Any person who shall operate a vehicle or tractor at a speed in excess
of that established therefore, be sentenced to pay a fine of this
section, shall, upon conviction thereof, be sentenced to pay a fine
of $35 and, for exceeding a maximum speed limit by more than five
miles per hour, shall pay an additional fine of $2 for each mile-per-hour
in excess of five miles per hour in excess of the maximum speed limit,
and costs of prosecution, or, in default of payment of such fine and
costs, to undergo imprisonment for not more than one day for each
$10 of the unpaid balance of the fine and costs.

Be it further enacted and ordained that the Manager is hereby authorized
and directed to take all actions necessary or appropriate to assure
the erection of a traffic signal at the intersection of Barrall Avenue
and Route 512.
C.
Any operator of a vehicle or tractor who shall disobey the directions
of any traffic signal shall, upon conviction thereof, be sentenced
to pay a fine of $25 and costs of prosecution, or, in default of payment
of such fine and costs, to undergo imprisonment for not more than
one day for each $10 of the unpaid balance of the fine and costs.

Any person who shall operate a motor vehicle or tractor upon any
highway or portion thereof hereby established as a one-way highway
other than in the direction hereby established for traffic thereon
shall, upon conviction thereof, be sentenced to pay a fine of not
more than $25 and costs of prosecution, or, in default of payment
of such fine and costs, to undergo imprisonment for not more than
one day for each $10 of the unpaid balance of the fine and costs.
A.
The following intersections are hereby established as stop intersections,
and official stop signs shall be erected (or are hereby confirmed
if heretofore erected) in such a position as to face traffic approaching
the second-named highway upon the first-named highway, in the direction
or directions hereby indicated. All vehicles and tractors approaching
any such intersection upon the first-named highway, in the direction
or directions hereby indicated in each case, shall come to a full
stop, within a reasonable distance, before entering any such intersection:

Any person who shall violate any provision of this section shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$50 and costs of prosecution, or, in default of payment of such fine

C.
Nothing herein shall prohibit the operation of any commercial vehicle
or tractor upon any highway or portion thereof listed hereinabove
where such operation thereon shall be necessary in order to pick up
or deliver any goods, wares, merchandise or material from or to any
premises located upon any such highway or portion thereof.
A.
It shall be unlawful for any person to operate any motor vehicle
or other tractor, trailer or tractor-trailer combination, having a
gross weight in excess of that herein respectively prescribed, upon
any of the following highways or portions thereof.

B.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be sentenced to pay a fine of $75 for each
500 pounds, or part thereof, in excess of 3,000 pounds over the maximum
allowable weight, plus costs of prosecution, or, in default of payment
of such fine and costs, to undergo imprisonment for one day for each
$10 of the unpaid balance of the fine and costs.
It shall be unlawful for any person to operate any vehicle or
tractor upon any highway in the Borough that is under construction,
resurfacing or repair, in disregard of any official sign, barricade
or notice that the same is closed to vehicular traffic. Any person
who shall violate any provision of this section shall, upon conviction
thereof, be sentenced to pay a fine of not more than $25 and costs
of prosecution, or, in default of payment of such fine and costs,
to undergo imprisonment for not more than one day for each $10 of
the unpaid balance of the fine and costs.

B.
The Mayor is hereby authorized to designate as play highways, whenever
he shall deem such action advisable, and for whatever period of time
directed by him, any portion of any highway in the Borough whereon
sledding and coasting shall be permitted. Such highway shall be set
apart for the purpose under the direction of the Mayor.
C.
No person shall operate any motor vehicle or tractor upon any play
highway at any time when such highway shall be so designated, except
in case of emergency, with special permission of the Mayor or of the
police officer in charge, who shall first clear such play highway
of all persons using such highway for the purpose for which it was
set aside. Any person who shall violate any provision of this section
shall, upon conviction thereof, be sentenced to pay a fine of not
more than $25 and costs of prosecution, or, in default of payment
of such fine and costs, to undergo imprisonment for not more than
one day for each $10 of the unpaid balance of the fine and costs.
No-turn-on-red signs are hereby established and authorized to
be erected facing all four approaches at the following intersections
within the Borough of Bath:

A.
Right-turns are hereby restricted by means of vehicle weight classification
and signs indicating as such are authorized to be erected at the following

B.
Any combination of vehicle exceeding the weight rating of 26,001 pounds or more is prohibited from negotiating a right-turn at the specified locations in Subsection A.
C.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be subject to the penalty set forth in the
Uniform Traffic Regulations of the CRPD (last revised April 20, 2002,
and proposed by the CPRD, as amended) and the Vehicle Code of the
Commonwealth of Pennsylvania, 75 Pa.C.S.A. § 6101 et seq.
(1977), as hereafter amended, supplemented, modified or reenacted
by the General Assembly of Pennsylvania.
A.
Use of brake retarders prohibited. No person shall operate, and no
owner shall permit the use of brake retarders on any motor vehicle
on any highway which prohibits said use.
B.
Motor vehicles not to be driven on sidewalks. No person shall operate
any motor vehicle upon any sidewalk in the jurisdiction of the Borough
of Bath, except in order to gain access to or egress from a driveway
or alley at such locations where the curb, if such sidewalk is curbed,
shall have been properly cut down for that purpose.
C.
Operation of motor vehicles as defined under the Vehicle Code of
the Commonwealth of Pennsylvania, 75 Pa. C.S.A. § 6101 et
seq. (1977), as hereafter amended, supplemented, modified or reenacted
by the General Assembly of Pennsylvania upon public lands or designated
areas. All licensed motor vehicle shall be permitted only in designated
parking lots and on designated access roads within public lands. Vehicles
shall not park or be driven on grass of public lands unless directed
to do so by the Borough or its designees. The Borough and agencies
authorized by the Borough is exempt from this provision in the performance
of such duties required to enter said areas.
D.
Prohibited vehicles. ATVs (all-terrain vehicles), utility terrain
vehicles, snowmobiles, trailbikes, and other similar vehicles shall
not be operated on public lands, including without limitation, parks,
playgrounds and designated open space, unless such vehicles are authorized
by a designated and marked trail for said use or authorized under
a sanctioned event by Borough Council.
F.
Police officers for the Borough of Bath and Bath Code Enforcement
Officers are each hereby authorized to enforce the provisions of this
section. Any person or persons, firm or corporation violating any
of the provisions of this section shall, upon conviction before a
Magisterial District Judge in a summary proceeding, be liable to and
shall pay a fine of not more than $100 plus costs for every violation.
In addition, court costs and reasonable attorney fees incurred by
the Borough in enforcement proceedings shall be assessed against violator
and awarded to the Borough.
