No person shall engage in the business of conducting a motel
without first having applied for and obtained a license from the Township.

Each applicant for a license under this chapter shall make written
application to the Director of Planning, setting forth:
A. The full
name, residence and post office address of the applicant.
B. The exact
location of the proposed licensed premises, giving the street address,
block and lot number, as shown on the Tax Assessment Map of the Township,
and the exact dimensions of the lands upon which the business is to
be conducted.
C. A description
of the buildings, structures and accommodations upon such lands, including
a statement of the number of housing or lodging units, the maximum
number of persons who can be accommodated at any given time, a description
of the character of such buildings or structures as to size, type
of construction and whether or not the same are fireproof and a description
of automobile parking space and facilities.
D. The name
and address of the owner of such lands and buildings.
E. A detailed
description of the register or system used for the registration of
persons to whom accommodations are extended.
F. Whether
any person constituting the individual or partnership applicant or
whether the corporate applicant or any stockholder holding 10% or
more of the stock thereof or any director or officer thereof has ever
been convicted of any crime and if so the details thereof, including,
with respect to each conviction, the name of the person convicted,
the date thereof, the nature of the crime, the court in which the
conviction was entered and the punishment imposed.
G. In the
case of corporate applicants, the names and residences of all stockholders
holding 10% or more of any stock of the corporation, the names and
residences of all members of the board of directors of the corporation
and the names and residences of all officers of the corporation and
the office held by each.
It shall be a prerequisite to the issuance of a license under this chapter that the applicant shall have complied with all pertinent provisions of this Code and other Township regulations and ordinances, including but not limited to Chapter
316, Subdivision of Land, Chapter
360, Zoning, and building provisions. Approval of the application shall also be subject to inspection and approval by the Health Officer and the Police Department.
No license required by this chapter shall be issued to any person
who has been convicted of a crime involving moral turpitude, nor shall
any such license be issued to any corporation in which any stockholder
holding 10% or more of any of the stock thereof or any director or
officer thereof shall have been convicted of a crime involving moral
turpitude.
The annual fee for a license under this chapter shall be as provided in Chapter
152, Fees.

A license issued under this chapter shall be for a maximum term
of one calendar year, commencing January 1 or the date of issuance
and expiring December 31, and where issued after January 1 of any
year the license fee shall be prorated accordingly. In the case of
new construction, a license shall be apportioned from the date of
the certificate of occupancy, and in no case later than six months
after the date of the building permit.

Application for transfer of license shall be made in writing
to the Director of Planning. Applicants shall be charged a transfer
fee of 10% of the annual license fee applicable to the particular
premises. Such fee of 10% shall be retained by the Township Council,
whether the transfer is granted or not.
Any license issued under this chapter may be suspended or revoked
for violation of this chapter, or for any conviction of any licensee
or of any stockholder holding 10% or more of the stock of any corporate
licensee, or director or officer thereof, of a crime involving moral
turpitude, after due notice of the charges and a hearing by the Township
Council, at which the licensee shall be afforded full opportunity
to be heard.
Each licensee under this chapter shall at all times cause to
be maintained on the licensed premises a register. Each register shall
be preserved for a period of one calendar year after last entry.
No housing unit shall be rented more than once in any twelve-hour
period.
The Health Officer shall be admitted by the licensee at any
time for the purpose of inspecting the licensed premises.
