Section 1: The Spring Lake Heights Fire District # 1 is abolished effective December 31, 2011. The terms of the office of the members of the Spring Lake Heights Fire District # 1 will therefore be terminated effective December 31, 2011.

Section 2: Any provisions of the Borough Code of the Borough of Spring Lake Heights which refers to, authorizes or sets forth the operating procedures of the Spring Lake Heights Fire District # 1 is hereby repealed.

Section 3: All real and personal property owned by or in the name of the Spring Lake Heights Fire District # 1 and all monies remaining in the Fire District's treasury, shall be transferred to the Borough of Spring Lake Heights, and all documents and records pertaining to same shall be delivered to the Borough Clerk of the Borough of Spring Lake Heights.

Section 4: The Borough of Spring Lake Heights shall assume responsibility for the payment of all lawful debts and obligations of the Spring Lake Heights Fire District # 1, and the Borough of Spring Lake Heights hereby covenants and agrees to comply with and perform all covenants, obligations and agreements of the Spring Lake Heights Fire District # 1.

Section 5: The Borough of Spring Lake Heights shall continue to abide by the terms of the agreement between the Spring Lake Heights Fire District # 1 and the Spring Lake Heights Independent Fire Company #1, Inc. and thereby provide fire protection services to the same recipients and to the same extent as previously provided by the Spring Lake Heights Fire District #1. The Borough of Spring Lake Heights will continue to meet all equipment and financial needs of Spring Lake Heights Independent Fire Company #1, Inc.

Section 6: To the extent that the action of the Borough of Spring Lake Heights authorized by this ordinance is deemed in anyway to have prejudiced the rights that any person or entity had with the Spring Lake Heights Fire District # 1, the Borough of Spring Lake Heights agrees to assume the responsibility for such obligations and to take any steps necessary to correct such actions, including, if necessary, the issuance of obligations by the Borough of Spring Lake Heights to pay or provide for the payment of any outstanding obligations of the Spring Lake Heights Fire District # 1.
