This chapter shall be known as the "Law Establishing a Landscaper Registry."
As used in this chapter, the following terms shall have the meanings indicated:
LANDSCAPER
Refers to any individual, company or companies that perform any of the following services within the Village of South Nyack on behalf of a property owner or resident of the Village of South Nyack for compensation, without limitation: private landscaping, snow removal, tree removal and trimming, drainage swale installation, dry well installation, driveway paving and installation, installation of decorative walls and pillars, stone/concrete step construction, and lawn sprinkler system installation and maintenance.
Such rules and regulations as established in this chapter are designed to inform and monitor those who provide professional landscaping services, and to ensure all such persons or companies serving the property owners or residents of the Village of South Nyack comply with any and all laws of Rockland County and any laws, policies, rules, and regulations set forth by the Board of Trustees of the Village of South Nyack governing the provision of such landscaping services.
The South Nyack Village Clerk shall maintain a registry that lists all landscapers allowed to provide service in the Village of South Nyack.
A. 
Landscapers subject to the laws as set forth in this chapter must submit, to the Village Clerk, an annual application to be listed in the Village of South Nyack Landscaper Registry and to obtain a Village of South Nyack landscaper annual permit. Applicants shall pay an annual fee established by the Board of Trustees of the Village of South Nyack for such application. Landscapers that are approved for listing in the Village Landscaper Registry must display on every vehicle used in the Village of South Nyack for professional landscaping purposes a sticker provided by the Village for the current calendar year. The annual fee shall include the distribution of one sticker if the registration application is approved; additional stickers shall be charged at an annual fee established by the Board of Trustees.
B. 
All Village of South Nyack landscaper permits shall expire following December 31 of each calendar year, and must be renewed if the applicant/permittee desires to remain on the Landscaper Registry.
C. 
Landscaping permits issued by the Village of South Nyack shall be nontransferable.
Any and all landscapers, in performing professional landscaping services to any property owner or resident of the Village of South Nyack as defined in this chapter, shall comply with any and all applicable laws, policies, rules, and regulations established by the Village of South Nyack, including, without limitation, those laws, policies, rules and regulations that specifically apply to the provision of the Landscaper Registry.
Any person under the age of 18 years providing landscaping services within the Village of South Nyack, as defined in this chapter, is exempt from the Village of South Nyack's Landscaper Registry enrollment requirement.
Any person or entity that commits, takes part in, or assists in any violation of any provision of this chapter shall, upon conviction, be subject to a Type A penalty as set forth in § 1-15 of the Village Code.
This chapter shall take effect immediately upon filing with the Secretary of State.
