The purpose of the Residential III District is to designate those areas which have multifamily structures and high-density residential development; to protect adjacent residential districts; and to provide a buffer or transition area between business districts and low-density residential districts.
Permitted uses in the Residential III District are as follows:
A. 
Dwelling, multifamily rental unit.
B. 
No impact-based home business.
C. 
Accessory uses to the above.
Permitted accessory uses in the Residential III District are as follows:
A. 
Garage, private.
B. 
Gardening.
C. 
Storage shed (owned by the developer).
D. 
Parking areas or lots.
E. 
Garbage storage facilities (permanent; owned by the developer).
F. 
Accessory uses to the above.
Special exceptions may be permitted by the Zoning Hearing Board, following review and comment by the Planning Commission, pursuant to standards and criteria as set forth in Article XV, § 500-105D:
A. 
Apartment houses.
B. 
Flats.
C. 
Row houses.
D. 
Garden apartments.
E. 
Condominiums.
F. 
Townhouses.
Height regulations shall be 35 feet, including rooftop units.
Unless otherwise specified herein, lot area and impervious coverage requirements of the following dimensions shall be provided for each structure or use hereafter erected, established or altered for any use permitted within the district.
A. 
Minimum lot area: two acres.
B. 
Minimum lot width: 200 feet.
C. 
Maximum coverage: 80% of impervious surfaces (structures, parking, etc.).
D. 
Maximum building height: 35 feet, including rooftop units.
E. 
At least 20% of the lot area shall be maintained in a vegetative cover.
The following setback regulations apply to all uses permitted within this district, unless otherwise specified herein:
A. 
Front yard: minimum front yard setback of 15 feet from the edge of the pavement.
B. 
Side yard.
(1) 
All principal structures adjacent to the R-1 District: the setback shall be 20 feet.
(2) 
All principal structures adjacent to the B-2 District: the setback shall be 15 feet.
C. 
Rear yard.
(1) 
All principal structures adjacent to the R-1 District: the setback shall be 20 feet.
(2) 
All principal structures adjacent to the B-2 District: the setback shall be 15 feet.
The setback regulations for accessory structures shall be the same as required for the principal use.
The provisions of § 500-74, Yard requirements, shall apply in the Residential III District, except that front yards may be used for vehicular parking, parking spaces in a driveway, and for driveways. Parking shall not be on a grass surface; parking shall only be on a stabilized constructed surface.
A. 
Group projects (housing, commercial, educational, medical or religious) of two or more buildings are to be constructed on a parcel of at least two acres in area which will not be subdivided into lots; and streets may be constructed, provided that:
(1) 
Uses shall be limited to those permitted within the district in which it is located.
(2) 
Density and building coverage requirements of the district are met.
(3) 
There shall be a vegetative buffer planted in the buffer strip where such group development abuts a residential district.
B. 
Screening shall be required as set forth in § 500-67.11.
A. 
A buffer yard of not less than 15 feet in width shall be provided along the lot lines where it abuts an R-1 District. Buffer yards may coincide with building setbacks.
B. 
All buffer yard areas shall be planted and maintained with a vegetative material, and a screen planting shall be planted and maintained to the full length of the lot lines which abuts a residential district.
C. 
Buffer yards shall be maintained and kept free of all debris and rubbish.
D. 
No structure, manufacturing or processing activity or storage of materials shall be permitted in buffer yards. However, access roads, service drives, and utility easements not more than 35 feet in width are permitted to cross a buffer yard, provided that the angle of the center line of the road, drive or easement crosses the buffer yard at an angle not less than 60°.
E. 
Prior to the issuance of a building permit, plans for buffer yards shall be submitted for review and approval to the Zoning Officer. Said plans shall show the arrangements of all of the buffer yards and the placement, species and size of all plant materials to be placed in such buffer yard. Said plan must be reviewed by the Planning Commission and approved by the Borough Council before a building permit may be issued.
Where required, screen plantings shall be located in accordance with the following requirements:
A. 
Plant materials used in screen planting shall be at least four to six feet in height when planted at the maximum spacing for the tree and shall be of suitable vegetation in order to produce, within three years, a complete year-round visual screen of at least 10 feet in height, which may include a combination of both earth berm and screen planting.
B. 
The screen planting shall be maintained permanently, and any plant material which does not live shall be replaced within one year.
C. 
The screen planting shall be broken only at points of vehicular or pedestrian access or required utility rights-of-way.
D. 
Trees that shall not be used in planting of buffer yards are:
(1) 
Poplars, all varieties.
(2) 
Willows, all varieties.
(3) 
White or silver maple.
(4) 
Aspen, all varieties.
(5) 
Common black locust.
E. 
Wherever possible, natural vegetation shall be maintained as the required screening material. Natural earth berming may be included as part of the screening requirement to create visual height and natural grade change to make the buffer appear as a natural habitat.
F. 
Screen plantings shall be provided between the property line and any off-street parking area and any outdoor solid waste storage area for any multifamily, townhouse, commercial or manufacturing use where the parking or solid waste disposal area abuts a residential zoning district or a lot occupied by a residential use.
G. 
Any existing multifamily, commercial or industrial use shall not be required to comply with the screening requirements except in case of enlargement or exterior alteration of same.
