Shall mean any person who harbors or possesses any dog for
a period of 15 days or more. This does not apply to dogs lost or stolen.

The owner of every dog shall pay the annual license fee to the
Department of Health on or before March 31. The Department of Health,
upon payment of the license fee, shall issue a license for each dog,
which license shall contain the name and address of the owner of each
dog, a short description of the dog, indicating breed, sex, marking,
the number of such license and date of issuance, and shall bear the
signature of the Township Director of the Health Department. The Township
Health Department shall also issue together with the license a numbered
metal tag which shall be securely fixed or fastened to a strap or
collar to be worn around the neck of the dog so licensed, in a manner
in which it can be plainly seen and which tag shall have stamped thereon
the words "Licensed Dog," Belleville, N.J., with the year for which
issued. Duplicate tags will be issued only on proof in writing by
the owner or a member of his household, above the age of 14 years
satisfactory to the Township tax collector of the loss of the original
tag, and on payment of the sum of $1.

No person except an officer in the performance of his duties,
shall remove a registration tag from the collar of any dog without
the consent of the owner, or attach a registration tag to a dog for
which it was not issued.

This chapter shall comply with the provisions of Chapter 151
Laws of 1941 of the State of New Jersey. All parts and provisions
of the Chapter 151 Laws of 1941 of the State of New Jersey which are
not covered by this chapter are hereby adopted to the same extent
as if written in full. It is the intention to have this chapter molded
to conform in every respect with Chapter 151 Laws of 1941 of the State
of New Jersey, except where there are local provisions heretofore
adopted, which are not inconsistent with and which are not embraced
in the statute above referred to.

sent or brought to a pound or shelter shall be sold or otherwise made
available for the purpose of experimentation.

nor upon privately owned property of any person in the Township.

The purpose of this section is to establish requirements for
the proper disposal of pet solid waste in the Township of Belleville,
so as to protect public health, safety and welfare, and to prescribe
penalties for failure to comply.

For the purpose of this section, the following terms, phrases,
words and their derivations shall have the meanings stated herein
unless their use in the text of this chapter clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
Shall mean that the pet solid waste is removed at once, without
delay.
Shall mean any person who shall possess, maintain, house
or harbor any pet or otherwise have custody of any pet, whether or
not the owner of such pet.
Shall mean any individual, corporation, company, partnership,
firm, association, or political subdivision of this State subject
to municipal jurisdiction.
Shall mean a domesticated animal (other than a disability
assistance animal) kept for amusement or companionship.
Shall mean waste matter expelled from the bowels of the pet;
excrement.
Shall mean placement in a designated waste receptacle, or
other suitable container, and discarded in a refuse container which
is regularly emptied by the municipality or some other refuse collector;
or disposal into a system designed to convey domestic sewage for proper
treatment and disposal.

a.
No owner shall permit, suffer or allow any dog to discharge its excreta
upon any public or private property, grass areas, lawns, stones, and
the like, including the property of the owner, except as follows:
Any dog must be leashed and curbed, and the owner must immediately
clean up such dog excreta in a proper fashion and make proper disposal
of the same. "Proper clean up and disposal" shall require that the
owner immediately remove all feces and droppings deposited by the
dog. Removal shall be in a sanitary manner by shovel, container, disposal
bag or some other similar device. Said feces and droppings shall be
removed by said owner and disposed of in a sanitary manner from the
place of deposit to a place owned and exclusively used or occupied
by the owner of the dog. Disposal shall be in a manner so as to prevent
any noxious odors, attraction of vermin or any other public health
nuisance. In no event shall disposal be effected by deposit into the
sewer system of the Township of Belleville.
b.
No person owning or in control of a dog shall permit it to damage
any lawn, shrubbery, flowers, grounds or other property.

Any owner or keeper who requires the use of a disability assistance
animal shall be exempt from the provisions of this section while such
animal is being used for that purpose.

The provisions of this section shall be enforced by the Police
Department and Health Department of the Township of Belleville.

Any person(s) who is found to be in violation of the provisions
of this section shall be subject to a fine of $150 for the first offense
and up to $175 for each offense thereafter.

Any dog not licensed pursuant hereto shall be subject to seizure
by any person appointed for that purpose by the Council, and if not
redeemed within seven days after being seized it may be destroyed
as humanely as possible. Any dog that does not have a license or registration
tag attached to it shall be deemed unlicensed and subject to seizure.

Any owner of a dog which has been seized hereunder shall upon
establishing ownership thereof to the satisfaction of the Township
Clerk, be entitled to reclaim such dog. The redemption fee of $2 shall
be paid to the Department of Revenue and Finance and certification
by an official of the Department of Revenue and Finance shall be required
for the release of any impounded dog. During the hours when the Department
of Revenue and Finance is closed the officer in charge of the police
division of the Department of Public Safety is authorized to accept
redemption fees and grant certification of payment of same.

The council shall by resolution appoint at such times and for
such term as may be necessary, one or more dog catchers and pound
keepers whose duty it shall be to seize and impound all dogs found
being kept or harbored or running at large liable to seizure hereunder
and to put to death at the time and in the manner directed by the
Township Clerk and to be removed from the Township or buried all such
dogs not redeemed in accordance with the provisions hereof.

No person shall hinder, interfere with or molest the persons
appointed as dog catchers, or any officer of the Township in the performance
of his duty.

All animals which are quarantined by the official dog catcher
of the Township shall be held under observation at a fee of $0.50
per day. This fee is to be chargeable to the owner of the quarantined
animal.

Any person who violates or who fails or refuses to comply with
this chapter, shall be liable to a penalty of $50 for each and every
offense except that for the first offense or failure to secure a license
as required within the time period specified in this chapter, the
penalty shall be $5. Failure to comply with this chapter may result
in a summons and subsequent court cost of $75.

No person shall keep on his property or in his possession more
than five adult dogs. An adult dog shall be defined as an animal four
months in age or older.

a.
No owner or persons having control or possession of any dog shall
permit the dog to be walked upon any streets, public places, nor upon
privately-owned property of any person in the Township without having
securely fixed or fastened to a strap or collar to be worn around
the neck of the dog a numbered metal tag in a manner in which it can
be plainly seen and which tag shall have stamped thereon the words
"Licensed Dog," Belleville, N.J. with the year for which issued.
b.
Any person who violates or fails or refuses to comply with this chapter
shall be liable to a penalty of $100.

No person shall own, keep, harbor or maintain a dog which habitually
barks or cries.

No person owning a dog shall permit it to be upon the public
streets or in any other public place in the Township unless the dog
is accompanied by a person capable of controlling the dog and it is
securely fastened to an adequate leash not more than six feet long.

The owner, caretaker, guardian or handler of any dog will exercise
diligence and reasonable care in using restraint to prevent any dog
from leaving their premises regardless of whether their premises is
owned, leased or rented. Restraint exists when the dog is:
a.
Enclosed and properly provided for pursuant to N.J.S.A. 4:22-17 within
a house, building, properly maintained fence, pen or other enclosure.
b.
The pen or other enclosure for each dog must be four feet in height
and square footage as follows:

Veterinary facilities and licensed animal shelters shall be
exempt from this section.

c.
The pen or other enclosure shall include a soundly constructed, safely
positioned and a properly maintained doghouse.
d.
The doghouse shall contain bedding, such as straw and other absorbent
material in a sufficient quantity to provide adequate insulation for
the house. Bedding shall be maintained in a dry condition and renewed
or changed as necessary.

The owner, caretaker, guardian or handler of any dog will exercise
diligence and reasonable care and protection in using restraint whenever
the temperature shall fall below 32° F. regardless of whether
the premises is owned, leased or rented. Whenever the temperature
shall fall below 32° F., restraint exists when the dog is:
a.
Enclosed and properly provided for pursuant to N.J.S.A. 4:22-17 within
a house, building, or other enclosure.
b.
A building or other enclosure shall include a soundly constructed,
safely positioned and properly maintained-doghouse.
c.
The doghouse shall contain bedding, such as straw and other absorbent
material in a sufficient quantity to provide adequate insulation for
the house. Bedding shall be maintained in a dry condition and renewed
or changed as necessary.

a.
Any dog must be able to move freely when chained or tethered and
shall be confined for a total of no more than eight hours within a
twenty-four-hour period, with a maximum of four hours at any one interval
and a minimum one hour period between confinements. The size of the
tether or chain must be a minimum of 15 linear feet and shall remain
tangle free. Any dog must be equipped with a properly fitted harness
or buckle-type collar. The tether or chain shall be constructed of
lightweight cable. A doghouse shall be accessible to any dog that
is chained or tethered.
b.
No dog may be tethered or chained after dark (prior to sunrise or
after sunset).
c.
Any dog that is not spayed or neutered will not be allowed to be
tethered or chained for any period of time and must be in a completely
enclosed yard or housed indoors.

a.
No owner, caretaker, guardian or handler shall withhold proper shelter,
protection from weather, veterinary care and immune care to any animal.
No owner, caretaker, guardian or handler shall fail to provide his
or her animal with sufficient food or drinkable water on a daily basis.
Food and water must be in an animal-food-consumption or water consumption
type feeder or water container.
b.
No animal shall be subjected to unnecessary suffering and cruelty
such as subjecting the animal to prolonged fear, injury, pain or physical
abuse. Interaction with humans and other animals shall not be unreasonably
withheld.
c.
No animal shall be left unattended in a motor vehicle without sufficient
airflow or under extreme heat conditions as to render the animal susceptible
to heat prostration, any other condition that would be caused by said
behavior, including death. No animal shall be left unattended for
more than 30 minutes.
d.
An owner, caretaker, guardian or handler of any dog will exercise
diligence and reasonable care to keep the dog under restraint. In
circumstances in which any dog is not on premises owned, leased, or
rented by the caretaker, guardian or handler, the dog must be handled
in a humane manner pursuant to N.J.S.A. 5A-4:22-17.
e.
An owner, caretaker, guardian or handler of any dog may attempt to
prevent said dog from leaving the premises by installing an invisible
fence. The owner, caretaker, guardian or handler of any dog is responsible
for the maintenance of the invisible fence and shall exercise diligence
to keep the fence in proper working order.
f.
Any violation of this section, in addition to other methods of enforcement
provided by law, may be enforced by the issuance of a Notice of Violation
by members of the Township of Belleville Police Department, the Township
of Belleville Code Enforcement Officer(s), and/or the Township of
Belleville Health Department.

a.
Any operator of a motor vehicle who accidentally strikes a dog or
cat shall stop and render such assistance to the dog or cat as may
be possible, provided it could be accomplished safely and without
danger to the motorist, pedestrians or other motorists.
b.
The operator of a motor vehicle involved in such an accident shall
promptly report such injury or death to the appropriate law enforcement
agency.

The Chief of Police and members of the Township of Belleville
Police Department shall be hereinafter referred to as "enforcement
officer."
