The purpose of this Article is to establish solid waste charges in the City of South Amboy for the collection and disposal of solid waste. This Article shall also provide for the payment and collection of these charges.

The quarterly solid waste charges shall be as follows:

All bills must be paid within 30 days of the date of mailing. Any bills not paid within said time frame shall be subject to a late charge of one and one-half (1 1/2 %) percent per month or 18% annually.

All sums ordered to be raised for the collection and disposal of solid waste in the City of South Amboy shall be levied and collected at the same time and in the same manner as other municipal taxes, except that any tax levied and collected to provide for the payment of the costs of solid waste collection or disposal shall appear as a separate item on the municipal tax bill. The Tax Collector shall pay the same to the Chief Financial Officer to be applied only for the purposes for which it is raised. All monies assessed and levied pursuant to this Section shall be a lien upon the land against which they are assessed in the same manner that taxes are made a lien against land pursuant to Title 54 of the revised statutes, (N.J.S.A. 54:1-1, et seq.), and the payment thereof shall be enforced within the same time and in the same manner and by the same proceeding as the payment of taxes is otherwise enforced.

Notwithstanding the remedies available under Section 79-25, the City may elect to maintain an action at law to recover any monies due to the City for solid waste charges and late charges.

Persons residing in single-family, owner occupied premises, where the owner is a person of the age of 65 or more years and has qualified for the homestead property tax reimbursement program are exempt from solid waste charges.
