Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c.383 N.J.S.A. 52:27D-192 et seq.), the New Jersey Uniform Fire
Code (N.J.A.C. 5:70-1 et seq.) shall be locally enforced in the Borough
of Milltown.

The local enforcing agency shall be the Milltown Fire Department
through its Bureau of Fire Prevention, which is hereby created therein.
The Bureau of Fire Prevention shall hereinafter be known as the local
enforcing agency.

a.
Within the established boundaries of the Borough of Milltown, the
local enforcing agency shall enforce the Uniform Fire Code in all
buildings, structures, and premises other than owner-occupied buildings
of less than three dwelling units used exclusively for dwelling purposes
and buildings, structures, and premises owned or operated by the Federal
Government, Interstate Agencies or the State.
b.
The local enforcing agency shall faithfully comply with all the pertinent
requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

a.
The Bureau of Fire Prevention established by subsection 17-1.2 shall be under the direct supervision and control of a Fire Official who shall report to the Chief of the Fire Department.
b.
The Bureau of Fire Prevention shall have at least one paid Fire Official
and such paid inspectors as may be necessary to properly enforce the
Uniform Fire Code.

a.
The Fire Official shall be certified by the State, and appointed
by the Governing Body from the recommendation of the Chief of the
Fire Department.
b.
Appointments and Qualifications of Inspectors and Other Employees.
Inspectors and other employees of the enforcing agency shall be appointed
by the Governing Body upon the recommendation of the Fire Official.
All life hazard use inspectors shall be certified by the State.
c.
Appointment of Legal Counsel. The Governing Body shall specifically
appoint legal counsel to assist the Agency in enforcing the Uniform
Fire Code.
d.
Term of Office. The Fire Official shall serve for a term of one year.
Any vacancy shall be filled for the unexpired term.
e.
Removal from Office. The Fire Official, inspectors and other employees
of the Agency shall be subject to removal by the Governing Body for
just cause. Before removal from office, all persons shall be afforded
an opportunity to be heard by the Governing Body or a hearing officer
designated by the same.

The Bureau of Fire Prevention established by subsection 17-1.2 shall carry out the periodic inspections of the life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

a.
In addition to the registrations required by the Uniform Fire Code,
the following non-life hazard uses shall register with the Bureau
of Fire Prevention. These uses shall be inspected once per year and
shall pay an annual fee as set forth below:

b.
Uses required to register with the State as life hazard uses shall
not be required to register under this section.
c.
Vacant buildings which create a fire hazard shall be charged and
inspected according to the previous use of the building.

The Fire Official or Fire Inspector shall conduct an inspection
prior to the issuance of a certificate of occupancy permit each time
there is a change in tenant in a nonresidential building. The fee
for this change of occupancy inspection shall be $0.08 per square
foot of gross floor area, subject to a maximum charge of $15,000.
The square footage of the overall area as interpreted for fee purpose
shall be computed as the product of the greatest width dimension and
the greatest length dimension (maximum width times maximum length)
of each floor. If there is a basement, mezzanine or similar floor,
it shall be counted as one floor in addition to the other floors.

a.
Fees. The application fees for the permits listed in N.J.A.C. 5:70-2.7
shall be as provided by State regulation.
b.
Nonprofit Organization. The Borough of Milltown and all nonprofit
organizations based in Milltown shall obtain all required permits.
The Fire Official will waive the required fees to these organizations.

The Fire Prevention Bureau shall report annually at the end
of the calendar year to the Mayor and Borough Council, and such report
shall contain a summary of all action taken under the Basic Fire Prevention
Code and any other statistics and/or information that the Fire Prevention
Bureau shall deem relevant. The Fire Prevention Bureau may, at such
time, recommend to the Mayor and Borough Council any amendments to
the Fire Prevention Code which it shall deem desirable.

a.
Authorization of Establish. The Fire Official of the Borough of Milltown
Fire Prevention Bureau is hereby authorized to establish fire lanes
on private property devoted to public use, including, but not limited
to, shopping centers, bowling alleys, apartment complexes, drive-in
theaters, churches, swimming pools and similar uses involving parking
of sufficient numbers of motor vehicles, to make necessary such regulations
for protection of persons and property in case of life or other emergency.
b.
Purpose. The fire lanes shall be established to ensure fire equipment
and other emergency vehicles unobstructed means of ingress and egress
to such properties and buildings, persons, vehicles, fire hydrants
and standpipes thereon in case of fire or other emergency.
c.
Determination of Standards. The number, location, width, length and
markings of such lanes shall be determined by the Fire Official of
the Borough of Milltown Fire Prevention Bureau in accordance with
the Uniform Construction Code. Such determination shall be based upon
the size, type and location of the building or buildings, use to which
property is put, number of persons using or occupying premises, existing
means of ingress, total area of property, including size of parking
lot or lots, and all other relevant factors.
d.
Notification of Property Owner. The Fire Official shall notify the
property owner in writing of the location and markings required to
designate such fire lane, and within 30 days after the receipt of
the notice, the property owner shall have complied with the directions
contained therein with respect to the markings and identification
of each designated fire lane. If the property owner fails to complete
this work within the time prescribed, then the Fire Official shall
notify the appropriate Borough department, which shall do all the
necessary work; and the cost thereof shall be added as a tax lien
to the property and collected in the manner of other tax liens and
in accordance with the New Jersey Statutes as may be provided.
e.
Violations and Penalties. After establishment of a designated fire
lane, parking of motor vehicles in or otherwise obstructing such fire
lane shall be prohibited at all times; and any person who parks a
motor vehicle therein or otherwise obstructs a designated fire lane
shall be subject to a fine of not more than $25. In addition thereto,
any motor vehicle parked in a designated fire lane may be towed away
and stored at the owner's expense.
f.
Enforcement. The Borough of Milltown Police Department shall have
concurrent jurisdiction with the Borough of Milltown Fire Prevention
Bureau to enforce the provisions of this section.
g.
Nothing herein contained shall be considered to repeal any previously
established fire area or fire lane, which shall continue to remain
in full force and effect.
h.
Penalty trust accounts shall be set up in accordance with N.J.A.C.
5:70-2.12 and N.J.A.C. 5:70 - 2.12A.

a.
Applicability. All properties within the Borough having an automatic
fire alarm system or a fire sprinkler system shall be equipped with
a key box. One- and two-family dwellings are excluded from the provisions
of this section.
b.
Key Box Type. The key box shall be a UL type approved by the Milltown
Fire Official. The key box shall be equipped with a tamper switch
connected to the building's burglar or fire alarm system. The
key box shall be installed in a location approved by the Fire Official.
c.
Key Box Contents. The key boxes shall contain the following:

Keys to be Labeled. All keys in the key lock box shall be clearly
and properly labeled with lamicoid tags, red with white letters, so
as to identify the lock for which each key is identified.
e.
Cost of Installation. All key lock boxes shall be installed of the
expense of the owner of the property or the lessee of the property
and all keys contained therein shall be kept current.
f.
Time for Compliance. All existing buildings shall comply within 12
months of the effective date of this section. All newly constructed
buildings, not yet occupied, or buildings currently under construction
shall comply immediately.
g.
Penalties. Any building owner violating this section shall be subject
to penalties set by the Fire Official as per N.J.A.C. 5:70-2.12.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any action of the local enforcing agency shall
have the right to appeal to the Construction Board of Appeals of Middlesex
County.

Enforcement, violations, and penalties shall be managed in conformity
with the Uniformity Fire Safety Act, the Uniform Fire Code and all
other laws of the State of New Jersey.
