This chapter shall be known and designated as the "Library Property
Ordinance of the Township of Pequannock."
No person, corporation, agency or other association shall retain
or fail to return any book, periodical, pamphlet, artistic reproduction,
recording, audio-visual material or any other article borrowed from
the Pequannock Township Public Library after 30 days have elapsed
from the date of posting of a notice demanding return thereof. Such
notice shall be addressed to that individual borrowing such article
at the last address furnished by such individual to the Pequannock
Township Public Library and shall be forwarded by certified mail,
return receipt requested.
No person, corporation, agency or other association shall cut,
tear, deface, disfigure, destroy or damage in any way any book, periodical,
pamphlet, artistic reproduction, recording, audio-visual material
or any other article which has been borrowed from, is owned by or
is in the rightful custody of the Pequannock Township Public Library.
No person, corporation, agency or other association shall register
or furnish to the Pequannock Township Public Library a false or fictitious
name or address for the purpose of borrowing any book, periodical,
pamphlet, artistic reproduction, recording, audio-visual material
or any other article. No person, corporation, agency or other association
shall use without the permission of the rightful owner any library
card issued by the Pequannock Township Public Library for the purpose
of borrowing any book, periodical, pamphlet, artistic reproduction,
recording, audio-visual material or other article.
No person, corporation, agency or other association shall remove
any book, periodical, pamphlet, artistic reproduction, recording,
audio-visual material or any other item from the Pequannock Township
Public Library unless such person, corporation, agency or association
shall have first charged such item to the proper library card in accordance
with the provisions of this chapter.
The provisions of this chapter shall be applicable to the main
office of the Pequannock Township Public Library as well as to all
other branches established within the Township of Pequannock.
The provisions of this chapter shall be enforceable by the Director
of the Pequannock Township Public Library or by such other individual
as may be designated by the Board of Trustees of the Pequannock Township
Public Library.
Any person, corporation, agency or other association violating any provision of this chapter shall be subject, upon conviction thereof, to a fine not to exceed $1,000 for each separate offense. Should any such person, corporation, agency or other association be found to have violated §
203-2 or
203-3 of this chapter, such person, corporation, agency or other association shall be, upon conviction thereof, subject to a fine not to exceed $1,000 for each article detained or damaged. Continued failure to return any such article detained or to pay to the Pequannock Township Public Library its replacement cost or the replacement cost of any article damaged for a period of 30 days subsequent to conviction shall constitute a separate offense under this chapter.
