City of South Amboy, NJ Chapter 45 Construction and Building

Article I Construction Hours

§ 45-1 Construction prohibited.

No person, firm or entity shall engage in construction activities in the City of South Amboy between the hours of 7:00 p.m. and 7:00 a.m., Monday through Saturday, and at no time between 7:00 p.m. on Saturday to 7:00 a.m. on Monday.

§ 45-2 Definitions.

As used in this section:

CONSTRUCTION ACTIVITIES

Shall include excavation, earth moving, demolition, construction, repair and/or alteration.

§ 45-3 Enforcement.

Any person, firm or entity who shall engage in construction activities during those times prohibited in Section 45-1 shall be in violation of this Article and shall be subject to the issuance of a summons to be issued by the Construction Code Official and/or the Police Department returnable in the Municipal Court of the City of South Amboy.

§ 45-4 Exclusions.

This Article shall not apply to owner-occupied premises with less than two rental units.

§ 45-5 Violations and penalties.

Any person violating any provision of this Article shall be subject to payment of a fine not to exceed $500 and for, a second and repeated offense, a minimum fine of $500 and a maximum fine of $1,500 for each separate offense.
