All premises, other than residences used solely for residential use, using the Town water must be equipped with an adequate water meter furnished by the Town but paid for by the consumer.

Meters shall be installed at a location that will be of easy access and approved by the Superintendent of Public Works.
The Superintendent of Public Works shall read or cause to be read every water meter used in the Town at such times as are necessary that bills may be sent out at the proper time.
Water meter rates will be established yearly by the Delmar Water Commission and available upon request in the Town Hall. A minimum charge is established in the yearly rates. All water rent is due within 50 days. If more than one unit is served by a single meter, each unit so served shall pay the minimum water rate.
A.
In the event there is any break or leak in any lateral or communication pipe between the street and any premise to which water service is furnished by the Town, such break or leak shall be deemed to be a public nuisance and the Town Manager shall furnish to such person to whom such service is being furnished, or the owners of the premises, a notice to abate and repair the break or leak. In the event that such person neglects or refuses to make such repair for a space of five days, the Town may abate and repair the pipe or line, the cost of which shall be borne by the owner of the premises.
B.
No new water service connection or any replacement for water service connection to any consuming unit shall be a diameter of less than 3/4 of an inch.
All water service lines from the water main to the property line of the property shall have a minimum cover of three feet.
All errors claimed in or complaint against or any objection to the statement rendered for any water service shall be made to the Town Manager within two calendar months after the date thereof. This statement shall be conclusively deemed to be correct unless such complaint or objection is made within two months.
A.
Water service to the premises shall be terminated and disconnected from the water system of the Town by the Town Manager, either with or without notice, for any one of the following reasons:
(1)
The failure to pay all or any part of the amount due for water service, or any other services contemplated thereby, rendered thereto within 50 days after the service charge shall be due and payable.
(2)
The wasting of water at such premises.
(3)
The resale of water furnished to the premises.
(4)
A break or leak in any lateral or communication pipe from the street line to the premises or in part of the water system of such premises.
B.
A charge for restoring water service in any event shall be set forth in the yearly rate schedule.
The Town Manager is authorized and directed to add to any water bill which is unpaid on the first day of each month interest at the rate of 1% per month for each month or fraction thereof, the penalty to be computed from the first day of each month.
No person shall turn on or off any curb box within the Town without written authority from the Town Manager.
All persons accepting water service furnished by the Town to any premises, as well as the owner of such premises which such water service is furnished, shall be conclusively deemed to have accepted such service subject to all provisions of this article.
The Town shall not be liable for interruptions in or any failure of water service resulting from the making of necessary repairs or extensions to or replacements in any part of the water plant and system of the Town, or from failures in wells, or from fire, flood, inability to obtain labor or material, labor trouble, riot or any other catastrophe or cause beyond its control.

A person who does not comply with the provisions of this article is guilty of a municipal violation, and the penalty shall be $50 for each initial offense and $100 for each subsequent offense. Each day a violation continues is a separate offense.
