Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle I of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time
as may be in current use in the Borough.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where EMERGENCY NO PARKING signs are
displayed. The Mayor or, in his absence, the superintendent of streets
and roads, is authorized to declare an emergency and to direct the
positioning of EMERGENCY NO PARKING signs when weather conditions,
accidents, fire, public celebrations, etc., dictate or require the
avoidance of hazards or other conditions which interfere with the
free flow of traffic. Notification that EMERGENCY NO PARKING signs
are being or will be posted shall be given to the operator or owner
of any vehicle which has been parked prior to the posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and menace to the safe and proper regulations
of traffic, and the superintendent of streets and roads, or his/her
agent, may provide for the removal of such vehicle. The owner shall
pay the reasonable costs of removal and storage which may result from
such removal before regaining possession of the vehicle.
c.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

No person shall park a vehicle at any time upon any of the streets
or parts thereof described in Schedule I attached to and made a part
of this chapter.[1]
Notwithstanding anything contained herein to the contrary, and
in the sound discretion of the governing body or the Borough Adminstrator
acting in the best interests of the Borough and where the public safety
and welfare of the Borough and its inhabitants are concerned, parking
in a restricted area or space may be permitted for special occasions.
Such parking shall be restricted to a defined area and for a limited
period of time, after approval has first been granted pursuant to
application, specifying terms and conditions, to the governing body
of the Borough of Sussex or the Borough Adminstrator. The fee for
such application shall be $10 which may be waived for federal, state,
county, municipal government or any emergency service organization(s)
thereof such as fire and/or ambulance services.

No person shall park a vehicle between the hours specified in
Schedule II of any day (except Sundays and public holidays) upon any
of the streets or parts of streets described in Schedule II attached
to and made a part of this chapter.[1]

No person shall stop or stand a vehicle between the hours specified
in Schedule III of any day (except Sundays and public holidays) upon
any of the streets or parts of streets described in Schedule III attached
to and made a part of this chapter.[1]

No person shall park a vehicle for longer than the time limit
shown in Schedule IV at any time between the hours listed in Schedule
IV of any day (except Sundays and public holidays) upon any of the
streets or parts of streets described in Schedule IV attached to and
made a part of this chapter.[1]

No person shall park a vehicle at any time in any area so indicated
by yellow curb markings.

The operator of a vehicle shall not stop, stand or park the
vehicle in a roadway other than parallel with the edge of the roadway
headed in the direction of traffic, on the right-hand side of the
road and with the curb side of the vehicle within six inches of the
edge of the roadway, except as follows:
a.
Upon those streets which have been designated by ordinance and have
been marked or signed for angle parking, vehicles shall be parked
at the angle to the curb designated and indicated by the ordinance
and marks or signs.
b.
Upon one-way streets, local authorities may permit parking of vehicles
parallel with the left-hand edge of the roadway headed in the direction
of traffic, on the left-hand side of the road and with the curb side
of the vehicle within six inches of the edge of the roadway.

Except when necessary to avoid conflict with other traffic or
in compliance with the direction of a traffic or police officer or
traffic sign or signal, no operator of a vehicle shall stand or park
the vehicle in any of the following places:
a.
Within an intersection.
b.
On a sidewalk.
c.
On a crosswalk.
d.
Within ten feet of a fire hydrant.
e.
Alongside or opposite any street excavation or obstruction when stopping,
standing or parking would obstruct traffic, when properly sign-posted.
f.
In any space on public or private property appropriately marked for
vehicles for the physically handicapped pursuant to P.L. 1977, c.
202 (C. 39:4-197.5), P.L. 1975, c. 217 (C. 52:27D-119 et seq.) or
any other applicable law unless the vehicle is authorized by law to
be parked therein and a handicapped person is either the driver or
a passenger of that vehicle. State, county or municipal law enforcement
officers or parking enforcement authority officers shall enforce the
parking restrictions on spaces appropriately marked for vehicles for
the physically handicapped on both public and private property.
No person shall move a vehicle not lawfully under his/her control
into any such prohibited area or away from a curb such distance as
is unlawful.
g.
Within 25 feet of a stop sign.

No person shall park or keep any commercial vehicle exceeding
12,000 pounds rated capacity on the street or in the open on any premises
in any residential district with the exception of school buses. This
subsection shall not apply to service vehicles making deliveries and/or
pickups of 30 minutes or less in duration.

Parking of vehicles on Borough streets during snow removal and/or
salting operations, or when there is 1/4 inch or more of accumulation
of snow or ice on the roadway, is prohibited.

Trucks over four tons gross weight are hereby excluded from
the streets or parts of streets described in Schedule V except for
the pickup and delivery of materials on such streets. Schedule V being
attached to and made a part of this chapter.[1]

The streets or parts of streets described in Schedule VI attached
to and made a part of this chapter[1] are hereby designated as one-way streets in the direction
indicated.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets
or parts of streets described in Schedule VII attached to and made
a part of this chapter[1] are hereby designated as Through Streets. STOP signs shall
be installed on the near right side of each street intersecting the
Through Street except where YIELD signs having sides 36 inches in
length are provided for in the designations.

described in Schedule VIII attached to and made a part of this chapter[1] are hereby designated as Stop Intersections. STOP signs
shall be installed as provided therein.

a.
Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable for a penalty of not less
than $48 and a maximum of $100 provided that the person has been convicted
of three or less violations of this chapter in the twelve-month period
preceding the conviction for the violation in question.

b.
Every person convicted of more than 3 violations of this chapter
within a 12-month period shall be liable for a penalty of not less
than $200 for each subsequent offense.
c.
A person violating this chapter and subject to a fine shall also
pay the surcharges set forth in N.J.S.A. 39:5-41 and any other surcharges
required by law.
d.
Notwithstanding anything to the contrary stated above in this section,
in any space on public or private property appropriately marked for
vehicles for the physically handicapped, any person parking a motor
vehicle in a restricted parking space without a special vehicle identification
card issued by the Motor Vehicle Commission pursuant to the provisions
of N.J.S.A. 39:4-204 et seq. and N.J.S.A. 39:4-197.5 shall be liable
to a fine of $100 for the first offense and, for subsequent offenses,
a fine of at least $100 and up to 90 days community service on such
terms and in such form as the court shall deem appropriate.
e.
Notwithstanding anything to the contrary stated above in this section, every person convicted of a violation of Subsection 9-3.11 of this chapter shall be liable for a penalty of $100 for a first offense; $250 for a second offense, provided that the person is convicted thereof within 12 months after conviction of a first offense of Subsection 9-3.11 of this chapter; and $500 for each subsequent offense, provided that the person has been convicted thereof within 12 months after conviction of a prior offense of Subsection 9-3.11 of this chapter.

The Mayor, the Public Works Commissioner or his designee may
close any street in the Borough to all motor vehicular traffic, or
certain types of vehicular traffic whenever he finds that such closing
is necessary for the preservation of public safety, health or welfare.
The filing of a written notice with the Borough Police Department,
to the effect that a certain street is closed, together with an actual
notice or barricade being placed in said street, shall be deemed sufficient
action and public notice to close any street.
Any person who operates a motor vehicle on a street closed to
such traffic shall be liable under the general penalty provision of
the Revised Ordinances of the Borough of Sussex.
b.
Regulatory and Warning Signs. Regulatory and warning signs, conforming
to the current standards prescribed by the Manual of Uniform Traffic
Control Devices for Streets and Highways, as adopted by the Commissioner
of Transportation of the State of New Jersey, shall be erected and
maintained to effect the above-designated speed limit(s).
