Any establishment which sells or serves food products or perishable beverages shall be subject to an annual inspection and be required to secure an annual license from the Health Inspector. On completion of the inspection by the Health Inspector, the licensee shall be provided a copy of the inspection report and the annual license.
For newly opened establishments, the cost of the license fee and inspection will be $200. For annual reinspections, the cost of the inspection and issuance of the license will be $100 per year. For further inspections of establishments, a fee is set at $40 per hour for such required inspections.
Any person who fails to secure an inspection or a license under this article shall be subject to a fine of not less than $100 and not more than $300, and each day that the violation exists shall constitute a separate violation for the purposes of this article.
All ordinances or parts of ordinances of the City of Nanticoke in conflict with this article, to the extent of such conflict, and no further, are hereby repealed.
The provisions of this article are severable; and if any section, sentence, clause, revision, part or other portion hereof shall be held unconstitutional, illegal, invalid or otherwise ineffective, the validity of the remaining provisions shall be unaffected thereby. It is the intention of the Council of the City of Nanticoke that this article would have been adopted had such unconstitutional, illegal, invalid, or otherwise ineffective section, sentence clause, or provision, part or other portion not been included herein.
This article shall become effective within 30 days of enactment as provided for in the Home Rule Charter of the City of Nanticoke.
