Garbage and trash must be placed at the curb not earlier than 6:00 p.m. of the day preceding the time scheduled for the collection of trash, except that on Broadway, garbage and trash shall not be place at the curb before 6:00 a.m. of the day on which the collection is scheduled.

Empty receptacles, cans, containers or barrels must be removed from the curb line or any part of the street or sidewalk or any part or portion of the front yard or side yards of the premises before 8:00 p.m. of the day of collection.
Garbage and trash must be placed in suitable metal or plastic receptacles, cans or barrels, with covers for all of same, for receiving and holding the aforesaid materials. Plastic trash and garbage bags with a proper and adequate seal shall be considered plastic receptacles.

All receptacles and containers shall be of such size and weight as can be easily handled by one person and in no case shall exceed 60 pounds in weight. All receptacles and containers shall be kept covered and in an upright position. Plastic trash and garbage bags shall be kept closed and sealed.

Public litter containers are placed in various parts of the city to prevent litter. Use of these containers as a private trash or garbage container shall be prohibited.

A. 
Any person, corporation, occupant or entity who or which violates or fails to comply with any provision of this Article of any of the rules or regulations promulgated hereunder shall, upon conviction be subject to the following penalties:
(1) 
For a first offense, $75.00 for each violation;
(2) 
For a second offense, $150.00 for each violation;
(3) 
For a third and subsequent offense, not less than $200.00 nor more than $500.00 for each violation, with court appearance required.
B. 
Each day a particular violation continues shall constitute a separate offense.
