The City of Nanticoke shall be reimbursed whenever its Fire
Department responds to a call for service, including, but not limited
to, vehicular accidents and fires, residential and commercial fires,
environmental responses and mutual aid responses. Reimbursement for
services shall include a reasonable reimbursement for all labor, equipment,
materials and any other expenses related to the City of Nanticoke
providing services in response to an emergency call.
Any person or entity who is rendered the services herein specified
shall provide the Nanticoke Fire Department or its authorized representatives
the following information:
A.
Name, address and telephone number;
B.
Name and address of all insurance carriers potentially covering the
emergency situation and authorization to secure insurance policy information
from said carriers; and
C.
Any other information necessary to identify a potentially responsible
party for said services.
A.
The Nanticoke Fire Department, through its Chief or designated representative
or collection agency, shall have the primary responsibility and authority
to administrate and enforce the provisions of this article.
B.
Emergency service shall not be refused for lack of insurance or ability
to pay. In particular, nothing in this article shall authorize any
Nanticoke personnel, including, but not limited to, fire personnel,
to refuse or delay any emergency service to any person, firm, organization
or corporation due to the lack of insurance coverage or ability to
pay for said emergency services.
C.
The Fire Department is hereby authorized and directed, by and through
its officers and authorized representatives, to ascertain what insurance
coverage may be applicable and available under any given circumstance
and to take all necessary and affirmative steps to apply for and receive
reimbursement from any insurance carriers where a property owner is
or may be insured to reimburse the Department for any cost and/or
expense incurred for services, supplies and/or equipment used for
or provided to the property owner by the Department.
D.
Under no circumstances shall any property owner ever receive a bill
from the Nanticoke Fire Department for fire protection or other services
provided by the Nanticoke Fire Department except in cases of false
alarms and fires intentionally set by the property owner.
The provisions of this article shall be severable; and if any
provision shall be deemed to be invalid for any reason, the validity
of any of the remaining provisions of this article shall not be affected.
It is hereby declared as the intention of the City Council that this
article would have been adopted had such invalidity not been included
herein.
All other ordinances or parts thereof inconsistent herewith
are hereby repealed, including, but not limited to, Ordinance No.
13 of 2001.
