The purpose of this chapter is to establish in certain areas that are public or quasi-public and open to the public or to which the public is invited spaces where parking shall be prohibited in areas designated as handicapped spaces for use by persons who have been issued special vehicle identification card by the Division of Motor Vehicles. No other person or persons shall be permitted to park in these spaces.
A. 
This chapter is enacted in accordance with N.J.S.A. 34:4-197, which does confer upon the Township of Dennis the right to establish designated restricted parking spaces for handicapped persons who have been issued special vehicle identification card by the Division of Motor Vehicles.
B. 
In addition, pursuant to N.J.S.A. 39:4-197.5, any municipality may by ordinance establish restricted parking spaces in front of residences, schools, hospitals and other public buildings and in shopping and business districts for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles.
As shown in the attached Schedule A,[1] those areas shall be designated as handicapped parking spaces and shall be so marked by signs and conformance with the current Manual on Uniform Traffic Control Devices for Streets and Highways, and said schedule is made part of this chapter.

A. 
Notice of this chapter will be effective by placing its provisions on signs according to specifications contained in the current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198.
B. 
In addition to the specifications in the Manual on Uniform Traffic Control Devices, any sign erected before and after the effective date of this amendatory and supplementary act to notify the public that parking in a space is reserved for the handicapped shall also state the penalty set forth in § 177-6 pursuant to N.J.S.A. 39:4-197, Subdivision (3)c, which may be imposed for a violation.

Upon receipt of a certified letter from the Township Engineer designating handicapped spaces and the designated handicapped spaces listed in the attached Schedule A,[1] the New Jersey State Police shall enforce parking restrictions on all designated handicapped parking spaces in the Township of Dennis.

B. 
Pursuant to N.J.S.A. 39:4-207.7, an eligible handicapped person may request a law enforcement officer to arrange for the removal and storage of a motor vehicle unlawfully parked in a handicapped parking space or zone which is restricted for use by a handicapped person. It shall be the obligation of the owner of the motor vehicle to pay the reasonable costs for the removal and for any storage which may result from the removal.
Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $100 for the first offense and for subsequent offenses a fine of at least $100 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
All ordinances or parts or ordinances inconsistent herewith are hereby repealed, and this chapter shall take effect immediately upon final passage and publication as required by law.
