The board of city commissioners shall be authorized to subsequently
amend the amounts charged in this chapter for fees, by a resolution
duly adopted, referring to this chapter, should the need arise.

Any party owning property that is assessable property as defined by Section 17-97 herein desiring to connect to the City of Williston, North Dakota, Municipal Sanitary Sewer System shall be subject to a sewer availability charge based on water service line size.

For the purpose of this section, the following sewer availability
fees apply based on the size of the water line that services the property
from the public water main. These fees may be changed by resolution
approved by the city commission.

A request for sewer availability charge determination shall
be made prior to the issuance of the building permit covering the
subject property.

The sewer availability charge shall be assessed against all
property that has not previously been assessed for any trunk line
sewer. See map attached hereto and by this reference made a part hereof.[1]

The sewer availability charge referred to herein shall be paid
in full to the City of Williston before the City of Williston plumbing
permit or water meter is issued.

All funds received in payment of such sewer availability charges
shall be deposited in the City of Williston Municipal Sewer Account
for the purposes and disbursed only in the manner provided by the
laws of the State of North Dakota pertaining to municipal utilities.

In the event a property seeks an additional or larger replacement
water line, the property shall be assessed a connection fee according
to the size of the additional or replacement line with a credit given
for the fee previously paid up to the amount of the connection fee
of the additional or replacement line.

The term "expansion sewer hookup" as used in this article is
defined to mean all sewer service lines or sewer laterals that benefit
or will benefit from west and north sewer lines installed at city
expense from 2011 and 2012 install and generally shown on attached
map exhibit. The map referred to herein may be found on file in the
city offices.

The City of Williston shall be allowed to charge a fee for an expansion sewer hookup as defined above. This fee shall be $140 per 10,000 square feet of expansion area and shall be in addition to the City of Williston Ordinance Number 872. (See Section 17-95).
