A. 
A separate Perpetual Care Fund is to be established and designated and used for the care or improvement of the grounds of the St. James Cemetery.
B. 
Two hundred thousand dollars ($200,00.00) will be deposited in the Perpetual Care fund and invested in government securities.

All funds received by the City for the care and maintenance of the cemetery shall be delivered to the City Clerk and shall be placed in a separate fund or account to be known as the Perpetual Care Cemetery Fund.

No money shall be transferred out of the Perpetual Care Fund except for the purpose of being invested. Perpetual care fees collected from the sale of lots shall not be less than three hundred fifty dollars ($350.00) per lot. When cremation remains are buried in grave, a registration fee of one hundred twenty-five dollars ($125.00) shall be collected for the recording of the deceased in that lot. This fee shall be deposited into the Perpetual Care Fund.

The interest income derived from the Perpetual Care Fund shall be used for the preservation, care, and upkeep of the St. James Cemetery.

The principal of the Perpetual Care Fund is not to be used for any purpose whatsoever, and no money shall be transferred out of the Perpetual Care Fund except for the purpose of being invested.

Any gift, donation or bequest to the Perpetual Care Cemetery Fund shall be placed to the credit of the Perpetual Care Cemetery.
