight parking prohibition shall apply to the vehicles listed
in paragraph b1 regardless of type of registration, private or commercial,
with the exception that privately registered minivans will not fall
under the purview of this section.
4.
Penalties and Fines. Vehicles that are in violation of this paragraph
shall be fined no less than $50 and no more than $200.

Parking Only.
1.
Effective
24 hours a day, one side of every designated street will be designated
resident permit parking only. These zones are valid only for vehicles
displaying a valid resident parking permit and are indicated by signage.
2.
Only
vehicles with current resident parking permits may park in a resident
permit parking only area. Unless otherwise posted, other vehicles
shall not park in these areas at any time or for any reason, with
the exception of vehicles specifically endorsed by the Chief of Police,
to do so.

a.
The Borough of East Newark shall adept reasonable regulations for
the placement of all permits. Permits issued by the East Newark Police
Department shall include but not be limited to, residential, nonresidential,
temporary, visitor and business permits. Any vehicle bearing an invalid
or expired permit and parked on any street within the Borough shall
be subject to the same penalty as a vehicle parked on a street without
a parking sticker or permit. All permits are nontransferable.
b.
Parking Permits.
1.
Residential Parking Permit. Upon the granting of the residential
permit designation the following rules and regulations will apply:
(a)
A resident parking permit of a design specified by the Borough
of East Newark will be issued to the resident owner/lessee of a vehicle.
The vehicle must be owned or leased by a person residing in the Borough
of East Newark and must not be registered as commercial vehicle.
(b)
Proof of vehicle owner/lessee's residence must be presented
when applying for a permit. The following proof is required:
(1)
A valid New Jersey driver's license bearing the vehicle owner's/lessee's
East Newark address;
(2)
A valid New Jersey motor vehicle registration for the vehicle
for which the permit is sought bearing the owner's East Newark address;
(3)
A valid New Jersey motor vehicle insurance card for the vehicle
for which the permit is sought bearing the owner's East Newark address.
(c)
A resident parking permit shall be valid until the resident
no longer resides at the address for which the permit was issued and
every two years from the initial program start.
(d)
In the event that a resident with a residential parking permit
relocates within the Borough of East Newark, the resident is required
to notify the East Newark Police Department of their new address.
(e)
The fee for a resident parking permit shall be $0.
2.
Nonresident Parking Permit. Upon the granting of the nonresident
permit designation the following rules and regulations will apply:
(a)
A nonresident parking permit of a design specified by the Borough
of East Newark will be issued to the nonresident owner/lessee of a
vehicle. The vehicle must not be registered as a commercial vehicle.
(b)
Proof of vehicle owner/lessee's residence or employment must
be presented when applying for a permit. The following proof is required:
(1)
A valid driver's license bearing the vehicle owner's/lessee's
issued by any State within the United States;
(2)
A valid motor vehicle registration for the vehicle for which
the permit is issued. Registration must be issued by any state within
the United States;
(3)
A valid vehicle insurance card for the vehicle for which the
permit is sought.
(4)
A current utility bill and lease exhibiting the applicant's
name and East Newark address or in the case of a month-to-month renter,
a landlord's affidavit attesting to the residency of the applicant
in lieu of a lease.
(5)
In the case where the applicant is employed in a business with
its location in the Borough of East Newark, a valid employment identification
and/or pay stub along with the above vehicle documentation must be
presented.
(c)
A nonresident parking permit shall be valid until the resident
no longer resides or is employed at the address for which the permit
was issued and must be renewed January 1 of the current year.
(d)
In the event that a nonresident with a nonresidential parking
permit relocates within the Borough of East Newark, the resident is
required to notify the East Newark Police Department of their new
address.
(e)
The fee for a nonresident parking permit shall be $50 for a
period of 12 months when issued at any time from January 1 through
June 30 of the current year. The fee for any permit issued after July
1 up to and including December 31 shall be $25.
3.
Visitor Parking Permit. Upon the granting of the visitor permit designation
the following rules and regulations will apply:
(a)
A visitor parking permit of a design specified by the Borough
of East Newark will be issued to a visitor nonresident owner/lessee
of a vehicle. The vehicle must be owned or leased by a person visiting
in the Borough of East Newark and must not be registered as a commercial
vehicle.
(b)
A visitor permit will be granted for any visitor who meets the
following qualifications:
(1)
Visitor permits will be issued for a period not longer than
two weeks, holidays and weekends included;
(2)
Visitor permits must be clearly displayed in the manner as prescribed
by the East Newark Police Department at all times when the vehicle
is parked in the Borough of East Newark;
(3)
Use of visitor permit, other than as permitted by this subsection,
will constitute a violation of this subsection and will result in
issuance of a summons or revocation of the applicant's privilege to
obtain additional visitor permits.
4.
Governmental Employees Parking Permit.
(a)
Nonresident employees of East Newark's government agencies and
employees of the East Newark School District located in the Borough
of East Newark may obtain government employee permits. The permit
shall be reasonably limited to the hours during which the nonresident
employee is present at its place of employment.
(b)
All written requests for government employee parking permits
shall be executed by the responsible officer of the employer. The
Chief of Police shall be entitled to obtain periodic verification
of all relevant information and shall have the power to invalidate
or not renew any government employee parking permits issued pursuant
to this subsection if the information indicates nonentitlement of
the permit. The letter, on the government agency's letter head, shall
list the name of the employee, the vehicle identification number and
license plate of the vehicle, the driver's license number, and such
other information as may be required by the Chief of Police. The employee
may register up to two vehicles for which the permit is requested.
Employees shall only be allowed one permit which may be transferred
to either registered vehicle utilized at any one time.
(c)
The government agency must immediately notify the Chief of Police
of any inactive employees. Employees not actively engaged in work
at the governmental agency during the agency's normal working hours
who use the permits to park on the streets of East Newark will be
in violation of the Residential Permit Parking Ordinance.
(d)
Governmental employee permits are valid for one year and must
be renewed during the month of September of each year.
c.
Conditions for Revocation. Parking permit will automatically be revoked
if a vehicle ceases to qualify, if affixed to a car other than the
one so designated at the time of application, or if the registration
number or the registration number or the resident sticker is different
than the one on the vehicle. Any vehicle bearing a revoked parking
sticker and parked within the designated streets will be subject to
the same penalty as a vehicle parked on a street within the Borough
of East Newark without a parking sticker or visitor permit.
d.
Placement of Permit. The parking permit shall be placed on the rear
view mirror facing the front windshield of the vehicle, driver's side
or as directed by the East Newark Police Department.
e.
Penalties. Any vehicle parked in violation of this subsection will
be subject to a fine of $35.
f.
Violations. It shall be unlawful and a violation of this subsection
for a person to copy, produce or otherwise bring into existence a
facsimile or counterfeit permit of any form or to alter a permit.
It shall further be unlawful and a violation of this section for a
person to knowingly use or display an altered, facsimile or counterfeit
permit, in order to evade time limitations on parking applicable to
residential permit parking areas.
g.
Exceptions. Exceptions shall be as follows:
1.
Emergency Vehicles. Emergency vehicles and public service, telephone
and other public utility vehicles may park within the permit parking
area during the time required to render services or repairs within
the area.
h.
Authority to Promulgate Rules and Regulations. The East Newark Chief
of Police shall have the authority to formulate and promulgate rules
and regulations to further effectuate the intent of this subsection.

a.
The Borough of East Newark, for good cause shown, does hereby establish
by ordinance restricted parking zones in front of or near residences
occupied by handicapped drivers provided that such parking is not
otherwise prohibited and does not interfere with the normal flow of
traffic. No restricted parking zones will be established for persons
who do not transport themselves and who do not possess a valid "handicapped
person" identification card and placard or license State issued by
the State of New Jersey, Motor Vehicle Commission, pursuant to N.J.S.A.
39:4-205 and 4-206. No restricted parking zones will be established
for applicants who have a driveway, carport, garage or off-street
space available for their use.
b.
The term "handicapped driver" means any driver who has lost the use
of one or more lower limbs as a consequence of paralysis, amputation
or other permanent disability or who is permanently disabled as to
be unable to ambulate without the aid of an assisting device or whose
ambulation is otherwise severely limited.
c.
Applications for the establishment of restricted parking zones may be obtained from the East Newark Police Department and shall be filed with the Chairman, Police Committee who shall cause each application to be investigated for compliance with subsection (a). Thereafter, the Chairman of the Police Committee shall notify the applicant when and where to report for a medical examination or in the alternative shall notify the applicant of the person to contact to arrange such medical examination. The examining physician shall be selected by the Chairman, Police Committee. The cost of examination shall be borne completely by the applicant. The applicant shall bring to the examination any and all medical or other documentation which he or she believes relevant as to the applicant's physical condition. Such documentation may include, but not limited to, x-rays, reports, C.T. scan reports, cardiograms, hospital and surgical records and attending physician's report. If the examining physician does not possess adequate documentation to verify the applicant's eligibility under paragraph b and cannot by examination alone verify such eligibility, the applicant may be rejected.
d.
1.
Applicants who meet all of the requirements and are deemed by the
examining physician as having a disability of sufficient severity
to warrant the establishment of restrictive parking zone, shall have
their names and addresses submitted to the Borough Council for approval.
2.
Applicants who do not meet all of the requirements or who are not
deemed by the examining physician as having a disability of sufficient
severity to warrant the establishment of restricted parking zones,
shall be notified of such by mail.
e.
If the Borough Council so approves, the Chairman of Police Committee
shall cause to be established a restricted parking zone in front of
or near the residence of the applicant and shall issue a permit which
complies with N.J.S.A. 39:4-197.7. Only the motor vehicle for which
a valid permit has been issued shall be parked in such zone and only
when the permit is properly displayed. Only one permit shall be issued
to each applicant.

Restricted parking permits shall be valid for two years and shall
be renewed thereafter in accordance with paragraphs a through e.

Any party denied a restricted parking zone shall have the opportunity
to request reconsideration of such denial. A letter requesting reconsideration
must be received by the Chairman, Police Committee within 20 days
of the date of the notice of denial. The applicant will then be advised
to report for a medical examination with a different examining physician
and/or the Borough Council may hold a hearing to reconsider any relevant
evidence pertaining to the applicant's eligibility, at the option
of the applicant. As in the initial medical examination, costs shall
be borne by the applicant and it shall be the responsibility of the
applicant to bring to the examination and/or hearing any and all documentation
in support of his or her condition. The applicant will be notified
by mail of the decision on reconsideration. No more than one reconsideration
will be rendered each applicant. Thereafter, the applicant may reapply
in accordance with paragraphs a through e after one year has elapsed
from the date of notice of denial.
h.
Existing Restricted Parking Zones. All persons with exiting restricted
parking zones which do not comply with paragraphs a through e above
are hereby cancelled effective six months after the effective date
of this subsection. The Chairman, Police Committee shall establish
fair and uniform procedures to assure that each holder of an existing
permit is afforded an opportunity to present evidence of compliance
with this subsection. Such procedures shall provide that notice of
cancellation be sent to all persons with existing restricted parking
zones not later than 20 days before the cancellation of such permit.

a.
Purpose.
The Borough's Fire Chief and Deputy Fire Chief shall be entitled to
have one parking space directly in front of the Fire Chief and/or
Deputy Fire Chief's place of residence within the Borough reserved.
Said vehicle must be the official Borough vehicle issued to the Official.
It shall be a violation for anyone other than the Fire Chief or Deputy
Fire Chief to park in said space. Furthermore, this reservation shall
cease upon the termination, retirement, resignation or death of the
Fire Chief and/or Deputy Fire Chief, or said officials vacating the
premises as their respective places of residence.
b.
Penalties
and Fines. Vehicles that are in violation of this subsection shall
be fined no less than $50 and no more than $200 plus court costs.

a.
Purpose.
Members of the public shall be allowed to utilize the space in front
of the Municipal Offices located at 34 Sherman Avenue for on-street
parking for a duration of no more than 10 minutes for Borough business
and use of the Borough's facility.

of this subsection shall not apply to those visiting the Municipal
Offices for business at the Borough's Municipal Court.
c.
Penalties

a.
The Borough of East Newark, for good cause shown, does hereby establish
by ordinance restricted parking zones in front of or near residences
occupied by handicapped drivers provided that such parking is not
otherwise prohibited and does not interfere with the normal flow of
traffic. No restricted parking zones will be established for persons
who do not transport themselves and who do not possess a valid "handicapped
person" identification card and placard or license state issued by
the State of New Jersey, Motor Vehicle Commission, pursuant to N.J.S.A.
39:4-205 and 4-206. No restricted parking zones will be established
for applicants who have a driveway, carport, garage or off-street
space available for their use.
b.
The term "handicapped driver" means any driver who has lost the use
of one or more lower limbs as a consequence of paralysis, amputation
or other permanent disability or who is permanently disabled as to
be unable to ambulate without the aid of an assisting device or whose
ambulation is otherwise severely limited.
c.
Applications for the establishment of restricted parking zones may be obtained from the East Newark Police Department and shall be filed with the Chairman, Police Committee who shall cause each application to be investigated for compliance with subsection (a). Thereafter, the Chairman of the Police Committee shall notify the applicant when and where to report for a medical examination or in the alternative shall notify the applicant of the person to contact to arrange such medical examination. The examining physician shall be selected by the Chairman, Police Committee. The cost of examination shall be borne completely by the applicant. The applicant shall bring to the examination any and all medical or other documentation which he or she believes relevant as to the applicant's physical condition. Such documentation may include, but not limited to, x-rays, reports, C.T. scan reports, cardiograms, hospital and surgical records and attending physician's report. If the examining physician does not possess adequate documentation to verify the applicant's eligibility under subsection 7-39.2Ab and cannot by examination alone verify such eligibility, the applicant may be rejected.
d.
1.
Applicants who meet all of the requirements and are deemed by the
examining physician as having a disability of sufficient severity
to warrant the establishment of restrictive parking zone, shall have
their names and addresses submitted to the Borough Council for approval.
2.
Applicants who do not meet all of the requirements or who are not
deemed by the examining physician as having a disability of sufficient
severity to warrant the establishment of restricted parking zone,
shall be notified of such by mail.
e.
If the Borough Council so approves, the Chairman of Police Committee
shall cause to be established a restricted parking zone in front of
or near the residence of the applicant and shall issued a permit which
complies with N.J.S.A. 39:4-197.7. Only the motor vehicle for which
a valid permit has been issued shall be parked in such zone and only
when the permit is properly displayed. Only one permit shall be issued
to each applicant.
f.

shall, subsequent to initial procurement and installation, maintain
such signs and pavement markings in good condition at no cost or expense
to the Borough of East Newark. The owner shall be responsible for
the repair and restoration or replacement of same.

a.
Permitted Parking. Residents shall be permitted to park in the Borough's
parking lots, upon application to the Office of the Borough Clerk,
in accordance with the Rules promulgated by the Borough Clerk's Office.
b.
Prohibitions.
1.
Vehicles longer than 17 feet are prohibited from parking in the following
Borough-controlled lots: Searing Avenue, John Street Lot 1, John Street
Lot 2, Veterans, Central Avenue, Valley National.
2.
Commercial vehicles are prohibited from parking in the following
Borough-controlled lots: Searing Avenue, John Street Lot 1, John Street
Lot 2, Veterans, Central Avenue, Valley National.
6.
Residents
may not sublet, assign or otherwise transfer their parking rights.
Upon moving from the Borough, residents shall return their permit.
If determined that a spot has been sublet, parking privileges shall
be forfeited.

Parking Fees.

There is a $65 fee, per vehicle, for parking in the following lots:

2.
There is a $150 fee, per vehicle, for parking in the Passaic Avenue Lot for commercial vehicles. Commercial vehicles shall be defined pursuant to Borough Ordinance 13-06 (Subsection 7-8.9).
3.
Failure to pay the parking fee by the 10th of the month shall result
in a $25 late fee for the first offense and $50 for the second offense,
including forfeiture of parking privileges.
d.
Enforcement. Any person parking their vehicle, in violation of this
subsection, shall be subject to having the vehicle ticketed and/or
towed at the owner's expense. Failure to abide by the rules promulgated
by the Clerk's office may result in the forfeiture of parking privileges.

a.
No driver
shall enter an intersection unless there is sufficient space on the
other side of the intersection to accommodate the vehicle he/she is
operating without obstructing the passage of other vehicles or pedestrians,
notwithstanding any traffic-control signal indication to proceed.
b.
All intersections
within the Borough of East Newark shall be designated as "Don't Block
the Box" intersection and appropriate striping and signage shall be
provided.
c.
This section
is consistent with and amplifies N.J.S.A. 39:4-67, by authorizing
the installation of signage to be designed for this purpose and erected
at intersections.
d.
There shall
be a minimum penalty of $250 for a violation of this section.
