[1975 Code § 3-5.1]
The Borough is the owner of a certain river-front lands situated in the Borough; and it is deemed advisable by the Borough Council in the interest of the public health, safety and convenience to regulate the use of the riverfront lands and public parks; to authorize the establishment of bathing beaches at these locations in the Borough; to employ lifeguards and to furnish boats and other lifesaving equipment for the protection of persons using the bathing beaches and to regulate the use thereof; and to prohibit the use for bathing beach of the riverfront lands in the Borough outside the limit of such bathing beaches as are established under the terms and provisions of this section.
The maintenance, regulation and protection of the public parks and bathing beaches is an expense for the Borough. The Borough Council has determined to require persons using the bathing beaches to pay reasonable permit fees for the purposes of meeting the expenses of maintenance, regulation and protection of these bathing beaches. The Borough Council has determined to require persons mooring boats at the parks to pay reasonable permit fees for the purpose of meeting the expenses of maintenance, regulation and protection of the parks.

The establishment of not more than two or less than one bathing beach at suitable locations on the riverfront land of the Borough is hereby authorized.
Subject to the provisions of this section, the number, location and boundaries of such bathing beaches shall be determined by the Mayor and Park Committee of the Borough Council with special regard to the physical conditions of the riverfront lands as affecting public safety.

The location and boundaries of all bathing beaches established under this section shall be indicated or marked by the erection of appropriate signs, fences or otherwise as shall be determined by the Mayor and Recreation Commission of the Borough Council.

For the protection of persons using the bathing beaches as established under this section, the Borough shall employ one lifeguard during the summer season for each bathing beach. Lifeboats and other lifesaving equipment may be furnished by the Borough for use of the bathing beaches. The bathing beaches shall be open for use on days and at times as shall be determined by the Mayor and Park Committee of the Borough Council.

No person shall enter upon or use any bathing beach for the purpose of bathing or swimming in the waters of Toms River or in Jakes Branch except where permitted by the Recreation Commission and under its rules and regulations.
[1975 Code § 3-5.6]
No person while in or using any public park or bathing beach or while bathing or swimming in the waters of Toms River adjacent thereto shall:
a. 
Annoy or molest any other person or persons.
b. 
Utter any offensive or indecent language.
c. 
Act in any disorderly manner.
d. 
Throw, discard or leave any cans, bottles, paper or other refuse of any kind whatsoever upon any such bathing beach.
e. 
Climb upon, break, deface, destroy or damage any property of the Borough on any bathing beach.
f. 
Disrobe in any place not provided for such purposes.
g. 
Build or ignite any open fire without a written permit issued by the Recreation Commission and the Fire Marshal of the Borough Council.
h. 
Refuse and fail to obey and comply with any of the rules and regulations established by the Borough Council or by the Recreation Commission for the management, control and regulation of the use of the public parks and bathing beaches.
i. 
Operate a beach buggy or other motor vehicle except a motor vehicle which shall be registered in the name of the Borough of South Toms River on any public park or municipally-owned beach in the Borough.

No person shall, for the purpose of bathing or swimming in the waters of Toms River, use any of the riverfront lands of the Borough except within the boundary of the bathing beaches as established in this chapter.

No person shall bring any dog on any bathing beach. No person shall permit any dog owned by him or in his custody to be or remain on any bathing beach and any dog found upon any bathing beach shall be impounded by the Police and disposed of according to law.

No person shall use or be in possession of any glass bottle or other glass container upon any beach, park or other recreational facility owned or maintained by the Borough of South Toms River.
Anyone found in violation of this section shall be subject to the penalties as set forth in Chapter 1 Section 1-5 of the Revised General Ordinances of the Borough of South Toms River.

No person shall be in or on any municipally-owned park in the Borough of South Toms River except between the hours of 8:00 a.m. and sunset Eastern Standard Time.

No person, firm, corporation or other legal entity shall launch any boat and/or personal water craft at any riverfront lands owned by the Borough. Any violation of this section shall be subject to penalties set forth in Chapter 1, Section 1-5 of the Revised General Ordinances of the Borough of South Toms River.

a. 
No person shall abandon any boat, vessel, yacht, barge or raft on any river-front land owned by the Borough, in any public park, bathing beach or in the waters of Toms River adjacent thereto.
b. 
Penalty. In addition to the penalties prescribed in Section 1-5, any person who shall violate any of the terms or provisions of this subsection shall, upon conviction thereof before the Judge of the Municipal Court or other Judge authorized to hear and determine the matter, forfeit and pay such additional fine as shall be equal to cost of removing from the riverfront property of the Borough or the waters of Toms River adjacent thereto any boat, vessel, yacht, barge or raft as shall be abandoned.

The municipally-owned properties known as the Community Center/Recreation Building at 1 Drake Lane and Mathis Plaza may be offered for one day rentals on a first come, first serve basis, to persons or organizations.

The applicant is responsible for any and all damages incurred and will forfeit the deposit should any damage be noted. The applicant is solely responsible for the cost of damages in excess of the deposit posted.

A refund of any deposit will be made to the applicant only. Checks received for the application must be in the name of the applicant. In the case of the property at 1 Drake Lane, the applicant will be required to sign the appropriate voucher which will start the refunding process. The governing body, at a regularly scheduled meeting following the use of the facility and signing of the voucher, may approve the refund.

The Community Center/Recreation Building at 1 Drake Lane may be leased on a recurring basis to various groups which serve residents of South Toms River pursuant to the Local Lands and Buildings Law N.J.S.A. 40A:12-14.
a. 
The property located at 1 Drake Lane shall be advertised pursuant to all requirements and procedures set forth in the Local Lands and Buildings Law including advertisements in the official newspaper of the Borough at least once a week during two consecutive weeks, the last publication to be not earlier than seven days prior to the letting of the lease.
b. 
Sealed bids shall be received by the Borough Clerk at the Borough Clerk's Office, 144 Mill Street, South Toms River, New Jersey, 08757.
c. 
The Borough reserves the right to reject any and all bids.
d. 
The term of any lease shall be a maximum of six months.
e. 
One month's rent shall be required as a security deposit.
f. 
A written lease must be executed by the successful bidder within 10 days of award by the Borough Council.
