[Adopted 8-8-2006 by Ord. No. 5-2006]
That a certain document, three copies of which are on file in the office of the Plymouth Borough Secretary of Plymouth Borough, being marked and designated as the International Energy Conservation Code, 2006 edition, as published by the International Code Council, be and is hereby adopted as the Energy Conservation Code of the Borough of Plymouth, in the State of Pennsylvania for regulating and governing energy efficient building envelopes and installation of energy efficient mechanical, lighting and power systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Energy Conservation Code on file in the office of the Borough of Plymouth are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 90-39 of the article.
The following sections are hereby revised:
Section 101.1. Insert: Borough of Plymouth.
That Ord. No. 4 of 1999 of the Borough of Plymouth entitled "An ordinance of the Borough of Plymouth adopting the 1998 edition of the International Energy Conservation Codes, regulating and controlling the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of the building envelope, mechanical, lighting and power systems in the Borough of Plymouth"; providing for the issuance of permits and collection of fees therefor; repealing Ord. No. 3 of 1990 of the Borough of Plymouth and all other ordinances and parts of the ordinance in conflict herewith are hereby repealed.
That if any section, subsection, sentence, clause or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Plymouth Borough Council hereby declares that it would have passed this article, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
That nothing in this article or in the Energy Conservation Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 90-40 of this article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
That the Borough Secretary is hereby ordered and directed to cause this article to be published.
That this article and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the date of its final passage and adoption.
