The purpose of the Environmental Advisory Council is to advise the Township Board of Commissioners on matters dealing with protection, conservation, management and use of natural resources, including air, tree, land and water resources located within the limits of Upper Gwynedd Township, to assist in the ongoing efforts of the Board of Commissioners to preserve open space within the Township, and to help educate residents of Upper Gwynedd about the importance of environmental protection.
The Upper Gwynedd Township Environmental Advisory Council ("Council") is hereby created, pursuant to the authority of the Act of the Commonwealth of Pennsylvania of December 21, 1973, No. 148.
The Council shall be composed of not more than seven and not fewer than five residents of the Township appointed by the Board of Commissioners. Whenever possible, one member shall also be a member of the Planning Commission.
The Board of Commissioners, at its first regularly scheduled meeting of each calendar year, shall designate the Chairperson of the Council. The Chairperson, at the first regularly scheduled Council meeting, shall designate a Vice Chairperson and a Secretary.
Council members shall serve for the term of three years, except that the terms of the members shall be so staggered that two members' terms shall expire December 31, 2021, and three members' terms shall expire December 31, 2022. Thereafter, all appointments shall be for a term of three years, with the exception of members appointed by the Board of Commissioners to fill a vacancy, in which case the member shall serve out the remainder of the term of their predecessor.
The Board of Commissioners shall appropriate funds for the expenses incurred by the Council during the annual budget process. All expenditures must be submitted and approved by the Finance Director of the Township.
The Council shall have the following advisory powers and duties:
A. 
To identify environmental problems and recommend plans and programs for their resolution to the appropriate governmental agency of the Township, which shall include but not be limited to the Planning Commission and the Board of Commissioners.
B. 
To make recommendations to the possible use of open land areas in the Township.
C. 
To keep an index of all open areas in the Township, publicly or privately owned, including but not limited to flood-prone areas, swamps, and other unique natural areas, for the purpose of obtaining information on the proper use of such areas.
D. 
To advise the appropriate local government agency in the acquisition of property, both real and personal, by gift, purchase, grant, bequest, easement, devise or lease in matters dealing with the purpose for which the Council is created.
E. 
To make recommendations and regulations for the care and protection of shade trees.
F. 
To review of all land development plans to encourage use of native plants and environmentally sustainable practices where feasible.
The Council shall meet, at a minimum, once per month at a time and location to be determined by vote of its members. The Council shall keep records of its meetings and activities and shall make an annual report to the Board of Commissioners, which shall be made publicly available. Minutes of each meeting of the Council shall be forwarded to the Board of Commissioners.
