To protect the health, safety, and comfort of residents, taxpayers, visitors, and employees the City Council of the City of Pittston deems it necessary to ban smoking in and on public property.
No use of tobacco or marijuana products, including, but not limited to, cigarettes, smokeless tobacco, electronic cigarettes, vapes, joints, is permitted within public property, including, but not limited to, buildings, parks, vehicles and equipment. There shall be no use of tobacco or marijuana products within 100 feet of any door or window of a public building.
A. 
The provisions of this article shall be enforced by any authorized officer, Police Department and those designated by the City Administrator.
B. 
Any violation of the provisions of this article may be cause for a citation, a violation ticket, quality of life ticket, and/or a notice of violation to be issued to the violator.
A. 
Any person who violates any provision of this article shall be fined $100. Payments made in person shall be made at City Hall in full on or within two City business days of the date of issuance. Postmark is acceptable evidence of date of payment for payments made by mail. Payments made online shall be deemed received per electronic date of receipt.
B. 
Late payment. Payments received after two City business days but less than 10 days after issuance shall require an additional late fee of $10 per calendar day.
C. 
Nontraffic citation. Payments not received after 10 City business days will result in the issuance of a nontraffic citation by the appropriate official. Upon conviction before the District Magisterial Court, a fine of not less than $500 nor more than $1,000 shall be imposed, along with any and all additional court costs and City-incurred legal costs and/or fees.
