Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time
as may be in current use in the Township.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in R. S. 39:41-38, any other New Jersey statute
or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY-NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of EMERGENCY-NO PARKING signs when weather conditions,
accidents, fires and public celebration dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that the EMERGENCY-NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle
which has been parked prior to the posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
c.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Sundays and public holidays) upon any of the streets, municipal parking lots, or parts of streets described in Schedule IV which can be found in Chapter 7A.

Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on the streets or highways or portions described in Schedule XIX which can be found in Chapter 7A.
a.
Handicapped parking spaces. No owner or operator of premises having
parking spaces reserved for handicapped drivers and no tenant, contractor
or other person may block access to such parking stalls reserved for
handicapped drivers by the plowing, hiring or placement of snow or
ice in such spaces.
Any owner, operator or tenant who violates this paragraph shall
be asked to remove the snow or shall be billed for the cost of snow
removal by the Township. This does not preclude any additional fines
which may be assessed pursuant to the within section.
These parking prohibitions shall remain in effect after the
snow has ceased until the streets have been plowed sufficiently and
to the extent that parking will not interfere with the normal flow
of traffic.

a.
The purpose of this subsection is to establish regulations in Municipal
Parking Lots One, Two, Three and Four.
b.
Municipal Parking Lot Number One: This lot is bordered on the west
side by Park Avenue businesses, on the south side by Bartle Avenue,
the east side by the Scotch Plains Public Library and on north side
by the properties of 361 Park Avenue and 347 Park Avenue (Old Baptist
Parsonage).
c.
Municipal Parking Lot Number Two: This lot is situated between all
the properties of Park Avenue, Bartle Avenue, Westfield Avenue, and
Forest Road.
d.
Municipal Parking Lot Number Three: This lot is located between Park
Avenue and Senger Place. It is bordered on the north side by Front
Street and on the South side by the properties of 450 Park Avenue
and 1827 East Second Street.
e.
Municipal Parking Lot Number Four: This lot is located on the north
side from East Second Street south to the property of 530 Park Avenue,
the east side from the property of 514 Park Avenue west to the property
of 1810 East Second Street.
f.
Parking shall be prohibited in all four municipal parking lots between
the hours of 2:00 a.m. and 6:00 a.m. each day of the week.
1.
People seeking relief from this restriction shall make application
for an annual parking permit which shall be issued by the Township
of Scotch Plains for a fee as established by this subsection.
2.
Applications are available in the Township Clerk's office as
well as police headquarters.
3.
The completed applications will be reviewed by the Chief of Police
or his designee and he shall have the authority to approve or deny
applications for annual parking permits.
4.
The Chief of Police will develop criteria for application approval.
5.
The Chief of Police or his designee will have the authority to grant
requests for temporary parking in all lots without an annual fee being
required.
6.
The annual fee for parking permits shall be $5 per vehicle per year.
Permits shall expire on December 31 of each calendar year. Permits
are renewable through the Police Department. The fee will be applicable
January 1.
7.
Parking decals issued by the Township shall be displayed in the lower
corner, driver's side, of the rear back window (Front windshield).
8.
There shall be nine parking spaces designated for exclusive use of
the Scotch Plains Rescue Squad located in Municipal Parking Lot Number
Two. Said parking spaces shall be appropriately signed so as to advise
the public of said prohibition against parking at any time.
9.
Employees of the municipality required to work between 2:00 a.m.
and 6:00 a.m. are exempt from restrictions in Municipal Lot Number
Three.
g.
Parking within the lines designated for parking.
1.
All passenger vehicles must park within the lines designated, not
blocking driveways or sidewalks within the municipal lots and not
take more than the one space designated for their vehicle.
2.
Oversize commercial vehicles making deliveries in the municipal parking
lots are exempt from this regulation while making deliveries.
h.
Stopping or standing shall be prohibited in the entrances and exits
of all four municipal parking lots.
i.
Penalties.
1.
Unless another penalty is expressly provided by NJ Statute, every
person convicted of a violation of a provision of this chapter, or
any supplement thereto, shall be liable for a penalty of $50 for each
separate violation.
2.
Persons who are in violation of Subsection 7-3.8 may also have their vehicles towed from the municipal lots and placed in storage at the owner's expense. This shall be provided for after the owner is contacted by the Police Department and given three working days to remove his vehicle and fails to do so.
j.
Police parking only. In accordance with the provision of Subsection 7-3.8, no vehicles except "police" shall park in the following locations:
1.
All the parking stalls in the most westerly parking lot area at the
Municipal Building and all the parking stalls in the most northerly
parking lot area at the Municipal Building excluding the first four
parking stalls nearest the Hamilton House located at the corner of
Senger Place and Front Street (to be reserved solely for the use of
the Resolve Counseling Center) and also excluding the two parking
stalls in the most northerly location of this lot (to be reserved
for police visitor/Historical Society use).
k.
Fifteen-minute parking only location. Including the first two parking
stalls to the westerly side of the concrete parking island nearest
the Municipal Building's southerly side entrance.
l.
Parking spot in Municipal Lot Number Three monitored by a surveillance
camera and is designated to the safe exchange of internet sales.

No person other than the specified emergency personnel shall
park a vehicle in the following locations:
a.
Only active fire department personnel shall park in the spaces provided
in the front of the Southside Firehouse, located on the southeast
corner of Martine Avenue and Raritan Road.
b.
Only active fire department personnel shall park in the spaces located
to the rear of the Southside Firehouse immediately adjacent to the
rear of the building, from the southeast corner of the building to
the rear overhead emergency doors, extending 50 feet south of the
building.
c.
No person shall park a vehicle on the grass areas surrounding the
Southside Firehouse without specific authorization from the Fire Chief
or his designee, nor in any area immediately in front of and extending
a distance of 75 feet out from the front and rear emergency overhead
doors of the Southside Firehouse.

a.
The only parking permitted on those places listed in Schedule XXIV which can be found in Chapter 7A shall be those persons displaying a valid and properly issued parking permit.
b.
The Mayor and council designates the Township manager as the individual
who will set forth the parameters of the requirements for those persons
who constitute and qualify as a resident, with the sole understanding
that a resident must be a bonafide full-time resident and have proof
thereof including but limited to a tax bill, driver's license or other
documents in the discretion of the Township manager or his designee
and that the number and nature of said permit shall be left to the
discretion of the Township manager or his designee; and
c.
This section shall be enforced by the Township police department
and shall constitute the violation of this particular section and
shall be in conformance with violations of N.J.S.A. 39:4-138.

covered in this traffic chapter are hereby repealed except that this
repeal shall not affect or prevent the prosecution or punishment of
any person for any act done or committed in violation of any ordinance
hereby repealed prior to the taking effect of this ordinance.

reason held to be invalid, such decision shall not affect the validity
of the remaining portion of the regulation.

the above designated speed limits authorized by the Department of
Transportation.
e.
Tow away. Any vehicle parked or standing as to obstruct or impede
a normal flow of traffic, block entrances or exit ways, loading zones,
oil fills, any grassy area, pedestrian walkway, or present in any
way a safety or traffic hazard may be removed by towing the vehicle
at the owners or operators expense.
f.
All signs, posts or other necessary materials shall be installed
and paid for by the applicant. All signing shall conform to the current
Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198
and N.J.S.A. 39:4-183.27. Unless another penalty is expressly provided
by New Jersey Statute, every person convicted of a violation of this
section or any supplement thereto shall be liable to a penalty of
not more than $100 or imprisonment for a term not exceeding 15 days
or both.
g.
Effect of regulations. If any part of this regulation is for any
reason held to be invalid, such decision shall not affect the validity
of the remaining portion of the regulation.

The locations herein described are designated as mid-block crosswalks
which shall be marked as such in accordance with the Manual of Uniform
Traffic Control Devices. Each such crosswalk shall extend from road

Terms used in this section shall have the meanings ascribed
to them in Title 39 of the New Jersey Statutes Annotated.
In accordance with the provisions of N.J.S.A. 40:48-2.46 relating to parking facilities open to the public or to which the public is invited, those parking spaces enumerated in Schedule XXV which can be found in Chapter 7A are hereby set aside and reserved for the vehicles of handicapped persons.
In accordance with the provisions of N.J.S.A. 39:5A-1, an owner
of private property may request that certain parking spaces be set
aside and reserved for the vehicles of handicapped persons, and in
the event that such a request is approved by an amendment or supplement
to this section and by the New Jersey Commissioner of Transportation,
then the provisions of this section, including the penalties for violations,
shall apply to such parking spaces.
In accordance with the provision of N.J.S.A. 39:4-197.5, any
municipality may, by ordinance, resolution or regulation, establish
restricted parking spaces in front of residences, schools, hospitals
and other public buildings for use by persons who have been issued
a special vehicle identification card.
In accordance with the provisions of N.J.S.A. 39:4-197.6 any municipality may, by ordinance, establish a restricted parking zone in front of a residence occupied by a handicapped person, provided such parking is not otherwise prohibited and the permitting thereof would not interfere with the normal flow of traffic. Those parking spaces enumerated in Schedule XXV which can be found in Chapter 7A are hereby set aside and reserved for the vehicles of handicapped persons.
Each parking space set aside and reserved for the vehicles of
handicapped persons pursuant to this section shall be marked with
the required New Jersey designation sign (MUTCD R7-8) and the required
penalty sign.
The owners of private properties to which the public is invited
shall be responsible for erecting and maintaining the required signs
and shall be subject to the penalty provisions herein for failure
to comply.
No person shall park a motor vehicle in any parking space which
is duly designated and marked in accordance with the provisions of
this section as being set aside and reserved for the vehicles of handicapped
persons unless:
a.
The vehicle shall have affixed thereto special license plates bearing
the national wheelchair symbol, or the vehicle shall display a handicapped
placard issued by the New Jersey Motor Vehicle Commissioner or from
any other state, province or country or a currently valid temporary
handicapped placard issued by a municipal Chief of Police; and,
b.
A handicapped person is either the driver or a passenger in the vehicle.
Any person parking a motor vehicle in a parking space set aside
and reserved for the vehicles of this section shall be liable to a
fine and penalties as set forth in N.J.S.A. 39:4-197.

a.
This section shall restrict the use of all off-street parking facilities
on properties maintained by the Township's recreation department for
those attending or participating in activities at those facilities
except for those exemptions authorized by the Township manager or
his designee.
b.
This section shall restrict the use of all parking spaces created
adjacent to the Township's recreational facilities which may fall
within the right-of-way of a public road within the Township for those
attending or participating in activities at those facilities except
for those exemptions authorized by the Township manager or his designee
and this shall prohibit any and all commercial vehicles of any type
not directly parked for use of said department of recreation programs
at any time of the day (24 hours) and on all days of the week.

Various traffic regulations shall be made applicable to the
driveways and parking lots at the Newmark School located in the Township
of Scotch Plains, County of Union as depicted on the site plan entitled,
"Newmark School, Inc. Block 13701, Lot 2, Tax Map Sheet #37, 1000
Cellar Avenue, Township of Scotch Plains, Union County, New Jersey"
prepared by Insite Engineering dated April 5, 2011, last revised June
24, 2011 and the following shall be enforceable:
The site plan shall be on file in the office of the Township
Clerk.
a.
General parking.
1.
All vehicles must park in designated areas and between the lines
provided as depicted on the site plan.
2.
Handicapped parking. All stalls shall be eight feet wide as shown
on the attached site plan and signed with R7-8 and R7-8a (Reserved
Parking Sign and Penalty Plate), in the designated parking areas for
persons who have been issued the handicapped parking permits by the
Motor Vehicle Commission.
c.
Tow away. Any vehicle parked or standing as to obstruct or impede
a normal flow of traffic, block entrances, exit ways or student drop
off areas, loading zones, any grassy area, pedestrian walkway, or
present in any way a safety or traffic hazard may be removed by towing
the vehicle at the owner's or operator's expense.
d.
Loading zone(s). The locations described on the site plan are hereby
designated as loading zones. No person shall park a vehicle in said
location other than for loading and unloading of goods and materials.
e.
All signs, posts or other necessary materials shall be installed

Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198

The following terms, when used in this section, shall have the
meanings ascribed to them herein, except where context clearly indicates
a different meaning:
Shall mean a paved road having residences on both sides that
lies entirely within the Township limits. A local residential street
must intersect one other street; therefore, portions of longer streets
may be considered as eligible for speed humps.
Shall mean the construction of an asphaltic geometric design
installed on streets to address speeding problems on streets that
are classified as local residential streets.

In response to an increasing number of complaints regarding
speeding problems on residential streets, the Township has studied
available alternatives and methods employed by other communities and
how effectively those communities have addressed residential speeding
problems. The installation of speed humps was found to be a popular
and relatively cost-effective measure in reducing average speeds.
When properly designed and installed, and with strong majority community
backing and support, speed humps were found to be effective at reducing
speeds in neighborhoods. They are therefore found to be of public
interest and benefit and are hereby authorized in the Township.

The Township will consider the installation of speed humps only on streets classified as local residential streets, unless otherwise initiated by the Township as provided in subsection 7-24.2.
