As used in this article, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended:
BOROUGH
The Borough of Abbottstown.
MOTOR VEHICLE
A vehicle which is self-propelled, except one which is propelled solely by human power or by electric power obtained from overhead trolley wires, but not operated upon rails.
POLICE
The Chief of Police of the Borough of Abbottstown or any law enforcement officer of the Borough.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon rails or tracks.
A. 
In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the streets of Abbottstown Borough, the Mayor may declare a snow and ice emergency (designated in this article as a "snow emergency"). Information on the existence of a snow emergency shall be given by the Borough through radio on either WGET (Gettysburg) or WHVR (Hanover), or on the Borough website, or on social media.
A. 
After any snow emergency is declared, it shall be unlawful, at any time during the continuance of the snow emergency, for any person:
(1) 
To park a vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in § 197-39 of this article or on any no-parking zone designated in § 197-40 of this article.
(2) 
To drive any motor vehicle on any such snow emergency route, unless that motor vehicle is equipped with snow tires, chains or tires approved by the Pennsylvania Turnpike Commission.
A. 
The following are designated as snow emergency routes:
(1) 
The full length of East and West Fleet Streets.
(2) 
The full length of East and West Water Streets.
(3) 
North and South Country Club Road, between East Water Street and East Fleet Street.
(4) 
North Abbott Street, from West Water Street to West King Street.
(5) 
Jackson Street, from West Fleet Street to West King Street.
Parking shall be prohibited along all Borough streets and alleys during all snow emergencies. A snow emergency shall exist whenever two inches of snow or ice has accumulated or when declared by the Mayor of Abbottstown. The snow emergency shall be in effect until the streets and alleys are cleared of snow or salted and cindered.
A. 
If, at any time during a period of snow emergency declared under § 197-37 of this article, any person shall park a vehicle or allow a vehicle to remain parked anywhere upon a snow emergency route or in a snow emergency no-parking zone, that person shall, upon conviction, be sentenced to pay the fine of $50 for each incident (every day in violation), together with costs which may be assessed by law.
B. 
If, at any time during a period of snow emergency declared under § 197-37 of this article, any person shall drive a motor vehicle upon a snow emergency route without having the motor vehicle equipped with snow tires or chains, that person shall, upon conviction, be sentenced to pay the fine of $50 for each incident (every day in violation), together with costs which may be assessed by law.
Any vehicle which has been ticketed for violation of this article shall be immediately removed by its owner either from the snow emergency route or snow emergency no-parking zone. If the motor vehicle is not removed from the snow emergency routes or the snow emergency no-parking zone within one hour of being ticketed, the Borough shall have the authority to remove and impound or to order the removal and impoundment of any vehicle which remains parked in violation of this article, pursuant to the provisions and procedures contained in Article VIII of this chapter authorizing the removal and impoundment of illegally parked vehicles by the Borough Council under authority of § 6109(a)(22) of the Pennsylvania Vehicle Code. All costs incurred in the removal and impoundment of any vehicle shall be paid by the owner of the vehicle.
Motorists are required to clear snow and ice from their own on-street parking spaces.
Enforcement of this article shall be implemented by the Chief of Police or any law enforcement officer of the Borough.
