No person using any park or recreation area owned, leased, maintained or operated by the Borough shall do any of the following while so using such park or area:
(A) 
Cut, mutilate, remove or destroy in any manner any tree, shrubbery, flower, plant or weed therein;
(B) 
Deface, mark, damage, remove or destroy any building, post, fence, gate or guard railing in such park or area or any other park or recreational property;
(C) 
Use or distribute alcoholic or other intoxicating beverages, become intoxicated, use or distribute controlled substances, as defined by the statutes of the Commonwealth, become intoxicated or come under the influence of any such drugs, use indecent, profane, obscene or blasphemous language, or conduct himself or herself in any disorderly manner, including the playing of radios, cassette players or the like in a loud and offensive manner;
(D) 
Permit the entry of a dog or other domesticated animal into such park;
(E) 
Litter the park or area with trash, refuse or garbage or place trash, refuse or garbage anywhere except in containers provided for that purpose;
(F) 
Park cars or other motor vehicles anywhere within such park or area except in places designated for parking;
(G) 
Use any such park or area at hours other than from 9:00 a.m. to sundown, except with written permission;
(H) 
Throw, discharge or otherwise place or cause to be placed into the waters of any fountain, pond, lake, stream or other body of water in or adjacent to any such park or area or into any tributary, stream, storm sewer or drain flowing into such waters, any substance, matter or thing, liquid or solid, which will or may result in the pollution of such waters;
(I) 
Use any such park or area, unless the person so using such park or area is a resident of the Borough, except that nonresidents may use any such park or area if it is not being used by Borough residents and no Borough resident has expressed a desire to use the park or area. Borough residents are hereby given priority to use all such parks and areas within the Borough, except when nonresidents are engaged in organized recreational activities sponsored or otherwise permitted by the Borough;
(J) 
Commit any of the following acts within parks or playgrounds without the previously obtained consent of the Borough:
(1) 
Play any music, except personal radios at a reasonable volume;
(2) 
Deliver any public speech;
(3) 
Hold any public meeting or engage in any marching or driving as members of a military, political or other organization;
(4) 
Post or display any sign, banner or advertisement;
(5) 
Hold any picnic at a place not designated for that purpose, unless with written permission. There shall be no open fires;
(6) 
Violate regulations relating to the use of any building or place;
(7) 
Damage any notice or sign posted by order of the Borough;
(8) 
Perform digging of any kind;
(9) 
Use bows and arrows;
(10) 
Trap or remove any wild animal from a park;
(11) 
Allow any animal to enter a park in violation of § 614.19 of the General Offenses Code;
(12) 
Fly any gasoline-driven model airplane;
(13) 
Ride any bicycle within any park, except on designated paths;
(14) 
Strike golf balls, throw or pitch horseshoes or cause any sharp object to become airborne;
(15) 
Operate a motor vehicle except on those areas specifically designed and constructed for vehicular traffic;
(16) 
Exceed the legal speed limit of five mph on any park roadway or parking lot. This shall not apply to fire or police vehicles, ambulances or vehicles used by physicians when actually engaged in responding to emergency calls;
(17) 
Drive a truck in any park, except for deliveries. No truck weighing over 10,000 pounds shall be permitted;
(18) 
Road-test vehicle or instruct driving in any park, including on roadways or in parking areas therein;
(19) 
Shine spotlights or any flashlight into any vehicle or at any person from a moving vehicle or from a fixed position, except by duly authorized personnel; and
(20) 
Wash, repair or otherwise service automobiles in any park, including on roadways and in parking areas therein.
Any group of 15 or more persons seeking to conduct a group activity in any park or recreation area owned, leased, maintained or operated by the Borough shall apply to the Borough Secretary of the Borough for a permit to conduct such activity. The applicant shall supply the following information to the Borough Secretary:
(A) 
The name of the person or organization wishing to conduct such activity;
(B) 
If the activity is to be conducted for or on behalf of or by an organization, the name, address and telephone number of the headquarters of the organization and of the authorized and responsible head of such organization;
(C) 
The name, address and telephone number of the person who will be the Chairperson of such activity and who will be responsible for its conduct;
(D) 
The name, address and telephone number of the person or organization to whom the permit is desired to be issued;
(E) 
The date such activity is to be conducted;
(F) 
The park or recreation area portion thereof for which such permit is desired;
(G) 
An estimate of the anticipated attendance;
(H) 
The hours such activity will begin and terminate; and
(I) 
If the activity is to include the cooking of food, the nature, type and location of any fire intended for such cooking.

The Borough Secretary shall grant and issue the permit required by § 1062.02 if:
(A) 
The proposed activity or use of the park or recreation area will not unreasonably interfere with or detract from the general public enjoyment of the park;
(B) 
The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation;
(C) 
The facilities desired have not been reserved for other use at the day and hours specified in the application;
(D) 
The conduct of such activity will not substantially interrupt the safe and orderly movement of traffic;
(E) 
The conduct of such activity will not require the diversion of so great a number of police officers of the Borough to properly police such activity and the areas contiguous thereto as to prevent normal police protection of the Borough;
(F) 
The conduct of such activity is not reasonably likely to cause injury to persons or property or to incite violence, crime or disorderly conduct; and
(G) 
The applicant deposits with the Borough Secretary $25 as security for the faithful observance of the requirements of § 1062.01 and the conditions of the permit. If the applicant faithfully observes such requirements and conditions, such deposit shall be returned to the applicant. If the applicant fails to comply with the requirements of § 1062.01 and the conditions of the permit, such deposit shall be forfeited.

Each permit shall state the following:
(A) 
The date of such activity;
(B) 
The park or recreation area or portion thereof to be used;
(C) 
The hours such activity will begin and terminate;
(D) 
The nature of the activity; and
(E) 
The nature, type and location of any fire which may be permitted.
