No elected or appointed official, officer or employee of the
Borough shall engage in any business transactions or professional
activity or acquire a financial interest, directly or indirectly,
which is or may be inconsistent with the proper discharge of his official
duties unless full disclosure thereof is made to the Mayor and Council.

No elected or appointed official, officer or employee of the
Borough shall represent any private interests to the detriment of
the Borough or for the purpose of unwarranted personal gain before
any Borough agency, board, department or the Municipal Court.

In the event any elected or appointed official has a direct
or indirect financial or other private interest in any proposed ordinance
he shall disclose publicly the nature and extent of such interest.

No elected or appointed official or employee shall accept any
gift or gratuity from any person, firm or corporation which to his
knowledge is interested, directly or indirectly, in any business transaction
with the Borough and over which transaction he has power to influence
official action.

No elected or appointed official, officer or employee shall
improperly use his official position to obtain a personal benefit
or gain from any person.

In the event that any elected or appointed official, officer or employee
shall violate any of the provisions of this section, then charges
shall be filed with the Mayor and Council who shall promptly set the
matter down for formal hearing and shall serve on the accused a copy
of the charges and shall advise him of the date and place of hearing
at least 10 days prior thereto. At the hearing the accused may be
represented by counsel and shall be afforded an opportunity to be
heard.

In the event that any appointed official, officer or employee should
violate any of the provisions of this section, the Mayor and Council
may suspend, demote or dismiss such official, officer or employee.

The following days are to be legal holidays for all employees
of the Borough.

The hours of operation for the employees of the Borough of South
Toms River shall be established individually by each department supervisor
on an annual basis, after the Council approves and confirms the hours.

As used in this section:
Shall mean Borough employees assigned or permitted by a department
head to operate a vehicle; Borough officials and department heads
authorized by the Mayor or the Borough Council or the Chief of Police.
Shall mean all sedans, station wagons, sport utility vehicles,
vans, trucks and equipment owned or leased by the Borough of South
Toms River for use by Borough employees to conduct the business of
the Borough.
Shall mean Municipal vehicles used by Borough Officials,
department heads or employees to conduct Borough business.

Employees assigned municipal vehicles or Supervisors whose units
are assigned vehicles are responsible for ensuring that their vehicles
are clean, in good operating condition, serviced according to the
established preventative maintenance schedule, and inspected by the
New Jersey Motor Vehicle Commission as required.

Only authorized personnel may be transported in municipal vehicles.
c.ย
Vehicles shall be used for official, work-related activities only.
This does not include such activities as excursions for check cashing
or coffee break supplies.
d.ย
Insurance premiums are paid by the Borough. Current insurance cards
shall be placed in the vehicle glove compartments. However, it is
the operator's responsibility to be sure the current vehicle
registration and insurance card are in his/her possession.
e.ย
All municipal vehicle drivers shall possess a current, valid New
Jersey drivers license.
f.ย
All occupants of Borough of South Toms River vehicles shall wear
seat belts at all times.
g.ย
Operators of Borough vehicles shall obey all motor vehicle laws.
Failure to comply with all motor vehicle laws may result in disciplinary
action, up to and including termination of employment.
h.ย
Unauthorized use or removal of a municipal vehicle may be cause for
disciplinary action, up to and including termination of employment.
i.ย
Payment of traffic/parking tickets are the responsibility of the
operator of the vehicle. Failure to attend to the summons and pay
any fine required may result in disciplinary action.

Unless otherwise provided in Statutes, all officers and employees
employed by the Borough of South Toms River shall be bona fide residents
of the Borough. A bona fide resident as used in this section shall
be defined as a person having a permanent domicile within the Borough
of South Toms River and one which has not been adopted with the intention
of again taking up or claiming a previous residence acquired outside
the boundaries of the Borough.
The residency requirement shall be waived in the appointment
of the Chief Financial Officer. The Borough's Chief Financial
Officer may be a nonresident of the Borough.

Purpose. It is the intention of this paragraph to authorize an amendment
to the rules and regulations governing the Police Department in order
to adopt the Ocean County Law Enforcement Drug Testing Policy for
the Department and its members.
b.ย
Amendment to the Departmental Rules and Regulations. The Rules and
Regulations governing the Police Department are hereby amended to
include therein as the Department's Drug Testing Policy, the
"Ocean County Law Enforcement Drug Testing Policy" dated November
2002, a true and correct copy of which is attached hereto and incorporated
herein.[1]

Copy Supplied. A copy of the Drug Testing Policy shall be provided
