The following words and phrases, which are not defined in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey, shall have the meanings respectively ascribed to them in this section for the purposes of this article.
ELECTRIC VEHICLE
A battery-powered electric vehicle operated solely by electricity or a plug-in hybrid electric vehicle that operates on electricity and gasoline and has a battery that can be recharged from an external source.

ELECTRIC VEHICLE STATION
Any facility or equipment that is used to charge a battery or other energy storage device of an electric vehicle.

ELECTRIC VEHICLE STATION PARKING SPACES
Spaces that are equipped with an electric vehicle station.

PARKING METER-PAY STATION (METERING DEVICE)
Any mechanical or electro-mechanical or digital device or meter, not inconsistent with this article, placed or erected for the regulation of parking by authority of this article. Each "metering device" installed shall indicate by proper legend the legal parking time established by the Borough and, when operated, shall at all times indicate the balance of legal parking time and, at the expiration of such period, shall indicate illegal or overtime parking.
PARKING METERED SPACE
Any space within a parking metered zone, adjacent to a parking metering device, and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street or lot adjacent to or adjoining the metering device.
PARKING METERED ZONE
Any restricted street or off-street parking lot upon which parking metering devices are installed and in operation.
The Chief of Police or designee is hereby directed and authorized to provide for the marking off of individual parking spaces in the parking zones designated and described in § 166-65 of this article, said parking spaces to be designated by lines painted or marked on the curbing or surface of the street or lot. At each space so marked off, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so designated.
In said parking metered zones the Chief of Police or designee shall cause parking metering devices to be installed upon the curb, sidewalk or area immediately adjacent to the parking spaces provided in § 166-65 of this article. No parking metering devices shall be installed in areas where parking is prohibited pursuant to the provisions of N.J.S.A. 39:4-138. The Chief of Police shall be responsible for the regulation, control, operation, maintenance and use of such parking meters. Each device shall be so set as to display the legal parking time upon the deposit of the appropriate coin, lawful money of the United States of America, for the period of time prescribed by said section. Each device shall be so arranged that, upon the expiration of the lawful time limit, it will indicate by a proper, visible signal that the lawful parking period has expired, and in such case the right of such vehicle to occupy such space shall cease, and the operator, owner, possessor or manager thereof shall be subject to the penalties hereinafter provided.

A. 
Charging fees: The rate for charging an electric vehicle shall be $0.50/hr. for the first four hours. After the first four hours the fee shall be $5 per hour.
B. 
Parking fee: The fee to park while charging an electric vehicle shall be the same as all other parking spaces in the same lot. A person while charging and electric vehicle is not exempt from paying the parking fee.
C. 
Prohibited parking: It shall be unlawful to park in an electric vehicle station parking space if not actively charging. It is unlawful to use the space by any person that is not operating an electric vehicle.
D. 
It shall not be a defense to a charge under this section that the sign or notice posted at the electric vehicle charging station or the designated parking space does not comply with applicable rules, regulations, or local ordinances, if a reasonable person would be made aware by the sign or notice on or near the parking space that the space is reserved for electric vehicles.
E. 
Penalty: Any person found guilty of violating the provisions of Subsection C shall be fined not less than $250.

A. 
The following named areas, streets or portions of streets, and such other areas, streets or portions of streets as may hereafter be included in this section by amendment thereto, lying within the corporate limits of the Borough, shall constitute parking metered zones, except in those areas that are otherwise prohibited by N.J.S.A. 39:4-138 or other local ordinance. It shall be unlawful, between the hours of 9:00 a.m. and 7:00 p.m. Monday through Saturday, to park or stand a vehicle in excess of the time indicated in the areas described below:

B. 
Hours of enforcement for on-street and Lots 1, 2, 4, and 6 are Monday through Saturday 9:00 a.m. - 7:00 p.m.
C. 
In Lot 7, hours of enforcement are Monday through Friday, 9:00 a.m. - 7:00 p.m. Parking is free in Lot 7 on Saturday.
D. 
Parking is free on street and in Lots 1, 2, 4, 6 and 7 on Sundays.
E. 
Holiday parking. Every Saturday between Thanksgiving Day and New Year's Day shall be free in Lots 1, 2, 4, 6 and 7.
F. 
Friday night parking between Memorial Day and Labor Day on East and West Main Street. Hours of enforcement shall be from 9:00 a.m. to 5:00 p.m.
Except in a period of emergency determined by an officer of the Fire or Police Department, or in compliance with the directions of a police officer or traffic control sign or signal, when any vehicle shall be parked in any parking space alongside or next to which a parking metering device is located, the operator of such vehicle shall, upon entering the said parking metered space, immediately deposit or cause to be deposited in said metering device such proper coin or accepted currency of the United States of America as is required for such parking meter and as is designated by proper directions on the metering device; and when required by the directions on the metering device, the operator of such vehicle, after the deposit of the proper coin or accepted currency, shall also set in operation the timing mechanism on such metering device in accordance with directions properly appearing thereon; and failure to deposit such proper coin or accepted currency and to set the timing mechanism in operation when so required shall constitute a violation of this article. Upon the deposit of such coin or accepted currency (and the setting of the timing mechanism in operation when so required), the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for the part of the street in which said parking space is located, provided that any person placing a vehicle in a parking meter space adjacent to a metering device which indicates that unused time has been left in the meter by the previous occupant of the space shall not be required to make a deposit of currency so long as his occupancy of said space does not exceed the indicated unused parking time. If said vehicle shall remain parked in any such parking space beyond the parking time limit set for such parking space and if the meter shall indicate such illegal parking, then and in that event such vehicle shall be considered as parking overtime and beyond the period of legal parking time, and such parking shall be deemed a violation of this article.
When a parking meter space is diagonal to the curb or sidewalk, no person shall park or permit the parking of any vehicle in such parking space in any other position than with the foremost part of such vehicle nearest to the parking metering device. No person shall park or permit the parking of any vehicle in such parking space in any other position than with the foremost part of such vehicle nearest to the curb; provided, however, that in the municipal off-street parking lots, signs shall be erected indicating that head-on parking only is permitted. In any event, a vehicle shall be parked within the lines marked on the pavement measuring such parking space.
It shall be unlawful and a violation of the provisions of this article for any person to:
A. 
Cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking metered zone as herein described, or to deposit in any parking meter any coin or accepted currency for the purpose of parking beyond the maximum legal parking time for the particular parking meter zone.
B. 
Permit any vehicle to remain or be placed in any parking space adjacent to any parking metered space while said metering device is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space.
C. 
Park any vehicle across any line or marking of a parking metered space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings.
D. 
Deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking metering device installed under the provisions of this article.
E. 
Deposit or cause to be deposited in any parking meter any slug, device or metal substance or other substitute for lawful coins or accepted currency.
F. 
Park or permit the parking of any vehicle in any parking metered space where the meter does not register lawful parking.
A. 
Any violation of § 166-68A, B, or C shall be punishable by a fine of $40 per violation.
B. 
Any violation of § 166-68D or E shall be punishable by a fine of not less than $100 nor more than $500 as determined by the court.
C. 
Fines shall be established by ordinance. Each year fines shall be evaluated. If the State of New Jersey adds certain charges or costs onto summons violations, said summons violations shall be increased by the same amount automatically.
A. 
It shall be the duty of the police officers, or parking enforcement officer acting in accordance with instructions issued by the Chief of Police, to report:
(1) 
The number of each parking metering device or metered space which indicates that the vehicle occupying the parking space adjacent to such parking metering device is or has been parked in violation of any of the provisions of this article.
(2) 
The state license number of such vehicle.
(3) 
That such vehicle is parked in violation of any of the provisions of this article.
(4) 
Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation.
B. 
Each such police officer or parking enforcement officer shall also attach to such vehicle a notice to the owner thereof that such vehicle has been parked in violation of a provision of this article and instructing such owner to report to the Municipal Court in regard to such violation.
Any vehicle left parked for a period exceeding the maximum parking time indicated during the hours of operation specified in the space in which the vehicle is parked shall be towed, under the direction of the Police Department, to a garage or other place designated by the Chief of Police for impoundment, subject to redemption by the owner upon payment of the reasonable cost of towing and a storage for each day or portion thereof during which it remains in said garage or other place.
The coins or accepted currency required to be deposited in parking meters as provided herein are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets and also the cost of supervising and regulating the parking of vehicles in the parking metered zones created hereby and to cover the cost of the purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of the parking metering devices described herein.
It shall be the duty of the Chief of Police to designate some proper person or persons to make regular collections of the moneys deposited in said meters, and it shall be the duty of such person or persons so designated to remove from the parking meters the coins so deposited in said meters and to deliver said coins or accepted currency to the Treasurer, who shall count the funds contained in such containers and deposit such funds in the usual manner provided by law.
Parking or standing a vehicle in a parking metered space in the parking meter zones described in § 166-65 shall be lawful only when not in excess of the maximum parking time indicated during the hours of operation specified and only upon the deposit of such amount as is prescribed by the following section. Parking for the periods of time indicated in said section shall be permitted only in those areas within the zones where parking is not prohibited or restricted to a shorter period of time by any other duly adopted provision of this chapter regulating the parking of vehicles.
No person shall park at any time upon any area in any metered off-street parking area except within a parking stall controlled by a metering device.

The charges for the use of parking metering devices in all zones in the Borough shall be as follows:
A. 
In parking meter zones with a time limit of 12 minutes or 36 minutes, the charge shall be $0.01 in the form of one penny for each 12 minutes.
B. 
In parking meter zones with a time limit of two hours or three hours, the charge shall be dictated by the rates of said meter.
(1) 
In Parking Lot Nos. 1, 2, 4, 6, 7 in parking meter zones with no time limit, the charge shall be $0.50 for each unit, one hour.
(2) 
In all on-street parking metered zones with a time limit of three hours, a cost of $1 per hour. Division Street between South Street and Veterans Memorial on the west side shall be $0.01 for 12 minutes.
Lot 1A located on 49 West High Street Block 118, Lot 8. Business permit and residential permits shall be made available to the users of Lot 1A as defined above at the following rates: $700 annually; $390 semi-annually and $200 quarterly to users of the lot. Said list shall be maintained by the Clerk's office. The permit will be valid Monday through Sunday. However, occupants shall not store vehicles at said location and shall be able to move on a semi-monthly basis for cleaning and maintenance as required.

A. 
Lot 1A and Lot 7 short-term residential parking permit.
(1) 
Three hours between the hours of 9:00 a.m. and 8:00 p.m. Upon proof of residency, residents may purchase a short-term resident parking permit for a fee of $10 annually per vehicle, annually renewable on June 1.
(2) 
Residents will be required to park in an area designated for short-term parking and will be limited to three hours. The identification provided by the Borough shall be displayed as required on the application.
B. 
Lot 1A merchant/employee daytime parking permit.
(1) 
A merchant/employee (upon proof of employment) may purchase a permit for a fee of $50 per month per merchant/employee.
(2) 
Permit holders will be required to park in an area designated for daytime parking and will be limited between the hours of 9:00 a.m. and 8:00 p.m. The identification provided by the Borough shall be displayed as required on the application.
C. 
Lot 1A full-service resident permit. Resident permit No. 1, also known as full-service resident permit, shall be made available to primary residents of the Borough of Somerville in Lot 1A for parking availability Monday through Sunday, 24 hours a day, seven days a week. The full-service permit (residential permit No. 1) shall be sold at the following rates: Annually, $960; Semi-Annually, $500; Quarterly, $275. However, occupants shall not store vehicles at said location and shall be able to move on a semi-monthly basis for cleaning and maintenance as required. Residents will be required to park in an area designated for full-service resident permit.
D. 
Lot 7 monthly resident and merchant/employee parking permit.
(1) 
A resident upon proof of residency may purchase a Lot 7 resident daytime permit for a fee of $30 per month per resident per vehicle.
(2) 
An employee upon proof of employment may purchase a merchant/employee daytime permit for a fee of $30 per month per vehicle.
(3) 
Residents and employees will be required to park in an area designated for permit during the hours of 9:00 a.m. to 8:00 p.m.
E. 
Lot 7 county permit.
(1) 
The county shall pay a monthly fee equal to $30 per space. The exclusive spaces will be designated to be used by the county between the hours of 8:00 a.m. to 6:00 p.m., Monday through Friday.
(2) 
The holder of this permit will be required to park in an area designated for the county. The identification provided by the Borough shall be displayed as required on the application.
F. 
Replacement tags. Replacement tags or decals shall be at a cost of $15.
G. 
Penalty; fine. Any person who shall violate or fail to comply with any of the provisions of this section as set forth therein shall be deemed guilty of an offense and shall be punished by a fine of $30.
