This article shall be known and may be cited as the "Borough of Bath Snow Emergency Ordinance" and is supplementary and in addition to the ordinances of the Borough of Bath establishing vehicular regulations.
As used in this article, the following terms shall have the meanings indicated:
CHAINS
Full chains, strap chains or other types of chains mounted on the driving wheels of a motorized vehicle.
EVEN-NUMBERED SIDE OF THE STREET
That side of the street containing building numbers or designations which are evenly divisible by two.
ODD-NUMBERED SIDE OF THE STREET
That side of the street containing building number or designations which are not evenly divisible by two.
SNOW EMERGENCY
A "snow emergency" shall exist upon declaration by the Mayor, or his/her designee, when it is determined that winter snow and ice conditions are severe enough to mandate that vehicles should not be parked on public streets on designated snow emergency routes. Such periods shall not exceed more than 72 hours after the cessation of a snowfall.
SNOW TIRES/ALL-PURPOSE TIRES
Snow tires/all-purpose tires with sufficient tread to allow self-propelled vehicles to move through streets during snow emergency conditions.
A. 
In the event of inclement weather where the snowfall is expected to or does accumulate to more than three inches, severe icing of the roadway is expected or actually occurs on the roadway, or a serious public hazard impairing transportation, the movement of traffic, food and fuel supplies, medical care, fire, health and police protection and other vital facilities of the Borough exists, a snow emergency may be declared. During this emergency, no vehicles will be parked or left unattended on any designated snow emergency route as set forth in this article. Any vehicle stranded, disabled or parked on these snow emergency routes will be towed at the vehicle owner's expense and pay the appropriate penalties for the violations hereof and any storage fees as charged by the towing service.
B. 
Any and all vehicles traversing the snow emergency routes shall be required to have state-approved snow or all-purpose tires or tires with chains.
C. 
Snow emergency declarations may be publicized by the Borough Manager, or his/her designee, via television, radio, newspaper, Internet, the Borough website, social media or other media as is available.
D. 
The period of a snow emergency shall not exceed more than 72 hours after the cessation of a snowfall.
E. 
The snow emergency declaration shall be posted to the Borough's website and shall be effective immediately upon the declared date and time posted to the Borough website.

In addition, when the date of a declared snow emergency falls on an even-numbered day of the Gregorian civil calendar as amended and currently in effect, no person shall park a vehicle or allow a vehicle to remain parked on the even-numbered side of the following streets:

D. 
For snow emergencies lasting longer than a period of 24 hours, the effective time of the change for parking on either the even-numbered side of the street or the odd-numbered street (depending on the day for which the snow emergency is declared) is between 8:00 p.m. to 9:00 p.m. for the next day.
E. 
The snow emergency parking rules as set forth in this section shall not apply to private and public parking lots.
A. 
The Borough Manager, or his/her designee, is hereby authorized to designate snow removal zones on streets where the use of such streets is deemed to be essential by the Borough Manager.
B. 
When a snow removal zone is designated under this section, there shall be snow removal zone signs posted on the streets where such snow removal operation is to be performed. Such snow removal zone signs shall be erected on the streets involved 24 hours in advance of such snow removal operation and shall inform the public when parking is prohibited.
C. 
After snow removal zone signs have been posted, it shall be unlawful for any person to park or suffer to be parked any vehicle of any kind or description during the time designated on such sign on either side of any street, highway, avenue, boulevard or other public way within such snow removal zone.
D. 
The Borough Manager shall supervise the placement and pickup of snow removal zone signs. The posting of such signs as provided in this section shall constitute due and sufficient notice to the public.
E. 
Such snow removal zones shall remain in existence until the snow removal operation has been declared completed by the Borough Manager and the snow removal zone signs are removed.
A. 
In order to assist the operators of motor vehicles in determining the streets affected by the provisions of the "Borough of Bath Snow Emergency Ordinance," the Borough Manager, or his/her designee, shall place upon the utility poles on the highways or portions thereof, as indicated in § 625-4, signs reading as follows:

B. 
The Borough Manager is hereby authorized to and directed to procure signs as may be specified by the Borough Council of the Borough of Bath at appropriate intervals along each street giving public notice of parking restrictions during declared snow emergencies.
No provision of this article shall be construed to permit parking or any street or at any location along said street where such parking is prohibited by the provisions of the Commonwealth of Pennsylvania Motor Vehicle Code (75 Pa.C.S.A. § 101 et seq.) or by any other part of this chapter or any other ordinance of the Borough of Bath now in effect or hereafter enacted.
A. 
Police officers for the Borough of Bath under the authority of this article or the Commonwealth of Pennsylvania Motor Vehicle Code, (75 Pa.C.S.A. § 101 et seq.), as amended and currently in effect, and the designated Borough of Bath Code Enforcement Officer, each may remove or tow away from the right-of-way of any state highway, Borough road or cartway any vehicle which is stranded, disabled, incapable of moving under its own power, or left unattended upon any street or parked in violation of the provisions of this article when it is determined that such removal is necessary to facilitate the plowing or removing of snow and ice or for any other lawful purpose.
B. 
Vehicles referenced in Subsection A above may be impounded by police officers for the Borough of Bath or any Borough of Bath Code Enforcement Officer in accordance with Articles VII and VIII of this chapter, as the case may be. The owner of the impounded vehicle(s) shall pay for the costs of such removal and storage and it shall be a violation of this article for the owner to fail to pay such costs.
Any person or persons, firm or corporation violating any of the provisions of this article, including any snow emergency rules and regulations found under Article II of this chapter, shall, upon conviction before a Magisterial District Judge in a summary proceeding, be liable to and shall pay a fine of not more than $150 plus costs for every violation, plus the fees for cost of removal, towing and storage of said vehicle. In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.
