§ 23A-1 Declaration.

It is hereby declared to be the policy of the Township of East Windsor to require recycling of leaves as nutritive material through composting in accordance with the requirements of N.J.S.A. 13:1E-99.21 and N.J.S.A. 13:1E-99.22 and, at the same time, to provide for the most efficient method of collecting those leaves and disposing of same within the Garbage District No. 1 which are not so utilized.

§ 23A-1A Definitions.

For the purpose of this chapter, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this chapter clearly demonstrates a different meaning.

a. CARTWAY — Shall mean the actual road surface area from curbline to curbline that may include travel lanes, parking lanes, and deceleration and acceleration lanes. Where there are no curbs, the cartway is that portion between the edges of the paved or hard surface width.

b. CONTAINERIZED — Shall mean the placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.

c. PERSON — Shall mean any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.

d. STREET — Shall mean any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing State, county or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.

e. YARD WASTE — Shall mean loose leaves and grass clippings.

§ 23A-2 Prohibition.

a. The owner or occupant of any property, or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services, shall not sweep, rake, blow or otherwise place yard waste, unless the yard waste is containerized, in the cartway of the street. If yard waste that is not containerized is placed in the cartway of the street, the party responsible for placement of yard waste must remove the yard waste from the street or said party shall be deemed in violation of this section. Exceptions to this prohibition occur in the fall between mid-October and the end of December and in the spring for a limited one-week period. The exact dates for the exception shall be scheduled and announced by the township department of public works.

b. No person occupying or owning a residential premises within the municipal boundaries or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services, for the period from mid-October through December 31 of each year in accordance with the dates scheduled and announced by the township department of public works, shall fail to source separate yard waste from solid waste generated by those premises for disposal, unless such yard waste is stored or recycled for composting or mulching by the generator.

§ 23A-3 Yard Waste Collection.

a. All yard waste collected on a residential premises and not used for composting shall be placed on the cartway of the street for collection in such a manner as shall be established in accordance with this section and the guidelines provided by the township department of public works.

b. Sweeping, raking, blowing or otherwise placing yard waste that is not containerized at the curb or along the cartway of the street is only allowed during the seven days prior to a scheduled and announced collection, and shall not be placed closer than ten feet from any storm drain inlet. Placement of such yard waste at the curb or along the street at any other time or in any other manner is a violation of this section. If such placement of yard waste occurs, the party responsible for placement of the yard waste must remove the yard waste from the cartway of the street or said party shall be deemed in violation of this section.

§ 23A-4 Violations and Penalty.

Any person found violating section 23A-2 or 23A-3 of this chapter shall be subject to a fine of not more than $25 for the first violation, and then $100 for any subsequent violations.

This chapter shall be enforced by the township police department.
