As used in this section:
ASHES
Shall mean the residue from the burning of wood, coal, coke or other combustible materials.
DEPARTMENT OF PUBLIC WORKS AND RECYCLING
Shall mean the Department of the Borough Council of the Borough of Milltown.
GARBAGE
Shall mean putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
HOUSEHOLD HAZARDOUS WASTE
Shall mean any material deemed to be toxic or carcinogenic.
REFUSE
Shall mean all putrescible and non-putrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes, except items designated as recyclable by the Department of Public Works and contained in Section 24-3, Recycling Program.
RUBBISH
Shall mean non-putrescible solid wastes (excluding ashes), consisting of both combustible and noncombustible wastes, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials.
SUPERVISOR OF PUBLIC WORKS OR SUPERVISOR
Shall mean the Supervisor of Public Works of the Borough of Milltown.

All refuse to be collected and disposed of by the Borough shall be collected, conveyed and disposed of by the Borough under the control of the Department of Public Works and Recycling Committee and under the supervision and direction of the Supervisor of Public Works. The Street Committee shall have the authority to make and change regulations concerning the days of collections and such other matters pertaining to the collection, conveyance and disposal as it shall find necessary, provided that such regulations are not contrary to the provisions thereof.

All garbage and rubbish, before being placed in garbage cans for collection, shall be drained of liquid and may be wrapped in paper.

a. 
Refuse containers shall be provided by the owner, tenant, lessee or occupant of the premises. Refuse containers shall be maintained in good condition. Any container that does not conform to the provisions of this section or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof shall be promptly replaced upon notice. The Supervisor shall have the authority to refuse collection services for failure to comply herewith.
b. 
Refuse containers shall be made of metal or plastic with suitable handles and shall be watertight. Plastic bags may also be used for disposing of refuse, provided that they are strong enough to prevent tearing with the contents enclosed and shall be tied or sealed at the neck.
c. 
No refuse containers with contents shall exceed 50 pounds in weight or 45 gallons in volume; and shall be of such shape as to permit ease in handling.

No person shall place any refuse in any street, alley or other public place or upon any private property, whether owned by such person or not, within the Borough unless it is in proper containers for collection or under express approval granted by the Supervisor; nor shall any person throw or deposit any refuse in any stream or other body of water.

Any unauthorized accumulation of refuse on any premises is hereby declared to be a nuisance and is prohibited. Failure to remove any existing accumulation of refuse shall be deemed a violation of this section.

No person shall cast, place, sweep or deposit anywhere within the Borough any refuse in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public or private place or into any occupied premises within the Borough.

Refuse accumulated by residents of the Borough of Milltown shall be collected once each week on a schedule to be established by the Department of Public Works and Recycling. Certain businesses as deemed necessary by the Supervisor of Public Works shall be collected twice a week. Such schedule may be altered or amended from time to time to conform to legal holidays and other emergency matters.

a. 
All refuse to be collected and disposed of by the Borough shall be placed in proper receptacles and set out within two feet of the curbline of property on which refuse originated in time for collection on the designated collection day.
b. 
Refuse shall not be placed at the curbside earlier than the evening before the day of collection.

All empty receptacles shall be removed from the street as soon after collection as possible and in no event later than 8:00 p.m. on the day collection has been made.

Tree trunks, large pieces of furniture, refrigerators, stoves, washers, etc., and other items exceeding 50 pounds in weight or of unusual size and shape may be disposed of by special arrangements with the Supervisor of Public Works.

The removal of clothing, bedding, or other refuse from homes or other places where highly infectious or contagious diseases have prevailed should be performed under the supervision and direction of the Borough Health Officer. Such refuse shall not be placed in containers for proper collections.

Highly flammable or explosive materials shall not be placed in containers from regular collection, but shall be disposed of as directed by the Supervisor at the expense of the owner or possessor thereof.

Household hazardous waste materials shall not be placed in containers for regular collection, but shall be disposed of as directed by the Supervisor at the expense of the owner or possessor thereof.

Vegetative matter and similar matter shall be cut to the length of four feet or less and securely tied in bundles of no more than two feet thick and shall not weigh more than 50 pounds before being deposited for collection. Vegetative matter and similar matter can also be placed in a standard 32 gallon trashcan for collection. Plastic bags are not to be used to dispose of vegetative and similar matter.

The Department of Public Works and Recycling, Supervisor of Public Works and the employees of the Street Department may refuse to collect any refuse which fails to meet the regulations set forth herein, and in such event, the individual placing the refuse for collection may be compelled to dispose of the same at his own cost and expenses.

The following words and phrases shall have the following meaning:
ALUMINUM
Shall mean all products made of aluminum, including aluminum cans, foil, wrappers, containers for prepared dinners or other foods, screen frames, storm door frames, aluminum lawn chairs and aluminum furniture.
ALUMINUM CANS
Shall mean containers, which are comprised entirely of aluminum and which contain and formerly contained only non-aerosol edible substances.
ASSISTANT SUPERVISOR OF PUBLIC WORKS
Shall mean Assistant to the Supervisor of Public Works of the Borough of Milltown.
AUTHORITY
Shall mean the Middlesex County Improvement Authority, a public body corporate and politic of the State of New Jersey, organized by the County pursuant to the County Improvement Authorities Law (N.J.S.A. 40:37A et seq.)
BATTERY
Shall mean a device for generating electric current for the use in the house and in cars, boats, trucks and/or motorcycles.
BOROUGH
Shall mean Borough of Milltown.
BRUSH
Shall mean branches, woody plants, and other like vegetative material that do not exceed five inches in diameter, and Christmas trees. Brush does not include leaves and grass clippings.
BULK ITEM PICKUP
Shall mean the picking up of large items, including but not limited to chairs, sofas, tables, cabinets, large plastic items, fiberglass, glass windows, shower/tub doors and beds.
BULK METAL PICKUP
Shall mean picking up of large items, including but limited to pipes, doors, tables, chairs, metals, sewing machines, and furnaces.
CANS
Shall mean containers comprised of aluminum, tin, steel, or a combination thereof, which contains or formerly contained only non-aerosol edible substances or such other substances as have been approved for recycling.
CIRCULARS
Shall mean advertisement printed on paper that is not of newspaper quality.
COMMINGLED CONTAINERS
Shall mean 20 gallon plastic containers to be used by the residents to place plastic containers, glass containers, aluminum cans and steel cans at the curb for collection.
COMMINGLED PAPER
Shall mean all type of paper spelled out in policy except for those specifically defined herein.
CORRUGATED CARDBOARD
Shall mean only corrugated material normally used for packaging, mailing, shipping or containerizing goods, merchandise or other material, but excluding plastic, foam or wax-coated or soiled cardboard, no coated material.
DEPARTMENT OF SOLID WASTE
Shall mean Department of the Borough of Milltown.
DEPARTMENT OF STREETS AND SANITATION
Shall mean Department of the Borough of Milltown.
DESIGNATED RECYCLABLES
Shall mean all recyclable materials that are designated by the Department of Public Works of the Borough of Milltown as materials that must be source separated from Municipal Solid Waste at the point of generation. On the date of this section, the recyclables designated by the Department of Public Works are newspaper, aluminum cans, glass containers, corrugated cardboard from residential and commercial sources, steel cans, plastic containers, mixed paper, textiles, leaves, motor oil, concrete asphalt, cinder blocks, bricks, bulk items, wood pallets and brush.
ELECTRONICS
Shall mean televisions, CPU's, monitors, laptops and mercury containing devices.
FLUORESCENT BULBS
Shall mean lamps that contain mercury.
GLASS
Shall mean all products made from silica or sand, soda ash and limestone, for the product being transparent or translucent and being used for packaging or bottling of various matter or other material commonly known as "glass," excluding, however, plate glass, blue and flat glass and glass commonly known as "window glass." "Glass" shall not include crystal, ceramics, light bulbs and plates, window, laminated, wired or mirror glass.
HIGHGRADE OFFICE PAPER
Shall mean photocopies, letterhead paper, computer printout paper.
HOUSEHOLD HAZARDOUS WASTE
Shall mean any material deemed to be toxic or carcinogenic.
INSTITUTIONS
Shall mean municipal facilities, schools, churches, places of worship.
LEAVES
Shall mean flattened plant structures, which were attached to a stem and functioning as a principal organ of photosynthesis.
MASONRY/PAVING MATERIAL
Shall mean asphalt, block, brick, cinder and concrete.
MIXED PAPER
Shall mean glossy inserts, magazines, telephone books, junk mail, colored paper, computer paper, office paper, paperboard (chipboard and pressboard), non-metallic wrapping paper, soft cover books, hard cover books with covers removed and fine paper.
MIXED PAPER CONTAINER
Shall mean a covered, fourteen-gallon container in which residents will place mixed paper at the curb for collection by the contractor, or such other container designated by the Authority, MCIA, for such purpose.
MULTIPLE COMMERCIAL AND FAMILY USE
Shall mean all buildings and/or structures which have both family dwellings and commercial use.
MULTIPLE COMMERCIAL USE
Shall mean all buildings and structures which encompass a multiple of the following uses as set forth in Article 301.1 of the BOCA National Code: Use Group A - Assembly; Use Group - Business; Use Group F - Factory and Industrial; Use Group H - High Hazard; Use Group M - Mercantile; Use Group R - Residential; Use Group S - Storage; Use Group Utility and Miscellaneous.
MULTIPLE FAMILY DWELLING
Shall mean all family dwelling having two or more dwelling units, including but not limited to attached single family units, as set forth in Article 309.3, Use Group R-2 and Article 307.4, Use Group R-3 of the BOCA National Code.
NEWSPAPER
Shall mean and include paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest.
OFFICE PAPER
Shall mean paper of letter or xerox quality.
PARKS AND GREEN ACRES
Shall mean open space for recreational use.
PETE/HDPE
Shall mean the composition of plastic container material.
PLASTIC CONTAINERS
Shall mean soda bottles made of PETE (SPI CODE #1) and milk, water and laundry product bottles made of HDPE (SPI CODE #2).
PLASTIC FILM
Shall mean stretch/shrink wrap, plastic shopping bags-only for warehouses, retail establishments and supermarkets with 25 or more employees.
RECYCLABLE BATTERIES
Shall mean rechargeable batteries, nickel cadmium, nickel metal hydride, lithium and small sealed lead.
RECYCLABLES
Shall mean a material, which would otherwise become solid waste, which can be collected, separated or processed and returned to the economic mainstream in the form of raw material or products. Any and all bottles, aluminum cans, scrap metals, white goods, waste oil, tires, plastic, bimetal cans, trees, stumps, cement, asphalt, clean wood pallets, plastic PETE/HDPE excluding products containing or that contained household hazardous waste, auto batteries, cardboard, newsprint - High grade, lawn products, car parts, branches, shrubbery, leaves.
RESIDENTS
Shall mean private, commercial and institutional residents of the Borough of Milltown that are required to recycle designated recyclables.
SINGLE COMMERCIAL USE
Shall mean all buildings and structures classified as one of the following Use Groups as set forth in Article 301:1 of the BOCA National Code: Use Group A - Assembly; Use Group B - Business; Use Group F - Factory and Industrial; Use Group H - High Hazard; Use Group M - Mercantile; Use Group S - Storage; Use Group U - Utility and Miscellaneous.
SINGLE FAMILY USE
Shall mean all detached one-family dwellings as set forth and defined in Article 309.5, Use Group R-4 of the BOCA National Code.
STEEL CANS
Shall mean tin-plated, bi-metal and other ferrous food and beverage containers.
SUPERVISOR OF PUBLIC WORKS
Shall mean the Supervisor of Public Works of the Borough of Milltown.
TEXTILE BAG
Shall mean a special bag to be provided by the Middlesex County Improvement Authority for the collection of textiles.
TEXTILES
Shall mean clean, dry clothing or other fabric measuring at least one foot by one foot in size.
TIRES
Shall mean rubber based scrap automotive, truck and equipment tires.
VEGETATIVE MATTER
Shall mean all grass clippings, leaves, shrubbery, branches greater than one inch in diameter, and not exceeding four feet in length, excluding roots.
WASTE OIL
Shall mean all petroleum products removed from cars, buses, trucks, motorcycles, lawn mowers and tractors.
WHITE GOODS
Shall mean washers, dryers, ranges, refrigerators, air conditioners, dehumidifiers - All devices that contain CFC's must be properly evacuated by a licensed individual and all CFC's recovered must be sent to an approved EPA reclaimer.
WOOD SCRAP
Shall mean unfinished lumber from new construction projects including pallets. Unfinished shall mean non-chemically treated (not pressure treated, impregnated with preservatives, insecticides, fungicides, creosote or other chemicals and not painted, resin coated or otherwise surface treated and not laminated or bonded; and not similarly altered from its natural condition). Only for new construction sites.

There is hereby established, within the Borough of Milltown, Middlesex County, New Jersey, a program for the mandatory source separation of designated recyclables.

It shall be a violation of this section for any person unauthorized by the Borough of Milltown to collect or pick up or cause to be collected or picked up any recyclable item(s) located within the Borough of Milltown. Any and each such collection in violation hereof from one or more premises shall constitute a separate and distinct offense punishable by a fine not to exceed $500 for each offense.

a. 
The property owner, or a designee of the property owner appointed in writing by the property owner, of all real property upon which a commercial business, commercial office, institutional use is located and all contractors whose place of business is located within the Borough of Milltown shall have the following additional recycling requirements:
1. 
A written program setting the precise manner by which the property shall achieve compliance with the recycling mandates of this section shall be established for all properties within 30 days of the effective date of this section;
2. 
Recycling containers must be clearly marked with the type of material to be deposited therein and adequate to hold materials between collections;
3. 
The property owner, or a designee of the property owner, must provide written notice to occupants of the property if they are impacted by the recycling system;
4. 
Where the property owner or a designee of the property owner of a commercial, industrial, or institutional use has arranged for removal of the recyclables by other than the Borough of Milltown, the property owner or a designee of the property owner shall submit or cause to be submitted reports of recycling tonnage information to the Borough of Milltown on a quarterly basis which reports shall be attested to under oath;
5. 
Prior to the issuance of a Certificate of Occupancy for all new construction, the property owners or a designee of the property owner must submit to the Supervisor of Public Works and/or the Assistant Supervisor of Public Works a written proposal of the recycling program it shall implement. Said program must be acceptable to said Supervisor of Public Works and/or Assistant Supervisor of Public Works.
6. 
A property owner or a designee of the property owner of property containing an existing business, commercial establishment or a contractor whose place of business is located within the Borough of Milltown is responsible for implementing a recycling program for their premises. Said recycling program must be submitted in writing to the Supervisor of Public Works and/or the Assistant Supervisor of Public Works for their approval within 30 days of the effective date of this section.
7. 
A property owner shall not be relieved of responsibility due to the failure of any tenant to comply with the provisions of this section.

a. 
The property owner, or a designee of the property owner appointed in writing by the property owner, of all multifamily dwellings within the Borough of Milltown shall comply with the following recycling requirements:
1. 
A recycling system must be established for all mandatory materials.
2. 
Drop-off or curbside collection must be provided at the sole cost and expense of the property owner for all mandated materials;
3. 
Recycling containers must be clearly marked with the type of material to be deposited therein and adequate to hold material between collections.
4. 
The property owner, or a designee of the property owner, must issue written notification to tenants every three months. Said notices must be sent Certified Mail, Return Receipt Requested and said return receipts be kept by the property owner or a designee of the property owner for a period of two years.
5. 
Where the owner, or a designee of the property owner, has arranged for removal of recyclables by other than the Borough of Milltown, the property owner or a designee of the property owners shall submit or cause to be submitted reports of recycling tonnage information to the Borough of Milltown on a quarterly basis which reports shall be attested to under oath.
6. 
Prior to the issuance of a Certificate of Occupancy for all new construction, the property owner, or a designee of the property owner, must submit to the Supervisor of Public Works and/or the Assistant Supervisor of Public Works a written proposal of the recycling program it shall implement. Said program must be acceptable to said Supervisor of Public Works and/or Assistant Supervisor of Public Works.
7. 
A property owner, or a designee of the property owner, of property containing an existing business, commercial establishment or a contractor whose place of business is located within the Borough of Milltown are responsible for implementing a recycling program for their premises. Recycling containers must be clearly marked with the type of material to be deposited therein and adequate to hold materials between collection; and
3. 
Where the property owner, or a designee of the property owner, has arranged for removal of recyclables by other than the Borough of Milltown, the property owner, or a designee of the property owner, shall submit or cause to be submitted reports of recycling tonnage information to be submitted to the Borough of Milltown on a quarterly basis, which reports, shall be attested to under oath.

a. 
The property owner, or a designee of the property owner, of all single commercial property within the Borough of Milltown shall have the following recyclable requirements:
1. 
A recycling system must be established for all mandated materials.
2. 
Recycling containers must be clearly marked with the type of material to be deposited therein and adequate to hold materials between collection; and
3. 
Where the site director and/or site director's designee has arranged for removal of recyclables by other than the Borough of Milltown, the site director and or site director's designee must submit or cause to be submitted reports of recycling tonnage information to be submitted to the Borough of Milltown on a quarterly basis which reports shall be attested to under oath.
4. 
The site director shall be held ultimately responsible for their occupant's failure to follow the provisions of this section.

All recyclables to be collected and disposed of by the Borough of Milltown shall be collected and disposed by the Borough under the control of the Street Committee and under the supervision and director of the Supervisor of Public Works or his designated agent. The Street Committee shall have the authority to make and change regulations concerning the days of collection and such other matters pertaining to the collection, conveyance and disposal as it shall find necessary, provided that such regulations are not contrary to the public provisions hereof.

a. 
Designated recyclable materials are all recyclable materials that are designated by the Department of Public Works of the Borough of Milltown as materials that must be source separated from municipal solid waste at the point of generation. The recyclables currently designated by the Department of Public Works include newspaper, aluminum cans, glass containers, corrugated cardboard, steel cans, plastic containers, mixed paper, textiles, leaves, motor oil, concrete, asphalt, cinder blocks, bricks, bulk items, wood pallets and brush, masonry/paving material, recyclable batteries, tires, white goods.
b. 
Additional Designated Recyclables for Commercial, Industrial and Institutional Governments and Office Parks.
1. 
Electronics: televisions, CPU's, monitors laptops, and mercury-containing devices.
2. 
Fluorescent Bulbs: lamps that contain mercury.
3. 
Plastic Film: stretch/shrink wrap, plastic shopping bags-only for warehouses, retail establishments and supermarkets with 25 or more employees.
4. 
Wood Scrap: unfinished lumber from new construction projects including pallets. Unfinished shall mean nonchemically treated (not pressure treated, impregnated with preservatives, insecticides, fungicides, creosote or other chemicals and not painted, resin coated or otherwise surface treated and not laminated or bonded; and not similarly altered from its natural condition). Only for new construction sites.

All recyclables before being placed in proper receptacle containers for collection shall be washed and drained of liquid.

a. 
Recycling containers shall be provided by the Middlesex County Improvement Authority. Recycling containers shall be maintained in good condition. Any container that does not conform to the provisions of this section or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof, shall be promptly replaced upon notice. The Supervisor shall have the authority to refuse collection service for failure to comply herewith.
b. 
Recycling containers shall be made of a rigid plastic material with suitable handle(s).
c. 
No recycling containers shall exceed 20 gallons in size.

All recyclables shall be placed at the curb in the following manner for pick-up:
a. 
Glass bottles, plastic containers (#1 PETE and #2 HDPE), aluminum, steel and tin cans shall be placed in a round twenty-gallon container supplied by the Middlesex County Improvement Authority.
b. 
Newspapers shall be tied in bundles with a string or cord no more than 12 inches high.
c. 
Mixed paper shall be placed in the rectangular container supplied by the Middlesex County Improvement Authority.
d. 
Corrugated cardboard shall be flattened and tied in bundles with string or cord; maximum dimensions: 24 inches wide by 48 inches long by 18 inches high.
e. 
Textiles shall be placed in bags supplied by Middlesex County Improvement Authority.

No person shall place any recyclables in any street, alley or public place, or upon any private property within the Borough, whether owned by such person or not unless it is enclosed in proper containers for collection as defined herein or under express approval granted by the Supervisor, as defined herein. No person shall throw or deposit any unauthorized recyclables in any stream, body of water, or municipally owned property whether enclosed in a container or not.

Any accumulation of recyclables not enclosed in the proper recycling containers is hereby declared to be a nuisance and is prohibited. Failure to remove any existing accumulation of recyclables within 30 days after the effective date of this section shall be deemed in violation of this section.

No person shall cast, place, sweep or deposit anywhere in the Borough any recyclable in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public or private place or into any premises within the Borough.

a. 
All recyclables subject to the collection schedule and disposed of by the Borough shall be placed in proper receptacles and set out within two feet of the curbline of property on which recyclables originated in time for collection on the designated collection day.
b. 
Recyclables shall not be placed at the curbside earlier than the evening before the day of collection and must be placed at the curbside no later than 7:00 a.m. on the day of collection to receive services.

All empty recycling containers shall be removed from the curbline of property as soon after collection as possible and in no event, later than 8:00 p.m. on the day collection has been made.

The Street Committee, Supervisor of Public Works, and the employees of the Street Department or his designated agent may refuse to collect any recyclables, which fail to meet the regulations set forth herein. In such event, the individual placing the refuse for collection shall be compelled to dispose of the same at his own cost and expense within 24 hours of such refusal.

New developments of Multifamily residential units or commercial, institutional, or industrial properties (Pursuant to N.J.S.A. 13:1E-9913a and 99.16c):
a. 
Any application to the Planning Board of the municipality of Milltown, for subdivision or site plan approval for the construction of multifamily dwellings of three or more units, single-family developments of 50 or more units or any commercial, institutional, or industrial development for the utilization of 1,000 square feet or more of land, must include a recycling plan. This plan must contain at minimum, the following:
1. 
A detailed analysis of the expected composition and amounts of solid waste and recyclables generated at the proposed development.
2. 
Locations documented on the application's site plan that provide for convenient recycling opportunities for all owners, tenants, and occupants. The recycling area shall be of sufficient size, convenient location and contain other attributes (signage, lighting, fencing, etc.) as may be determined by the Recycling Coordinator.
b. 
Prior to the issuance of a Certificate of Occupancy by the municipality of Milltown, the owner of any new multifamily housing or commercial, institutional, or industrial development must supply a copy of a duly executed contract with a hauling company for the purpose of collection and recycling of source separated recyclable materials, in those instances where the municipality does not otherwise provide the service.
c. 
Provision shall be made for the indoor, or enclosed outdoor, storage and pickup of solid waste, to be approved by the Municipal Engineer.
d. 
Building Permits. At the time of issuance of any building permit, the Building Code Official will provide written instruction on proper disposal and recycling of construction and demolition waste and furnish a Notification of Construction/Demolition Activity Form that must be filled out by the permit holder and faxed to the Middlesex County Division of Solid Waste Management (MCDSWM) within 48 hours of the issuance of a municipal permit.

Any person violating the provision of this section as a first offender shall be issued a violation notice in the form of a letter advising them that said violation must be abated within seven days. If said violation is not abated within the allotted time and/or any person violates a provision of this section for a second time said person may be served with a complaint to appear in Milltown Municipal Court for such violation and upon such violation, and upon conviction, may be fined in an amount not exceeding $500 for each and every day in which such violation shall continue.

The Supervisor and/or Assistant Supervisor of Public Works or their designee shall be responsible and empowered to enforce the provisions set forth in the section.

The Department of Public Works is hereby authorized to implement a Comprehensive Borough Public Education and Awareness Program through the preparation and dissemination of generic information and other education/information materials.

As used in this section:
COLLECTION DATE
Shall mean those dates set down by the Director of Public Works or his/her designee for collection of leaves or grass.
GRASS
Shall mean any lawn clippings. Grass shall not include any leaves, shrubbery, branches or root material.
LEAVES
Shall mean any flattened plant structures which were attached to a stem and functioning as a principal organ of photosynthesis. Leaves shall not include any grass clippings, shrubbery, branches or roof materials.

a. 
All leaves are to be bagged in paper, biodegradable bags which shall be 16 inches by 12 inches by 35 inches and which shall have a minimum capacity of 30 gallons. At no time may leaves be placed in plastic bags.
b. 
No grass clippings, shrubbery, branches, root material or any other materials shall be included with leaves.

a. 
All grass clippings are to be bagged in 30 gallon plastic bags of three or four mil. thickness or garbage cans, a maximum size of 30 gallons and/or maximum weight of 50 lbs.
b. 
Bags are to be unsealed and untied.
c. 
No leaves, shrubbery, branches, root material or any other materials will be included with grass clippings, brush or woody matter.

Leaves and grass accumulated by residents of the Borough shall be collected on a schedule to be established by the Department of Public Works. Such schedule may be altered or amended from time to time to conform with legal holidays and other emergency matters, or as the Department of Public Works shall deem necessary.

a. 
All leaves and grass subject to the collection schedule and disposed of by the Borough shall be placed in proper receptacles and set out within two feet of the curbline of property on which the leaves and grass originated in time for collection on the designated collection day.
b. 
Leaves and grass shall not be placed at the curbside earlier than the evening before the day of collection and must be placed at the curbside no later than 7:00 a.m. on the day of collection to receive services.
c. 
No person shall cast, place, sweep or deposit anywhere in the Borough any leaves and grass in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public or private place or into any premises within the Borough.

The Supervisor of Public Works and the employees of the Department of Public Works may refuse to collect any leaves and grass which fail to meet the regulations set forth herein. In such event, the individual placing the refuse for collection shall be compelled to dispose of same at his own cost and expense within 24 hours of such refusal.

Any person violating the provisions of this section as a first offender shall be issued a violation notice in the form of a letter advising them that the violation must be abated within seven days. If the violation is not abated within the allotted time and/or any person violates a provision of this section for a second time, the person may be served with a complaint to appear in Milltown Municipal Court for such violation and upon such violation, and upon conviction, may be liable to the penalty stated in Chapter 1, Section 1-5. Each and every day in which such violation shall continue shall constitute a separate offense.
