[HISTORY: Adopted by the Borough Council of the Borough of Plymouth 6-6-1932. Amendments noted where applicable.]
From and after the passage of this chapter, any person, firm or corporation, whether principal or agent, beginning or desiring to begin a transient retail business in the Borough of Plymouth, Pennsylvania, for the sale of any goods, wares or merchandise of any kind whatsoever or for the sale or taking of any picture, photograph or likeness of any kind and who or which hires, leases, occupies or uses any room, apartment, store, shop, building, railway car or other place or structure for the exhibition or sale of such goods, wares or merchandise or the sale or taking of any picture, photograph or likeness of any kind shall, before beginning such business, procure from the Mayor a license therefor, the cost of which shall be paid to the Borough Treasurer, who shall give his receipt therefor. Application for such license shall be made at least five days prior to the issuance thereof by the Mayor and the beginning of any business thereunder, in order that the proper officers of the Borough may make inquiry into the character of the business contemplated and the reputation of the person making such application.

The licensing requirements set forth in § 173-1 shall apply to the following, but the license fee herein contained shall not be taken to apply to:
A. 
Farmers selling their own produce.
B. 
Any sale of goods, wares or merchandise donated by the owners thereof, the proceeds whereof are to be applied to charitable purposes.
C. 
Any manufacturer or producer in the sale of bread and bakery products, meat and meat products or milk and milk products, provided that the term "milk and milk products" shall not include or apply to ice cream or other frozen desserts.
The cost of the license provided in § 173-1 hereof shall be $100 per month or fraction thereof and said license shall be renewed monthly during the continuance of the sale.

Any person, firm or corporation who shall begin any transient retail business in the Borough without first having procured a license, as aforesaid, shall, upon conviction thereof before any Magisterial District Judge be subject to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, shall undergo imprisonment in the county jail for a period not exceeding 30 days.
